Waiver of Mechanics Lien
WHEREAS, John F. Walter Excavating, Inc. of P. O. Box 175, Newville,
Pennsylvania 17241 entered into a contract dated ~o. %~ ~ , ("Contract")
with S & A Custom Built Homes, Inc. to provide materials and perform labor
necessary for the site improvements at Chesterfield, Phase II, Section 2A, Borough of
Carlisle, Cumberland County, Pennsylvania, and more particularly described in a
deed recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Deed Book V, 31, Page 351, Tract 1 only.
NOW, THEREFORE, it is hereby stipulated and agreed that neither the
undersigned contractor, any sub-contractor or material man, nor any other person
who furnished labor or materials to the contractor under the Contract will file a lien,
commonly called a mechanics' lien, for work done or materials furnished to the said
site improvements or any part thereof.
This stipulation is made and intended to be filed with the Prothonotary
for the County of Cumberland, Commonwealth of Pennsylvania in accordance with
Section 401 of the Mechanics' Lien Law of 1963, codified at 49 P.S. §1401 (Purdon
1965), of the Commonwealth of Pennsylvania in such case provided.
IN WITNESS WHEREOF, the undersigned heret~kintending to be
legally bound, have set their hands and seals this ~ ~ day of

himself to be the Vice President of JOHN F. WALTER EXCAVATING, INC.,
and he being authorized to do so, executed the foregoing Waiver of Mechanics
Liens for the purposes therein contained by signing the name of
JOHN F. WALTER EXCAVATING, INC. by himself as an officer, and
desired that the same might be recorded as such.
