CUSTODY CONCILIATION SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8, the undersigned Custody Conciliator submits the following
report:
1. The pertinent information concerning the Children who are the subject of
this litigation is as follows:
NAME DATE OF BIRTH CURRENTLY IN CUSTODY OF
Emily J. Corica April 13, 1997 Father
John N. Corica June 30, 1999 Mother
Alexander M. Corica September 26, 2003 Mother

following individuals in attendance: The Mother, Courtney J. Leinberger, with her
counsel, Marcus A. McKnight, III, Esquire, and the Father, Michael D. Corica, pro se.
3. The Honorable Kevin A. Hess previously entered Orders of Court dated
March 30, 2007, April 18, 2008 and October 9, 2008 providing for shared legal custody,
Father having primary physical custody of Emily and Mother having primary physical
custody of John and Alexander, and alternating weekends so the children would be
together on weekends.
4. Mother's position on custody is as follows: Mother seeks shared legal and
primary physical custody of Emily. Mother indicates that the child has expressed a desire
to live primarily with Mother. She maintains that Father leaves Emily in charge of the
younger children and Father disparages Mother in front of the children. She further
maintains that Father gets drunk in front of the children and that Father's girlfriend is in
charge of discipline for the children.
5. Father's position on custody is as follows: Father seeks to maintain the
status quo. He maintains that Mother too has Emily babysit for the younger children, that
Mother gets drunk and that she inappropriately put the child's picture on MySpace. He
asserts that Mother is not concerned about the children's education; that the younger boys
in Mother's primary custody are doing poorly in school, but that Emily does well in
school.
6. The Conciliator recommends an Order in the form as attached scheduling
a Hearing and maintaining the status quo. It is expected that the Hearing will require
one-half day.

The Petition was filed for Courtney J. Leinberger, Defendant/Petitioner

6. Marylou Matas, Esquire, did not indicate any objection to the continuance.
7. Marylou Matas, Esquire, was going to check with her client regarding dates
for the rescheduled hearing.
8. Although counsel for Father has left several messages for Marylou Matas,
Esquire, this week, there has been no further communication.
9. It is believed that Attorney Matas may be having difficulty reaching her
client because Mother was evicted from her most recent residence on May
14, 2010.
10. Mother has moved at least five (5) times since September, 2009. Each of
these moves has been the result of Mother being evicted or being asked to
leave the residences of family members because of her behavior.
11. Cumberland County Children and Youth contacted Father on May 14, 2010,
and asked him if he could take care of the parties' two young sons.
12. All three of the parties' minor children are now with Father at his residence

PRIOR JUDGE: Kevin A. Hess, J.
IN THE COURT OF COMMON PLEAS OF
CUMBERLAND COUNTY, PENNSYLVANIA
N0.2007-715 CIVIL ACTION-LAW
IN CUSTODY
CUSTODY CONCILIATION SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8, the undersigned Custody Conciliator submits the following
report:
1. The pertinent information concerning the Children who are the subject of
this litigation is as follows:
NAME DATE OF BIRTH CURRENTLY IN CUSTODY OF
Emily J. Corica April 13, 1997 Father
John N. Corica June 30, 1999 Father
Alexander M. Corica September 26, 2003 Father
2. A Conciliation Conference was held July 13, 2010 with the following
individuals in attendance: The Mother, Courtney J. Leinberger, with her counsel,
Marylou Matas, Esquire, and the Father, Michael D. Corica, who is represented by Nora
F. Blair, Esquire, but with the consent of Father did not appear.
3. The Honorable Kevin A. Hess previously entered Orders of Court dated
March 30, 2007, April 18, 2008, October 9, 2008, June 23, 2010 providing for shared
legal custody, Father having primary physical custody of Emily and Mother having
primary physical custody of John and Alexander, and alternating weekends so the
children would be together on weekends. The Orders also provide for the parents to
share physical custody of Emily in the summer on a week on/week off basis. The June
23, 2010 Order denied Father's request for primary physical custody of all of the
children, although it was captioned as a Motion for Continuance, and scheduled a hearing
for August 27, 2010.
4. Also pending is Mother's previous Petition for Modification which has
been continued for several months. Mother's prior Petition for Modification was for
primary physical custody of Emily. Mother indicates she will file a Petition for
Contempt based on Father's refusal to transfer the two younger children to her consistent
with the June 23, 2010 Order of Court, and Father's failure to obtain counseling or to
begin a custody evaluation consistent with the Order of Court dated October 9, 2008.
4. Mother's position on custody is as follows: Mother seeks shared legal and
primary physical custody of all of the children, with Father having alternating weekends
with the children. Mother indicates that Emily reports being slapped by Father and
otherwise being emotional abused. Mother also reports that the child has expressed a
desire to live primarily with Mother. Mother maintains that the children did not do well
in school while in Father's primary physical custody. Emily missed 38.5 days of school
during the 2009-2010 school year. Mother seeks Father's approval for the two younger
children to begin counseling.
4. Father's position on custody is as follows: Father seeks shared legal and
primary physical custody of the children, with Mother having supervised custody on
alternating weekends, but does not have a suggestion of who the supervisor would be.
He maintains that Mother has unstable housing and insufficient furniture to accommodate
the children. Mother only recently moved into low-income housing. He maintains that
Children & Youth Services was previously involved when Mother was evicted from her
housing. He asserts that Emily was raped and started using illegal drugs while in the
custody of Mother. Father is looking into counseling for Emily. He is in agreement to
start the younger children in counseling provided he has the right to approve who the
counselor is.
5. The Conciliator recommends an Order in the form as attached scheduling
a Hearing and maintaining the status quo with the inclusion of counseling for the younger
children if Father approves the counselor. The hearing should be scheduled on August
27, 2010 at 1:30 p.m.
