ANSWER TO NEW MATTER
AND NOW, comes the Plaintiff, Anita Lowe, by and through her attorneys,
Mancke, Wagner, Tully & Spreha, and files the following Answer to New Matter:
19. Denied. It is denied that Plaintiff's Complaint fails to state a claim upon
which relief may be granted.
20. Denied. It is denied that Plaintiff's claim is barred by the Doctrine of
Contributory Negligence and/or comparative negligence.
22. Denied. It is denied that Plaintiff assumed the risk of her alleged
injuries.
23. Denied. It is denied that the accident on June 26, 2001, did not
substantially cause Plaintiff's harm.
24. Denied. It is denied that Plaintiff failed to mitigate her damages.
WHEREFORE, Plaintiffrequests this Court to dismiss the New Matter of
Defendant, Robert Cassel, to be dismissed.
