Anne was .thrown from the bicycle and apparently struck her head
on the. roadway, resulting in the injuries hereinafter set forth.
6. As a result of the accident, the minor sustained a
basilar skull fracture. She was admitted to the Milton S.
Hershey Medical Center and discharged to her home on June 25,
1992. She was subsequently seen by a neurologist, J. craig
Jurgensen, M.D., in Carlisle.
7. Portions of the hospital records and office notes of
Dr. Jurgensen arc attached as Exhibit "A". The doctor has
determined that the minor has made a good recovery from her
injuries and her parents concur.
B. The major portion of the medical expenses have been paid
by your petitioners' first party insurer, Central Pennsylvania
Teamsters Health and Welfare Fund. The subrogation claim of the
medical payments provider has been settled by the stoudts'
liability insurance carrier as shown on the copy of the check
attached as Exhibit "B".
9. The Stoudts' liability insurance carrier has offered the
minor a structured settlement at a cost of $50,000 which will
result in payments of $15,000 per year for four years beginning
November 15, 1999, plus $10,000 on November 15, 2003 as shown on
the schedule attached as Exhibit "C". In addition, your
petitioner.s will receive $1,000 in partial reimbursement for
their expenses.

DATE OF ADMISSION: 21 June 1992
DISCHARGE DIAGNOSIS:
1. Basilar skull fracture
CHIEF COMPLAINT: This is the' first Hershey Medical Center admission for this
ten year-old female who fell from her bike.
DATE OF DISCHARGE: 25 June 1992
BRIEF HISTORY: Anne Morrison fell from her bike on June 21, 1992 and was
taken to the Carlisle Hospital. She was amnestic for the event with an
approximately two minute loss of consciousness. She had two to three
episodes of vomiting with some confusion. A CT scan demonstrated a basilar
skull fracture. She was transferred to Hershey Medical Center for evaluation
and treatment.
Past medical history is negative except for sinus infections. No prior
surgeries. Current medications none. Allergies none. Physical
examination: Weight 37 kg, temperature 37.7, pulse 110, respirations 16,
blood pressure 112/67. There is a contusion over the right forehead. The
neck is supple and nontender. There is a fluid collection behind the left
tympanic membrane. There is no fluid in either external auditory.canal.
Pupils are equal, round and reactive to light. EOM's are .intact. The
oropharynx is benign. Heart has a regular rate and rhythm. Lungs are
bilaterally clear to auscultation. The abdomen is soft and nontender with
active bowel sounds. Neurologically she is alert and oriented x3. Motor and.
sensory examination are intact. Deep tendon reflexes are 1+ and synmetrical.
HOSPITAL COURSE: She was carefully observed in the pediatric intensive care
unit where she remained hemodynamically and neurologically stable. She was
given antibiotics: Nafc;llin 1 gram IV every eight hours prophylactically.
She remained afebri~e and on bedrest until 6/25/92 when she was discharged
home in the care of her mother. Instructions for activity and indications
for returning to the physician were given. Followup appointment was made for
July 1 in neurosurgery clinic.

The patient returns with complaints of headaches. She is now one montn
following a head injury. The patient sustained a basilar skull fracture. At
the present time, there are no focal neurolo9ical signs. Her gait and station
are normal. She nas no papilledema. Her extra-ocular motions are normal and
there is no weakness.' .
I believe the patient has postconcussion syndrome and should be treated
expectantly. She have aspirin for the headaches. Her teachers should
probably be informed of the possibility that.she may complain of headaches and
have a decreased attention span.

AMENDED PETITION FOR APPROVAL OF
MINOR'S SETTLEMENT
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, come your petitioners, Stanley A. Morrison and
Marilyn T. Morrison, by their attorneys, FOwler, Addams, Shughart
& Rundle, and amend their petition as follows:
1. Paragraphs 1-8 of the original petition are incorporated
herein by referencr.
2. The Stoudts' liability insurance carrier has offered to
settle the minor's claim for $50,000. In addition, the
petitioners will receive $1,000 in partial reimbursement for
their expenses.
3. Your petitioners, with the advice of Counsel, William A.
Addams, are willing to settle and compromise this claim for the
offer set forth above.
4. There are no counsel fees or other expenses to be paid
from the proceeds of the stettlement.
5. Your petitioners believe it would be advantageous for'
the minor to accept the offer and that this settlement is in the
best interest of the minor.
