Kusic, Esquire and respectfully makes his Complaint as follows: 1. Plaintiff, Timothy D. Hoffman, is an adult individual doing business as Hoffman's Custom Contracting and resides at 21 Annendale Drive, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendants, William Lumadue, Jr. and Tina Lumadue, are adult married individuals residing at 13 Keystone Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. On or about January 3, 2001, Plaintiff and Defendants entered into a Construction Agreement for the construction of a residential dwelling unit. A copy of said Agreement is attached hereto, made a part hereof and marked Exhibit ~A~. 4. Plaintiff avers that he has substantially completed the dwelling unit for which he was contracted. 5. Plaintiff avers that Defendants have defaulted under the tentis and conditions of the Construction Agreement by failing to make payments to Plaintiff in accordance thereof. 6. Plaintiff did bill and Defendants have failed to pay the amounts set forth in Plaintiff's Final Report revised November 8, 2001 and Invoice number 356 dated March 25, 2002. Copies of said Report and Invoice are attached hereto, made a part hereof and marked Exhibit "B'. 7. Plaintiff has granted Defendants credit for all payments received and a balance remains due and owing in the amount of $6,789.94. 8. Plaintiff has made demands upon Defendants for the balance due and owing of $6,789.94, which demands remain unheeded. 9. Plaintiff avers that the amount claimed due does not exceed the jurisdictional amount requiring referral to arbitrators under local rule. WHEREFORE, Plaintiff prays your Honorable Court to enter Judgment in his favor and against the Defendants in the amount of $6,789.94 along with interest at the legal rate and the costs of this proceeding. LACK OF JURISDICTION OVER SUBJECT MATTER AND/OR IMPROPER VENUE: Pa. R.C.P. 1028 (a) (1) 1. Plaintiff avers that his claim is based upon an alleged written agreement, a portion of which is attached to the Complaint as "Exhibit A". 2. Said document ("Exhibit A") provides in relevant part as follows: "J. DISPUTE RESOLUTION AND ATTORNEY'S FEES Any controversy or claim arising out of or related to this Agreement involving an amount of less than $5,000 (or the maximum limit of the court) must be heard in the Small Claims Division of the Municipal Court in the county where the Contractor's office is located. Any controversy or claim arising out of or related to this Agreement which is over the dollar limit of the Small Claims Court must be settled by binding arbitration administered by the American Arbitration Association in accordance with the Construction Industry Arbitration Rules. Judgment upon the award mhy be entered in any Court having jurisdiction thereof." 3. Plaintiff's Complaint alleges the amount in controversy is $6,789.94· LAW OFFICES SNELBAKER, BRENNEMAN & SPARE 4. The District Justice Court system is the "Small Claims Division of the Municipal Court" in Cumberland County. 5. The maximum jurisdictional limit of the District Justice Court system is $8,000 exclusive of interest and costs: 42 Pa. C.S.A. § 1515 (a) (3). 6. Based upon the Plaintiff's own writing, this Court has no jurisdiction over the subject matter, and/or the venue is improper, said action to be heard exclusively in the appropriate District Justice Court as the "Small Claims Division of the Municipal Court". WHEREFORE, Defendants request the Court to dismiss Plaintiff's Complaint for lack of jurisdiction over the subject matter and/or for improper venue pursuant to Pa. R.C.P. 1028 (a) (1) and to enter judgment herein in favor of Defendants and against Plaintiff. B. FAIl JURE TO CONFORM TO RULE OF COURT: Pa. R.C.P. 1028 (a)(2) 7. Plaintiff alleges that his claim is based upon a written contract. 8. Pa. R.C.P. 1019 (i) requires Plaintiff to attach a copy of the written contract upon which said claim is based. 9. Plaintiff seeks damages for alleged sums due under a "Construction Agreement" ("Exhibit A" to Complaint), including sums allegedly due for "extra charges" without complying with Pa. R.C.P. 1019 (i) by failing to attach to the Complaint all of the relevant parts of the "Construction Agreement", including, but not limited to the following: "Additional Scope of Work pages" (¶ II), "Drawings and Specifications" (¶ III, O), "Page(s) attached" as "Additional Terms and conditions" (¶ III, O), "Draw Schedule" (¶ III, F, 1), "Change Orders" (¶ III, E, 4; ¶ m). R.C.P. 1028 (a) (2) and to enter judgment herein in favor of Defendants and against Plaintiff. C. LEGAL INSUFFICIENCY OF COMPLAINT (DEMURRER): Pa. R.C.P. 1028 (a) (4) 10. In the absence of pleading the required document on which his claim is based (as set forth in paragraphs 1 through 3 hereinabove), PlaintifFs Complaint is insufficient in that it fails to set forth a cause of action upon which the relief sought can be granted. WHEREFORE, Defendants request the Court to dismiss Plaintiff's Complaint for legal insufficiency pursuant to Pa. R.C.P. 1028 (a) (4) and to enter judgment herein in favor of Defendants and against Plaintiff. D. INSUFFICIENT SPECIFICITY OF COMPLAINT: Pa. 1028 (a) (3) 11. Plaintiff's Complaint fails to indicate with sufficient specificity all the monetary amounts charged by the Plaintiff in the performance of his agreement, fails to aver the amounts paid by Defendants to Plaintiff and fails to reconcile the total charges, payments and other credits.
