MOTION TO WITHDRAW MOTION TO MAKE RULE ABSOLUTE
AND NOW, comes Petitioners Shane B. Kope, Esquire, and Kope & Associates,
LLC and motions this Court to withdraw the Motion to Make Rule Absolute that was filed
on January 25, 2007 and in support of said Motion states as follows:
1. A Petition for Rule to Show Cause Why Administratrix Should not Be Ordered to
File an Inventory in Accordance with 20 PA.C.S.A. S 3301 (c) was filed in this matter on
December 6,2007.
2. A Rule was issued on December 8, 2007 by the Honorable Judge Kevin A.
Hess of this Court on the administratrixs of the estate of Jean E. Whitthoft to show
cause why they should not be required to file an inventory. The Rule was returnable
within twenty (20) days of service.
3. When no response was filed by the adminisratrixs within the twenty (20) day
deadline, Petitioner filed a Motion to Make Rule Absolute on January 5, 2007.

4. An answer to the Motion to Make Rule Absolute was filed by Respondent on
January 8, 2007.
5. The first Motion to Make Rule Absolute was denied by this Honorable court on
January 16, 2007.
6. A second Motion to Make Rule Absolute was subsequently filed on January 25,
2007 and this Honorable Court scheduled a hearing for February 22, 2007 at 3:00 pm.
7. Since the filing of that Motion to Make Rule Absolute and the scheduling of the
hearing there has been significant cooperation between the parties that has rendered
the hearing on this Motion moot.
8. Therefore, based on this cooperation of the parties in trying to resolve this
matter, Petitioner is respectfully requesting that the Motion to Make Absolute by
withdrawn and the hearing scheduled for today, February 22,2007 be canceled.
WHEREFORE, Petitioners Shane B. Kope, Esquire and Kope & Associates,
LLC, respectfully requests that this Court withdraw the Motion to Make Rule Absolute
filed in January 25,2007 and cancel the hearing scheduled for February 22,2007.
