I, MARGARET H. EAVENSON, of Carlisle, Cumberland County,
Pennsylvania, do make, pubHsh and declare this to be my Last Will
and Testament, hereby revoking any and all former Wills by rre at
any time heretofore made.

I direct the payment of my just debts' and funeral expenses as
soon after my death as will be convenient to my Executor hereinafter
na med .
SECOND
I give, devise and bequeath all my property, whether real,
personal or mixed, and wheresoever situate at the time of my death
unto my husband, DAVID B. EAVENSON, absolutely.
THIRD
Should my husband, DAVID B. EAVENSON, fail to survive me then
I give my entire estate unto my children, DAVID B. EAVENSON, JR.,
and ROBERT J. EAVENSON, in equal shares, per stirpes.
FOUR'l'H
I nominate, constitute and appoint my husband, DAVID B.
EAVENSON, to be the Executor of this, my Last Will and Testament.
Should my husband fail to survive me I appoint DAVID B. EAVENSON,
JR., and ROBERT J, EAVENSON to be Co-Executors to serve without being
required to file bond.

MARGARET H. EAVENSON, deceased, late of the Borough of Carlise,
Cumberland County, Pennsylvania,

Beneficiaries under the Last Will and Testament of MARGARET H.
EAVENSON, deceased.
WHEREAS, MARGARET H. EAVENSON died testate on January 16,
1994, a copy of her Last Will and Testament is attached hereto
as Exhibit 'A'; and
WHEREAS, on February 23, 1994, Letters Testamentary in
connection with the Estate of MARGARET H. EAVENSON, deceased,
were granted unto DAVID B. EAVENSON, JR. by the Register of
Wills in and for Cumberland County, Pennsylvania; and
WHEREAS, the Executor proceeded with the administration of
the estate and has prepared a First and Final Account and
Schedule of Distribution, a true and correct copy thereof is
attached hereto, made a part hereof and marked Exhibit 'B'; and
WHEREAS, the parties hereto desire that the Executor shall
not be required to file said Account with the Orphans' Court of
Cumberland County, and that the net estate of the decedent
shall be distributed without the necessity of filing a formal
account.

1. The parties hereto, and Bach of them, agree and
acknowledge that thoy have fully and carefully examined the
First and Final Account of DAVID B. EAVENSON, JR., Executor of
the Estate of MARGARET H. EAVENSON, Deceased, and Schedule of
Distribution relating thereto, and find them to be true and
correct, and acceptable to the partieD hereto and each of them,
I
and further that each of them has received a copy of this
Agreement and the said Account and Schedule of Distribution and
hereby authorize and agree to the distribut.ion therein
proposed.
2. The parties hereto do hereby release, remise and
forever discharge the Estate of MARGARET H. EAVENSON, and DAVID
B. EAVENSON, JR., Executor, of and from all manller of acts,
sui ts, claims, accounts, accounting, debts, dues and demands
whatsoever which they or any of them or their legal
representatives or' assigns may at any time hereafter have
against the Executor, the said Estate or the assets therecf,
concerning any of the asseto and property of the said Estate
and/or any claim or interest thereto or therein, and the
administration, management, collection, sale or distribution of
any of the said assets and for at' on account of any money,
interest, income, assets or proceeds out of the same, from the
time of the death of the said decedent to and including the
date of this Agreement and release.

3. This instrument is a full and final Family
Bettlement Agreement by and among the parties hereto, both
fiduciary and individual, all of the same having been arrived
at, concluded and executed after a full and complete disclosure
of the assets of the said estate and the rights of the parties
therein and thereto and all of the parties hereto, and each of
them, agrees to abide by the terms hereof.
4. The parties hereto, and each of them, agree that

they will at all times in the future and whenever necessary,
appropriate or convenient, make, execute, and deliver to the
said Administrators, and/or to the other party or persons, any
and all instruments, documents, conveyances, deeds, releases or
other instruments of any kind necessary or convenient to carry
out the intention of this Agreement and/or to permit, assist
and enable the Administrators to fulfill their duties with
reference to the said estate and all of the assets thereof
inclUding, but not limited to, the payment of additional
inheritance tax which may be due upon the Estate,

understanding among the parties hereto, and each of them
acknowledge that no representation or statement of any kind,
written or oral, have been made to them or any of them prior
hereto by the Executor or by any other persons or party upon
their behalf.
