AND NOW, this. 1."Sr 1 day of February, 2007, upon agreement of counsel after an in chambers
conference between counsel and the Court, it is ordered and directed as follows:
1. The Contempt Hearing scheduled in this case for February 23, 2007, is continued to May 24,
2007 at 9:30 a.m.
2. Counsel shall again meet with the undersigned on Friday, March 16, 2007 at 11 :30 p.m. to
report on the status of this case as set forth below.
3. An issue has arisen as to whether or not Mr. Mako of Summit Associates reviewed and
considered the.'leases owned by the Mandon Partnership in preparation of his January 23,
2007 appraisal report. Attorney Gilroy shall insure that all current leases for the property are
provided to Mr. Mako and shall request Mr. Mako to file a supplemental report/letter
acknowledging that he has had an opportunity to review the leases, and all amendments
thereto and indicating whether that review has any impact upon the valuation as set forth in
his January 23,2007 report. It is anticipated that Mr. Mako will issue an opinion with respect
to what impact, if any, the existing leases have on the valuation as set forth in his January 23,
2007 report.
