LAST WILL AND TESTAMENT

I, NETA E. BERRY, of Lowet. Paxton Township, Dauphin
County, Pennsylvania, being of sound mind, memory and under-
standing, hereby revoking any former Wills by me heretofore
made, publish and declare this my last Will and Testament in
mannet. as follows:
I direct my executor hereinafter named to pay ~ll my
just debts, funeral and burial expenses as soon after my de-
cease as practicable, as well as all inheritance taxes, whether
State or Federal, which may be assessed against my estate, or
on any property passing as a result of my death, whether or not
forming part of my estate, as part of the costs of administration.
I give, devise and bequeath all my property, real, personal
and mixed, of whatsoever sort and wheresoever situate, to my
husband, George I. Berry, absolutely.
In the event my said husband should predecease me, or
our deaths should occur simultaneously, or as a result of common
disaster, I direct my hereinafter named executor to sell and
convert all my property, real, personal and mixed, including my
home &t 4910 Constitution Avenue, Lower Paxton Township, Dauphin
County, Pennsylvania, if I shall still own it, into cash and to
divide the net proceeds derived therefrom as hereinafter provided.
I direct that my children and grandchildren shall have
the right and privilege of making a selection of any of my items
contained in my home before the general sale of property of my
estate.

I give and bequeath a one-fourth (1/4) portion thereof
to my .grandchildren, steven R. Crawford and Michele R. Crawford,
in equ&l shares, owing to the fact that their mother, Dolores J.
Crawtord, has predeceased me.
I give and bequeath a one-fourth (1/4) portion thereof to
my son, Thomas R. Berry, R.D. #2, Turner, Maine 04282.
I give and bequeath the remaining one-half (1/2) portion
thereof to my living grandchildren, being children of my aforesaid
children, share and share alike per capita and not per stirpes.
At the present time there are four grandchildren, namely, steven
R. Crawford and Michele L. Crawford, children of my deceased
daughter, Dolorea J. Crawford, and Daniel R. Berry and Richard A.
Berry, children of my son, Thomas R. Berry,
Should my son, Thomas R. Berry, also predecease me, then
I direct that the share or portion of my estate herein given to
my deceased child shall be given to his children, share and share
alike, per stirpes.
I nominate, constitute and appoint my said husband, George
I. Berry, Executor of this my last Will and Testament.
I~ the event of his prior death, then I nominate, con-
stitute and appoint my two grandchildren, Steven R. Crawford and
Michele L. Crawford, or the one of them who survives me, Co-
Executors of this my last Will and Testament, as well as Testa-
mentary Guardians of the separate estates of any and all minor
children for whom such Guardianship may be required by law,
including the right to inva~e the principal of said Guardianship
estate whenever in the opinion of the said Guardian the same shall
be necessary or advisable for any purpose relating to the general
welfare of said minors.

WHEREAS, Fulton Bank is executor under the will of Neta E.
Berry dated October 12, 1978, and
WHEREAS, Neta E. Berry died on January 6, 1994, and
WHEREAS, The will of Neta E. Berry states:
"In the event my said husband should predecease
me, ...I direct my hereinafter named executor...
and to divide the net proceeds derived therefrom
as herein provided."
"I give and bequeath a one-fourth (1/4) portion
thereof to my grandchildren, Steven R. Crawford
and Michele R. Crawford, in equal shares, owing to
the fact that their mother, Dolores J. Crawford,
has predeceased me.
I give and bequeath a one-fourth (1/4) portion
thereof to my son, Thomas R. Berry, R.D.#2, Turner,
Maine 04282.
I give and bequeath the remaining one-half (1/2)
portion thereof to my living grandchildren, being
children of my aforesaid children, share and share
alike per capita and not per stirpes. At the
present time there are four grandchildren, namely,
Steven R. Crawford and Michele L. Crawford, children
of my deceased daughter, Dolores J. Crawford, and
Daniel R. Berry and Richard A. Berry, children of
my son, Thomas R. Berry."

November 15, 1986.
WHEREAS, Michelle L. Becker has examined the attached
accounting and acknowledges that it is complete and accurate,
hereby waiving any right to demand the filing of a formal court
accounting by the fiduciary, and approves the acts and transactions
of the fiduciary in the administration of the estate, and

distribution of the balance of principal and income be made without
the formality of the filing of an accounting in any Court having

RECEIPT AND RELEASE AGREEMENT
WHEREAS, Fulton Bank is executor under the will of Neta E.
Berry dated October 12, 1978, and
WHEREAS, Neta E. Berry died on January 6, 1994, and
WHEREAS, The will of Neta E. Berry states:
"In the event my said husband should predecease
me, ...1 direct my hereinafter named executor...
and to divide the net proceeds derived therefrom
as herein provided."
"I give and bequeath a one-fourth (1/4) portion
thereof to my grandchildren, Steven R. Crawford
and Michele R. Crawford, in equal shares, owing to
the fact that their mother, Dolores J. Crawford,
has predeceased me.
I give and bequeath a one-fourth (1/4) portion
thereof to my son, Thomas R. Berry, R.D.#2, Turner,
Maine 04282.
I give and bequeath the remaining one-half (1/2)
portion thereof to my living grandchildren, being
children of my aforesaid children, share and share
alike per capita and not per stirpes. At the
present time there are four grandchildren, namely,
Steven R. Crawford and Michele L. Crawford, children
of my deceased daughter, Dolores J. Crawford, and
Daniel R. Berry and Richard A. Berry, children of
my son, Thomas R. Berry."
WHEREAS, George I, Berry, husband of Neta E. Berry, died
November 15, 1986.
WHEREAS, Thomas R. Berry has examined the attached accounting
and acknowledges that it is complete and accurate, hereby waiving
any right to demand the filing of a formal court accounting by the
fiduciary, and approves the acts and transactions of the fiduciary
in the administration of the estate, and

WHEREAS, it is the desire of the parties hereto that
distribution of the balance of principal and income be made without
the formality of the filing of an accounting in any Court having
jurisdiction, and
WHEREAS, ~ulton Bank is willing to make such distribution upon
receipt cf the Release and Indemnification provided for in this
agreement.
NOW 'fHEREFORE, KNOW ALL MEN BY THESE PRESENTS that the
undersigned does hereby request Fulton Bank to make distribution of
the balance of the estate without the filing of an accounting for
audit and approval by the Court having jurisdiction. The
undersigned, in consideration of the payment and delivery to him of
the following:

the receipt of which is hereby acknowledged, for himself, his
heirs, personal representatives and assigns does remise, release,
quit-claim and forever discharge Fulton Bank, individually and as
executor aforesaid, its successors and assigns, of and f.rom all
actions, suits, payments, accounts, claims and demands whatsoever
or by reason thereof, and from any sui t, payment, claim or
liability arising from the administration of any common fund by the
fiduciary or arising from any losses on investments in any common
fund administered by the fiduciary, and hereby agrees that any
court having jurisdiction may by its decree discharge Fulton Bank
as executor.
The undersigned further agrees to indemnify and hold harmless
Fulton Bany, its successors and assigns, from and against any and
all claims, loss, liability or damage which it may suffer or to
which it may be subjected by reason of the settlement of its
account and the distribution of assets of the said estate without
approval of the court having jurisdiction. In consideration of the
distribution to the undersigned of the property described above,
the undersigned agrees to p~y the fiduciary any amount up to the
value of the property that may be necessary in the future to
discharge any liabilities of the estate,
The undersigned further declares that it is his intention to
be legally bound by the execution of this Agreement.
