The alleged incapacitated individual is Charles M. Nolen, III, hereinafter referred to as Chuck, who is an adult individual, born October 1, 1957, who resides in a group home at 829 Lisburn Road, Camp Hill, Cumberland County, pennsylvania. 2. Chuck's mother died on November 7, 2003 and his father died on October 5, 2006. 3. Chuck did not have any children. 4. Chuck has a brother, Randolph Nolen, who resides at 1030 Swarthmore Road, New Cumberland, Cumberland County, Pennsylvania. 5. Chuck has a half sister, Becky Yingling, who resides at 611 S. Main Street, Marysville, Perry County, Pennsylvania. 6. Chuck receives residential services through UCP, 925 Linde Lane, Camp Hill, Pennsylvania. '. 7 . Chuck works at CPARC/CIT, Silver Spring Road, Mechanicsburg, Pennsylvania. 8. Petitioner requests that he be appointed primary guardian of his brother and that his wife, Tracey Nolen, be appointed alternate guardian. 9. Neither Petitioner nor his wife have an interest adverse to Chuck's. 10. Petitioner seeks guardianship since Chuck is not able to handle his own financial or other personal affairs. 11. Chuck had resided with his mother from birth until her death in October 2003. 12. Chuck resided with his brother from October 2003 until he went to the group home in July 2005. 13. Chuck has Down's syndrome, seizure disorder, hypothyroidism, Alzheimer's, dementia, insomnia, dyslipidema, hypoglycemia and he is post stroke which further limited his mental functioning. 14. Chuck is physically limited with arthritis, spinal surgery, foot surgery and eye surgery. 15. Chuck is challenged mentally, he is forgetful, unable to make decisions, tends to wander and will respond to the same question with different answers. 16. Chuck is currently able to dress himself, perform some household chores and provide his own basic personal hygiene with close supervision. 17. Petitioner has been Chuck's social security representative payee since his mother died. 18. Chuck receives $1,178 each month in social security from his father's account. 19. Chuck works at CPARC/CIT and his income pays for his lunch and other personal expenses related to working. 20. Chuck has a savings account at PSECU with approximately $600.00. 21. Petitioner has been responsible for and been paying for Chuck's needs and wants since October 2003. WHEREFORE, it is requested that Randolph Nolen be appointed the legal guardian of the person and estate of his brother, Charles M. Nolen, III, and that Tracey Nolen be designated as his alternate. ~lVf)). ~ Thomas D.
