Dear Mr. Dybliel
Enclosed is a letter that I received from Attorney Frank in-
dicating that Joseph W. Dyblie will be included as an unsecured
creditor in the second amended plan of reorganization that the
Grimms will be submitting to the Bankruptcy Court. It would appear
that Mr. Frank's failure to list your brother as a creditor in some
of the bankruptcy filings was an oversight, which he will now
correct. You did file the proof of claim and the Bankruptcy Office
has advised me that they do have Joseph Dyblie's name on the list
of creditors. I will send them a letter to confirm that notices
should be sent to you at your address,
Attorney Frank Martin at Hill Financial Services sent me the
information that I requested concerning the savings account loans.
This information indicates that Joseph Dyblie took out the loans and
the checks were made payable to "Joseph W. Dyblie or Harry G.
Dyblie". Two of the three checks were made payable to Professional
Property Management (which you indicated was a company owned by
Grimm) and the other check was endorsed in blank and then redeposited
at State Capital. I did not receive a copy of any check concerning
loan number 002-80-03127. You will note that loan number 002-80-
02840 indicates that no check was issued but that other CD's were
purchased. Mr. Martin al so sent copies of information concerning
account activities and other information in their computer.
It appears from the information that we have l'eceived that
your brother took out the loans with State Capital. He then must
have used the borrowed money to loan to the Grimms. The documents
that t'he Grimms signed are termed acknowledgements and state that
Mr. Dyblie pledged CD's for loans made by the GrimmR from State
Capital. This is not correct. Mr. Martin has advised me that tho
Grimms did not make any loans from State Capital. The only
