LAST WILL AND TESTAMENT
OF
JOHN T, NICKEL
I, JOHN T. NICKEL, of West Pennsboro Township (Mailing Address: 1708 Newville
Road, Carlisle, Pennsylvania 17013), Cumberland County, Pennsylvania, being of sound and
disposing mind, memory and understanding, do hereby make, publish and declare this as and for
my Last Will and Testament, hereby revoking lInd making void any and all Wills and Codicils
heretofore made.
I. I direct my hereinafter named Executrix to pay all of my just debts and funeral
expenses as soon after my death as muy be found convenient to do so.
2. All the rest, residue and remainder of my estate, real, personal and mixed, and
wheresoever the same may be situate,l give devise and bequeath to my wife, Violet F. Nickel, her
heirs and assigns, to the exclusion of any children, born and unborn, provided my said wife,
Violet F. Nickel, shall survive me by a period of ninety (90) days.
. 3. Should my said wife, Violet F. Nickel, predecease me or fail to survive me by the the
aforesaid period of ninety (90) days, then in such event all the rest, residue and remainder of my
estate, real, personal and mixed, and wheresoever the same may be situate, I give devise and
. bequeath as follows:
a. Two-thirds (2/3) in equal shares to the six (6) children of my wife, Violet F.
Nickel, their heirs and assigns, the share of any deceased child to pass to his or her issue, per
stirpes, and if there be no such issue then such share shall lapse. My wife's six (6) children are
Winifred F. Webber, born July 3,1940; Donald G. Hummel, born December 21,1941; Barry L.
Hummel, born August 7, 1944; Beverly J. Russel, born October 4, 1945; Kenneth L. Hummel,
born June 23, 1950; and Joan L. Hummel, born January 13, 1954.
b. The other one-third (1/3) in equal shares to the nieces and nephews of my late
wife, Helen B. Nickel, nee Burkholder, who are living at the time of my death, the share of any
deceased niece or nephew to lapse. At the present time the following eight (8) persons constitute
said nieces and nephews:
(I) The one (I) child of my late wife's brother, Robert Burkholder, who is
Roben Burkholder, Jr., of Shippensburg, Pennsylvania;
. (2) The Iwo (2) children of my late wife's brother, Paul Burkholder, who are
Ronald Burkholder, of Philadelphia, Pennsylvania, and Kay Burkholder Shildt, of Pittsburgh,
Pennsylvania;
(3) The three (3) children of my late wife's brother, William Burkholder, who
are Anne Louise Burkholder, Mark Burkholder, and Amy Burkholder, all of R.D. #2, Carlisle,
Pennsylvania;
(4) The twin daughters of my late wife's brother, John Burkholder, who are
Kim Burkholder and Karen Burkholder, both of R.D. #4, Carlisle, Pennsylvania.
4. Should any person less than 21 years of age share in my estate, I nominate, constitule
and appoinlthe Mellon Bank, Carlisle Office, I Nonh Hanover Street, Carlisle, Pennsylvania and
its successors and assigns, as Guardian of the estate of such minor person, and I authorize and
direct said Guardian 10 invest the same and to pay so much of Ihe income arising therefrom
together with so mu~h of the principal thereof as in the opinion of said Guardian is necessary or
desirable 10 be expended for the proper maintenance, support and education of such minor person,
10 the person havlllg custody of such minor person, and upon such person auaining 21 years of
age 10 pay him or her the then remaining principal together with any undistributed income.
5. I hereby nominate, constitute and appoint my said wife, Violet F. Nickel, as Executrix
of this my LasI Will and Testament, but should she predecease me or fail to qualify, Ihen in such
event I nominate, constitute and appoint Kenneth L. Hummel und Joun L. Hummel, or either of

them, as Co.exC'.cutors, and I further direct that none of Ihem shall be required to post an}' bond to
secure the faithful performance of his or her duties in the Commonwealth of Pennsylvanta or in
any other jurisdiction.
IN WITNESS WHEREOF, I have hereunto set my hand and seal 10 this my Last Will and
Teslament, written on two (2) pages, this 9th day of July . 1992.
