LAST WILL AND TESTAMENT
I, JACQUELINE H. FARNER, of the Township of Silver
Spring, County of Cumberland and State of Pennsylvania,
being of sound mind, memory and understanding, do maker
publish and declare this to be lilY last Will and Testament,
hereby revoking and making void all former wills, codicils
and other testamentary dispositions by me at any time here-
tofore made.
1.
I direct my executor, hereinafter named, to pay as
soon as practicable after my decease all my just debts and
.the expenses of my last illness and burial.
2.
I give, devise and bequeath all my estate, - real,
personal and mixed -/ unto my husband, Paul L. Farner, ab-
solutely.
3.
Should my said husband predecease me, then and in that
event/ I give, devise and bequeath all of my estate unto my
children, equally, share and share alike.
4.
I hereby nominate, constitute and appoint my said
husband, Paul L. Farner, executor of this my last Will. Sho'uld
my husband, Paul L. Farner, fail to qualify or cease to act
as executor I appoint The Harrisburg National Bank and Trust
Company, of Harrisburg, Pennsylvania, executor of this my
last Will and Testament.
5.
I appoint The Harrisburg National Bank and Trust Company,

of Harrisburg, Pennsylvania, guardian of any property whioh,
passes, either under this Will or otherwise, to a minor and
with respeot to whioh ! am authorized to appoint a guardian
and have not otherwise specifically done so. Such guardian
shall have the power to use principal as well as income from
time to time for the minor's education, support and welfare,
or to make payrnent for these purposes, without further re-
sponsibility, to the minor or to any person taking care of the
minor.
6.
I direct that my personal representative and guardian,
as well as their sucoessors, shall not be required to give
bond for the faithful performance of their duties in any
jurisdiction.

being of sound mind, memory and understanding, do make,

publish and declare this to be my last Will and Testament,
hereby revoking and making void all former wills, codicils
and other testamentary dispositions by me at any time here-
tofore made.

I direct my executor, hereinafter named, to pay as
soon as practicable after my decease all my just debts and
the expenses of my last illness and burial.
2.
I give, devise and bequeath all my estate, - real,
personal and mixed -, unto my hUSband, Paul L. Farner, ab-
solutely.
3.
Should my said husband predecease me, then and in that
event, I give, devise and bequeath all of my estate unto my
children, equally, share and share alike.
4.
I hereby nominate, constitute and appclint my said

my hUSband, Paul L. Farner, fail to qualify or cease to act

AND NOW, comes snelbaker & Brenneman, P.C" Attorneys for
the Estate and Administrators C.T.A. of the Estate of Jacqueline
H. Farner, Deceased, who respectfullY represent as follows:
1. Jacqueline H. Farner died on January 6, 1994/ leaving a
last will and testament bequeathing and devising her entire
estate unto her two children/ namely, Michael L. Farner and cathy
L. Carr, who also qualified as the Administrators cum Testamento
Annexo of their mother'S Estate and will.
2. The co_administrators duly filed their First and Final
Account with statement of proposed Distribution on May 19/ 1995,
which were presented to this court on June 20, 1995/ and duly
confirmed and distribution ordered by decree entered on the same
date by president Judge Harold E. Sheely.
3. It has noW been discovered that an error occurred in the

preparation of the statement of proposed Distribution based upon
the following I
A. The balance for distribution in the Estate is
$151,752.74/ which is to be divided one-half to each
beneficiary pursuant to Decedent's Will: $75/876.37 to
Michael L. Farner; $75/876.37 to cathY L. Carr.

B. since the beneficiaries desired to retain
oerta!n assets in kind, a disproportionate division of
ownership was required and agreed upon with respect to
real estate known as 8 Bare Road located in Silver
spring Township, Cumberland county, Pennsylvania.
C. The agreed disproportionate allocation of
ownership was properly reflected on page 2 of the
Statement of Proposed Distribution in which the share
to Cathy L. Carr was shown as 40.625% of said 8 Bare
Road ($32,500). The total distribution to Cathy L.
Carr was also correct: $75,876.37.
D. The error occurred when a former draft of page
10f said statement of Proposed Distribution was
inadvertently filed showing distribution to Michael L.
Farner of 50% of 8 Bare Road ($40,000) resulting in a
total distribution to him of only $68,376.37.
E. Attached hereto marked "Exhibit A" is a copy
of the correct and inadvertently omitted page 1 of the
statement of Proposed Distribution showing the interest
of Michael L. Farner in 8 Bare Road as being 59.375%
($47,500) with a total distribution of $75/876.37.
WHEREFORE, your Honorable Court is requested to amend the
decree of June 20, 1995/ to change the amounts awarded to Michael
L. Farner and to restate the order of distribution as follows:

Dorothy P. Zeigler, his wife, by their deed dated April
26, 1968, and recorded in the Office of the Recorder of
Deeds in and for Perry County, Pennsylvania, in Deed
Book 199, Page 6, granted and conveyed unto Paul L.
Farner and Jacqueline Y. Farner, his wife. The said
Paul L. Farner died on April 14, 1986, survived by his
wife, Jacqueline H. Farner (also known as Jacqueline Y.
