Mayberry Respondent/Defendant CIVIL ACTION LAW Approval of Minor Settlement Petition for Approval of Minor's Settlement 1. Your Petitioner, Jessica Barrick, is the parent and guardian of Zacharie C. Armold, a minor, all the aforesaid reside at 124 Tower Circle, North Middleton Township, Cumberland County, Pennsylvania. 2. The respondent, Ray A. Mayberry, is an adult individual residing at 31 E. South Street, Carlisle, Cumberland County, Pennsylvania. 4. On December 7, 2001, the minor plaintiff was injured as the result of a motor vehicle accident. 5. As a result of the accident which occurred on the aforesaid date the minor child suffered a laceration and was subjected to medical treatment all of which has been paid for by first party benefits. 6. The minor plaintiff's injury has healed but he is left with a scar below his eye. 7. The parties are desirous to conclude this matter and have agreed upon a settlement, as follows: THE PARTIES AGREE AS FOLLOWS: Insurer, State Farm Automobile Insurance Company will pay the following to the Plaintiffs on behalf of the Defendants: The sum of $12,500.00 on December 5, 2002 and The sum of $69,093.33 on December 11, 2014 8. All sums set forth above constitute damages on account of personal injuries, arising from the occurrence, within the meaning of § 104(a)(2) of the Internal Revenue Code of 1986, as amended. 9. Your petitioners have entered into a one-third contingency fee agreement with counsel. In accordance with the fee agreement the fee would be $16,666.66. Counsel for the petitioners have agreed to reduce the fee to twenty-five percent in the amount of $12,500.00. WHEREFORE, Petitioners pray that the settlements be a~p~oved. William P.
