Guardianship .ervioes are neoe..ary for Mr. Ruhrig notwithstanding the personal assistanoe and support whioh he reoeives from his immediate family. 6. Based upon the aforesaid oondition of Mr. Ruhrig and his laok of oapaoity to make and oommunioate deoi.ions in the regard mentioned, a temporary and partial guardian.hip with re.peot to hi. per.on i. required. 7. The duration of this guardianship will be until the guardian has exeouted the neoessary "2176 Waiver" and .eoured Mr. Ruhrig's entranoo into the HAP, Inoorporated, re.idential program, if the guardian feels that suoh measure. are in the interest of his brother. 8. Pursuant to 20 Pa. C.S. Seotion 5512.1(B), it i. found that Mr. Ruhrig is partially inoapaoitated and in need of temporary partial guardianlhip servioe. of the per.on. 9. The brother of Mr. Ruhrig is a perlon qualified under 20 Pa. C.S. Seotion 55ll(f) to serve a. .uoh guardian of hi. por.on. ~ y.- 10. C.S. Seotions 5501 et. seq. Petitioner ha. .ub.tantially . oomplied with these provisions, and based upon the foregoing Pindings of Faot, the following Order of Court will be entered. ORDER OF COURT AND NOW, this 6th day of May, 1994, upon oon.ideration of the Petition for Appointment of a Temporary Guardian of the Person Pursuant to Pa. C.S.A. 5513, and following a hearing held at the Cumberland County Courthouse, Jame. Ruhrig is adjudioated an inoapaoitated person, and his brother, Weston Robert Ruhrig, is appointed temporary partial. guardian of his person for the purpose of exeouting a "2176 Waiver" and effecting his brother's admission into the HAP, Inootporated, re.idential program. This appointment shall expire following the aocomplishment of those two servioe.. No bond shall be required of the guardian. INCAPACITATED PERSON PETITION rOR APPOINTMENT or A TEMPORARY GUARDIAN or THE PERSON PURSUANT TO 20 PA. C.S.A. 5513 1) Your Petitioner is Robert L. O'Brien, Esquire, Solicitor for the Cumberland/Perry Mental Health/Mental Retardation Office. 2) Respondent is James RUhrig, an incapacitated person, ourrently reoeiving care at Allentown State Hospital, Allentown, PA. Respondent is an adult individual being presently 56 years of age with a birth date of July 18, 1937. Attached hereto, marked as Exhibit "A", and incorporated herein by referenoe is a Petition prepared by the Cumberland County MH/MR Office. 3) Petitioner requests that the Court appoint Mr. Weston RUhrig, as guardian for the limited purpose of executing certain forms and waivers that are required to insure the continuation and availability of care and treatment for Respondent. An initial determination has been made that, due to Respondent's low intellectual functioning, he is unable to make a determination in reference to his placement/waiver, and that, in order to comply with applicable state and federal laws, a guardian be appointed by the Court for the purpose of making said election and signing the necessary forms. 4) It is has been pointed out to Petitioner by Larry L. Rice, Jr., Case Manager for the Cumberland/Perry county MH/MR Office, that Respondent James Ruhrig is unable to attend any hearing which may be scheduled by the Court as a result of the filing of this Petition. I WHEREFORE, Petitioner, RobertL. o'Brien, respectfully requests that the Court order that Respondent James RUhrig be, adjudged an incapaoitated person in reference to choosing between community base and institutional services for the mentally retarded. It is also . requested the Court appoint an attorney to represent Respondent and to a~sist him for the purposes of this Petition and subsequent hearing.
