NOW, THEREFORE, the parties intending to be legally bound set forth the following:
1. Administrators of the estate of deceased need not tile a formal accounting or schedule
of distribution,
2. The Administrators are authorized to convey premises owned by decedent at her death,
located at 424 North West Street, Carlisle, Cumberland County, Pennsylvania, as described in
Deed Book 21 V 1104 in the Recorder of Deeds Office for Cumberland County, to Jacqueline
A, Barnes, as life tenant.
3. A, It is the desire of the heirs that a life estate in the premises be conveyed to
Jacqueline A, Barnes; upon her death life estate to Victoria E, Barnes; remainder to the seven
children or their heirs, including heirs of Jacqueline and Victoria, in fee simple, Premises
shall be managed for and on behalf of the seven children and their heirs, Life tenant is not
required to reside on the premises,
B, For the period from date of this agreement until November 12, 1995, the premises
must be maintained for the use of the family only, Decedent had entered into an agreement
with the Borough of Carlisle, under the Housing and Community Development Act for
rehabilitation of the house under a $6639 grant, requiring payment back of a portion of the
grant if the house were sold prior to November 12, 1995,
C, Subject to the terms of this agreement, life tenant shall have absolute discretion in
the disposition, transfer, renting, encumbrance, and use of the premises, including the right to
sell, transfer and convey the premises, with the proceeds to be applied for the benefit of the
children and their heirs, as set forth herein, equally, share and share alike,
0, The heirs signing this family settlement agreement have discussed this ownership
issue with the administratrix, acknowledging that they have been advised that they have the
right to consult other counsel; that the firm of Broujos, Gilroy, & Houston, PC represents the
administratrix; and that they understand the implications thereof, and freely enter into this
agreement.
4, loe life tenant shall be responsible for payment of taxes, insurance, other
governmental charges, liens, assessments, and claims; utilities; and costs of repairs and
maintenance of the premises, She shall insure that the premises shall be maintained in the
state existing at the time of this agreement, normal wear and tear excepted, She may require
contribution from the children and heirs for expenses for use of the premIses and for
extrllodinary maintenance costs, such as replacement of the roof, which they agree to pay,
The costs may be paid out of any revenue received from any rental of the premises or, in the
event such funds are insufficient, shall be born by all the children or their heirs,
5. A, Upon the incapacitation of Jacqueline A, Barnes, determined in accordance with
the definition in 20 PaCS 550, as determined by at least one physician, the parties hereto

agree that Victoria E. Bames shall become the life tenant, with the rights, powers, and duties.
Upon her inca"acitation, the premises shall pass to the remaindermen,
B. During their respective life tenure, life tenants Jacqueline A, Bames and Victoria E,
Barnes have the right to transfer and convey a fee simple deed to the premises to any party at
a consideration in their absolute discretion, with the proceeds divided equally among the
children, with the share of any deceased child passing to the children of that child. The share
passing to a child under the age of 18 years shull be held by a Guardian for and on behalf of
the interest of the child, which Guardian shall be the oldest surviving child of Phyllis E.
Bames,
6, The life tenant shall have the right to rent the premises,
7, In performance of all of the acts, provisions, duties, responsibilities, and obligations set
forth herein, the life tenant shall have sole discretion, the parties herein vesting this discretion
in her because of the trust and confidence they have in her and to avoid the complication and
time involved in communicating with and making decisions by multiple parties, including
potential children and grandchildr~n,
8, The parties release the administrators with respect to acts or omissions in the
administration and distribution of the estate, including ownership of the premises after filing
of this agreement and conveyance of the life interest in premises to Jacqueline A, Bames and,
in the event of any advances, hereby agree to return any funds distributed under the
administration of the estate as may be required for the payment of any proper r.Iaims not
discharged prior to this distributioll, Since the assets are limited to the real estate and there
are expenses, there are no known funds or other assets to distribute.
9. The parties agree to pay an equal share of the costs of administration, since the real
property is not being sold, in the event that the remaining assets are insufficient for payment
of debts,
10. The said beneficiaries designate this statement as a "satisfaction of award" and hereby
authorize and direct the Clerk of Orphans' Court to mark satisfied of record any award which
may subsequently be made by the Court with respect to the distribution made to the
distributees in this Agreement.
II. The said beneficiaries acknowledge that this Family Settlement Agreement shall be
tiled with the Clerk of Orphans' Court in final settlement of the estate of Phyllis E, Bames,
