HomeMy WebLinkAbout02-5659STIPULATION AGAINST LIENS THIS AGREEMENT made the I~T~ of November, 2002, by and between COVE MOUNTAIN HOMES, INC., g~RY F' G~UDIo and JUDITH~ GAUDI0 he-^~-- . w~£, whereby the former un~^~ ~ C ~=~fter referred to c~nstruct a single famil~ ~oo~ an~ agreed to erect and as situate in ] u~=x~lng on that certain lot of ground Lot 2, Fox Hollow Road, High Meadow, Lower Allen Township, Cumberland County NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, COvenant and agree that no mechanic,s liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic,s liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent COvenant. (Seal) by (Seal) _(Seal) (Seal) ALL THAT CERTAIN lot or tract of land being situated along the East side of Lisburn Road, SR 2017, in Lower Allen Township, Cumberland County, Pennsylvania, said lot being shown as Lot No. 2 on a Final Subdivision Plan for High Meadow, Phase 4, dated July 19, 1996, and last revised August 27, 1997, as recorded in the office of the Recorder of Deeds in and for Cumberland County, in Plan Book 75, Page 94; said lot being more particularly bounded and described as follows: BEGINNING at a point on the Western right-of-way line of Fox Hollow Road, said point being the Northeastern corner of the above referenced lot and the Southeastern corner of Lot No. 1 as shown on the above referenced Subdivision Plan; thence along the same right-of-way, the following two (2) courses and distances: 1) a curve to the right with a radius of 239.13 feet and an arc length of 76.70 feet to a point; 2) South 27 degrees 34 minutes 57 seconds East, 90.40 feet to a point; thence along the Northern property lines of Lot No. 3, the following two (2) courses and distances: 1) South 62 degrees 25 minutes 03 seconds West, 108.70 feet to a point; 2) South 47 degrees 59 minutes 30 seconds West, 165.40 feet to a point on the Eastern right-of-way line of Lisburn Road (SR 2017); thence along the same right-of-way line, North 42 degrees 00 minutes 30 seconds West, 110.00 feet to a point; thence along the Southern property lines of Lot No. 1, the following two (2) courses and distances: 1) North 47 degrees 59 minutes 30 seconds East, 165.71 feet to a point; 2) North 36 degrees 50 minutes 00 seconds East, 137.04 feet to a point, being the Point of BEGINNING. CONTAINING an area of 35,320 square feet (0.811 acres). SUBJECT to all rights-of-way, easements and restrictions of record on the date hereof. BEING THE SAME PREMISES which New Penn Motor Express, Inc., by deed to be recorded simultaneously herewith in the Cumberland County Recorder of Deeds Office to grant and convey unto Gregory J. Gaudio and Judith A. Gaudio.
