LAST WILL AND TESTAMENT
OF
WANDA J. MCLAUGHLIN
I, WANDA J. MCLAUGHLIN, a resident of 525 South spring Garden
Street, Carlisle, Cumberland County, Pennsylvania being of sound
mind, memory and understanding, do hereby make, publish and declare
this to be my Last will and Testament, hereby revoking all Wills
and Codicils heretofore made by me.
ITEM 1: I direct that all my just debts, the expenses of my
last illness and funeral expenses be paid as soon after my decease
as the same can conveniently be done.
ITEM 2: I direct that there shall be paid out of my residuary
estate all estate, inheritance and like taxes together with any
interest or penalty thereon imposed by the government of the United
States, or any state or terr i tory thereof, or by any foreign
government or political subdivision thereof, in respect to all
property required to be included in my gross estate for estate,
inheritance or like tax purposes by any of such governments,
whether the property passes under this will or otherwise,
excluding, however, any property over which I have a taxable power
of appointment, provided, however, that no residuary beneficiary
shall by reason of this provision be denied the benefit of any
deduction, credit, favorable rate of tax or other benefit which by
law enures to such beneficiary.

LAST WILL AND TESTAMENT
OF
WANDA J. MCLAUGHLIN
ITEM 3: I bequeath unto my daughtor, DEBORA J. WRIGHT, if she
shall survive me, all of my clothing, jewelry and personal effects,
owned by me at the time of my death.
ITEM 4:
I give, devise and bequeath all of the rest, residue
and remainder of my estate, real, personal and mixed, of whatsoever
kind and nature, and wheresoever situate at the time of my death,
in equal shares, unto my children, DEBORA J. WRIGHT, BRYAN K.
MCLAUGHLIN and AARON F. MCLAUGHLIN, provided, however, that they
survive me and are living sixty (60) days after the date of my
death.
I direct that my son, AARON F. MCLAUGHLIN, have the first
option to purchase my residence from my estate at its fair market
value with the proceeds from said purchase being distributed in
equal shares, unto my children, DEBORA J. WRIGHT and BRYAN K.
MCLAUGHLIN.
IrEM 5: If and in the event that a child of mine dOBS not
survive me and is not living sixty (60) days after the date of my
death, then and in such event, I give, devise and bequeath the
interest in my estate, which such deceased child would have
received, if living, to the issue of said deceased child, per
stirpes.

~ I hereby nominate, constitute and appoint my son/
AARON F. MCLAUGHLIN, Executor of this my Last will and Testament,
with full power to do any and all things necessary for the complete
administration of my estate, and direct that no bond or other
surety is required of him in this or any other jurisdiction for his
performance of this office.
If and in the event that my son, AARON F. MCLAUGHLIN, does not
survive me and is not living sixty (60) days after the date of my
death, or does not complete his duties as Executor, then and in
such event, I hereby nominate, constitute and appoint my son, BRYAN
K. MCLAUGHLIN, Executor of this my Last Will and Testament, with
full power to do any and all things necessary for the oomplete
administration of my estate/ and direct that no bond or other
surety is required of him in this or any other jurisdiction for his
performance of this office.
ITEM 7:
If any provision of this Will or of any codicil
hereto is held to be inoperative, invalid or illegal, it j,s my
intention that all the remaining provisions thereof shall oontinue
to be fully operative and effective, so far as is possible and
reasonable.

WHEREAS, the only parties in interest in said Estate are the

net estate of the deoedent shall be distributed without the
necessity of filing a formal Aooount to avoid the expense, delay

aOknowledge that they have fully and oarefully examined the First
and Final Aooount of AARON F. MCLAUGHLIN, Exeoutor for the Estate
of WANDA J. MCLAUGHLIN, deoeased, and proposed Sohedule of
Distribution relating thereto, and find them to be true and
'oorreot, and aooeptable to the parties hereto and eaoh of them,
and further that eaoh of them has reoeived a oopy of this Family
Settlement and Final Release and of said Aooount and Proposed

2. The parties hereto hereby agree that in order to avoid
the expense, delay and publicity involved in the filing of a
fo~~l Account and Sohedule of Distribution, no acoounting to the
Court is necessary and we do hereby agree that we do consent to
distribution being made without the filing of an Account and
Sohedule of Distribution, the same to be with the same force and
effect as if they had been filed and oonfirmed by the Orphan's
Court Division of the Court of Common Pleas of cumberland County,
PennSYlvania.
3. The parties hereby remise, release, quitolaim and

debts and demands whatsoever whioh we or any of us or our legal
representatives or assigns may at any time hereafter have against
said executor, estate, or assets thereof, touohing or concerning
the Estate of the Decedent.

will contribute their ehare of the Estate to satisfy all claims,
debts, demands, suits or causes of action whioh may be
sucoessfully brought agains~ the Estate or the Exeoutor after the
exeoution of this Family Settlement and Final Release.
5. The parties hereto hereby agree that they will at all
times in the future and where ever necessari, appropriate or
convenient, make, execute and deliver to said Executor, and/or to
the other party or persons, any and all instruments, documents,
conveyances, deeds, releases or other instruments of any kind
neoessary or convenient to carry out the intention of this Family
Settlement and Final Release.
6. This Family Settlement and Final Release constitutes the
entire understanding among the parties hereto, and each of them

WHEREAS / WANDA J. MCLAUGHLIN, late of South Middleton
Township, Cumberland County/ Pennsylvania, died on February 7,
1994/ having left a Last Will and Testament, and

heirs and
WHEREAS, on March 10, 1994, the Register of wills in and for
the Coum:.y of Cumberl.:m<1, Commonwealth of Pennsylvania, did
constitute and appoint AARON F. MCLAUGHLIN, as Executor of the
Estate of WANDA J. MCLAUGHLIN, in Estate Number 2194-0231, and
WHEREAS, the Executor has proceeded with the administration
of said Estate consisting of assets in the amount of $83,951.32
and disbursements in the amount of $68,484.89, leaving a
principal balance on hand of $15,466.43, plus interest, as set
forth in the First and Final Account, a true and correct copy of
which is attached hereto and made a part hereof as Exhibit A, and
WHEREAS, the only parties in interest in said Estate are the
above-named parties, and
WHEREAS, said parties in interest desire that the
Executor shall not be required to fila an Account with the
Orphan's Court of Cumberland County, Pennsylvania, and that the
net estate of the decedent shall be distributed without the
neoessity of filing a formal Account to avoid the expense/ delay
and publicity of a formal accounting but should instead be
distributed in accordance with the Exeoutor's Proposed Schedule
of Distribution, a true and correct oopy of which is attached
her.eto and made a part hereof as Exhibit B.
NOW THEREFORE, in consideration of the mutual promises,
covenants and agreements recited herein, the above-named heirs
and beneficiaries of the estate of WANDA J. MCLAUGHLIN do hereby
'mutually agree as follows:
1. The parties hereto, and each of them, agree and
acknowledge that they have fully and carefully examined the First
and Final Acoount of AARON F. MCLAUGHLIN, Exeoutor for the Estate
of WANDA J. MCLAUGHLIN, deoeased, and proposed Schedule of
Distribution relating thereto, and find them to be true and
correot/ . and acceptable to the parties hereto and eaoh of them,
and further that eaoh of them has reoeived a copy of this Family
Settlement and Final Release and of said Account and Proposed
Schedule of Dlstribution.

2. The parties hereto hereby agree that in order to avoid
the expense, delay and publicity involved in the filing of a
fo~al Account and Schedule of Distribution, no accounting to the
Court is necessary and we do hereby agree that we do consent to
distribution being made without the filing of an Account and
Schedule of Distribution, the same to be with the same force and
effect as if they had been filed and confirmed by the Orphan's
Court Division of the Court of Common Pleas of cumberland County,
Pennsylvania. I
3. The parties hereby remise, release, quitclaim and
forever discharge the Estate of WANDA J. MCLAUGHLIN, and AARON F.
MCLAUGHLIN, Executor, his heirs, executors, administrators and
assigns, from all manner of aots, suits, claims, acoountings,
debts and demands whatsoever which we or any of us or our legal
representatives or assigns may at any time hereafter have against
said executor, estate, or assets thereof, touohing or concerning
the Estate of the Decedent.
4. The parties hereto hereby covenant and agree that they
will contribute their share of the Estate to satiSfy all claims,
debts, demands, suits or causes of aotion which may be
successfully brought against the Estate or the Executor after the
execution of this Family Settlement and Final Release.
5. The parties hereto hereby agree that they will at all
times in the future and where ever necessary, appropriate or
convenlent, make, execute and deliver to said Executor, and/or to
the other party or persons, any and all instruments, documents,
conveyances, deeds, releases or other instruments of any kind
necessary or convenient to c~rry out the intention of this Family
Settlement and Final Release.
6. This Family Settlement and Final Release constitutes the
entire understanding among the parties hereto, and eaoh of them
acknowledges that no representations or statements of any kind,
written or oral, have been made to them or any of them prior
hereto by the Executor or any other person or party upon his
behal f .
7. This Family Settlement and Final Release shall endure to
the benefit and shall bind the parties hereto, and each of them,
their heirs, exeoutors,administrators, suooessors and assigns.
8. This Family Settlement and Final Release shall be
. governed by the laws of the Commonwealth of' Pennsylvania.
