LAST WILL AND TESTAMENT
KNOW ALL MEN BY THESE PRESENTS, that I, ARLENE F. RUMBERGER,
presently residing at 44 Acri Meadow Road, Enola, Cumberland
County, Pennsylvania. being in good heal th lInd of sound and
disposing memory, do hereby make, declare, and publish this as my
Last Will and Testament, hereby revoking all former wills and
codicils thereto heretofore made by me at any time.
PAYMENT OF EXPENSES
I. Payment of Expenses: I direct that my Executrix,
hereinafter named, shall have the power, but not the duty, to pay
all my just debto, expenses of my last illness and funeral
expenses from my estate as soon after my decease as shall be
found convenient.
II. Cash Gifts I
A. I give the sum of Three Thousand Five Hundred
($3,500.00) Dollars to my daughter, ROSE MARIE DAWSON, if she
survives me. If she does not survive me, her gift shall be paid
to my daughter, PATRICIA JOANN GEARHART, if she survives me.
B. I give the sum of Five Thousand ($5,000.00) Dollars to
my daughter, PATRICIA JOANN GEARHART, if she survives me.

GIFTS
III. Personal and Household Effects I I bequeath my
automobile, household and personal effects and other tangible
personalty of like nature (not including cash or securities),
together '/lith any existing insurance thereon, to my daughter,
JANICE LYNN RUMBERGER, if she survives me by thirty days. Should
my daughter not be living on the thirty-first day after my death,
I bequeath such tangible personalty and insurance thereon to my
daughter, PATRICIA JOANN GEARHART.
IV. Residuary Estatel
A. I give, devise and bequeath the rest, residue and
remainder of my estate, whether real, personal or mixed, and of
any nature whatsoever and wherever situated, unto my beloved
daughter, JANICE LYNN RUMBERGER, if she survives me by 30 days.
B. In the event that my daughter, JANICE LYNN RUMBERGER,
should predecease me or die within thirty days of the date of my
death, then I give, devise and bequeath the rest, residue and
remainder of my estate, whether real, personal or mixed, and of
any nature whatsoever and wherever situated, to my daughter,
PATRICIA JOANN GEARHART.
V. Powers of Appointmentl No provision of this will shall
exercise any power of appointment I may have.

FIDUCIARIES
VI. Executors I I h~reby nominate, constitute and appoint my
daughter, JANICE LYNN RUMBERGER, as Executrix of this, my Last
Will and Testament.
In the event that my said daughter shall
predecease me, or be unwilling or unable to act as Executrix,
then I nominate, constitute and appoint my daughter, PATRICIA
JOANN GEARHART, as Executrix of this my Last Will and Testament.
No Executrix shall be required to post bond.
ADMINISTRATIVE PROVISIONS
VII. Management Provisions: My Executrix shall have, in
addition to the powers and authority conferred upon her by law,
the following additional powers and authority:
A. Sell/Lease I: To sell at public or private sale,
exchange, lease, mortgage or pledge any property, real or
personal, at any time constituting a portion of my estate, and
upon such terms and conditions as the Executrix shall deem wise.
B. Invest: To invest any money at any time in such bonds,
stocks, notes, real es tate, mortgages, life insurance, annuities
or other securities, or such property, real or personal, as the
Executrix shall deem wise, without being limited by any statute
or rule of law regarding investments by an executrix.
C. Retairl: To retain, without recurring any liability, as
investments, any property olflled by me at the time of my death, as
long as she deems it wise, and even though such property is not
the kind of property an executrix would purchase as an

investment I and even though to retain such property might violate
sound diversification principles.
D, :ritle to Prope~: 'I'o cause any security or other
property which may at any time constitute a portion of my estate
to be issued, held or regis tered in her own name, or in the name
of a nominee, or in such form that title will pass by delivery.
E. Capital Changes: '1'0 consent to the reorganization,
consolidation, readjustment of the financial structure, or sale
of the atlsets of any corporation or other organizati.on, the
securities of which constitute a portion of my estate. and to
take any action with reference to such securities which, in the
opinion of the Executrix, is necessury to obtain the benefit of
any such reorganization, consolidation, readj ustment or sale, to
exercise any conversion privilege or subscription right given to
her as the owner of any securities constituting a portion of my
estatel to accept and hold as a portion of my estate securities
resulting
from
any
such
reorganization,
consolidation,
readjustment, sale, conversion, or subscription,
F. Expenses of Estate: To pay ell costs, taxes, charges and
expenses in connection with the administration of my estate.
G. Allocate: To determine what is "Income" and what is
"Principal" hereunder, and her decis ion thereon shall be final
and to purchase securities at a premium or discount. and to apply
or charge said premium or discount against income or principal as
the Executrix may determine.

H. Borrowl To borrow money from any person, firm or
corporation I for the purpose of p:rotecting and preserving or
improving my estate hereunder I to execute promissory notes or
other obligations for amounts so borrowed.
I. EmploYI To employ legal counsel, accountants, brokers,
investment advisors, custodians I managers and other agents and
employees and to pay them reasonable compensation out of the
funds held hereunder to which said compensati.on is attributable.
J. O~: To do all other acts in her judgment necessary
or desirable for the proper and advantageous management,
investment and distribution of my estate.
VIII .
Death Taxesl I direct that all transfer and
inheritance taxes, state or Federal, assessed because of my
death, whether the funds, property or insurance proceeds to which
such taxes are attributable pass under this Will or not, shall be
paid out of my residuary estatel that my Executrix pay, or
provide for payment of all such taxes at such time, or times, and
in such manner as my Executrix deems best.

III. EFFECT OF DEFAULT.
In the event of default by BUYERS, this Agreement shall
become null and void and both parties shall thereupon be released
of all further liability hereunder.
IV, TIME OF ESSENCE.
Unless otherwise agreed between the parties settlement is to
be made at the offices of Ball, Skelly, Murren Ii Connell, 511
North Second Street, Harrisburg, PA, on or before August 31,
1994, time to be of the essence of this Agreement. At settle-
ment, SELLER shall tender and deliver to BUYERS a properly drawn,
executed and acknowledged Executor's deed conveying to tbe BUYERS
good and marketable title in fee simple, free and clear of all
liens and encumbrances except easements or buildings and use
restrictions visible on the gr.ound or of prior record. Title
shall be such as will be certified by a reputable title insurance
company in the Central Pennsylvania geographical area at r.egular
rates. BUYERS shall be responsible for costs of survey, if any,
and costs of title search and/or title insurance, the premium for
insurance coverage to protect the Buyers' interest, and Buyers I
normal settlement cos ts and accruals. SELLER shall be
responsible for costs of deed preparation.
V. POSSESSION.
Possession of the premises shall be delivered at settlement.
VI. APPORTIONMENT OF TAXES AND OTHER CHARGES,
Real estate taxes, water rents, sewer rent and any and all
other annual claims or charges upon and against the subject
premises, whether imposed by any municipality or other agency or
institution, shall be apportioned to the time of settlement. All
realty transfer taxes due as a result of this transfer will be
divided evenly and paid equally by both parties hereto.
VII. PERSONALTY.
All existing plumbing, heating and lighting fixtures and
systems appurtenant thereto and forming a part thereof, and other
permanent fixtures as well as other personalty now on the
premises and all trees, shrubbery, and all p1antings now in or on
the property unless specifically excepted in this Agreement are
included in the sale and purchase price. Any remaining heating

and/or cooking fuel stored on the premises at time of settlement
are also included under this Agreement.
VIII. TENDER OF DEED.
For.mal tender of an executed deed and purchase money is
hereby waived.
IX. RISK OF LOSS.
SELLER shall maintain the property and any personal property
specifically scheduled herein in its present condition, normal
wear and tear excepted. SELLER shall until the time of
settlement bear the risk of loss from fire or other casualties,
except as such are the result of actions by Buyers, their agents,
servants or employees for which Buyers shall be responsible. In
the event of damage to any property included in this sale by fire
or other casualties, not repaired or replaced prior to settle-
ment, BUYERS shall have the option of rescinding this Agreement
or of accepting the property in its then condition together with
the proceeds of any insurance recovery obtainable by SELLER.
X. RECORDING.
This Agreement shall not be recorded in the OfHce of the
Recorder of Deeds or in any other office or place of public
record. If BUYERS cause or permit this Agreement to be recorded,
SELLER may elect to treat such as a breach of the Agreement.
XI. WATER AND SEPTIC.
The property is serviced by private well and septic system.
a. BUYERS acknowledge that no statements have been
made to them by any parties to the transaction
regarding the potability or chemical content of the
water provided to subject property. BUYERS herein
acknowledge that BUYERS have been informed that subject
property has a private well for its water source and
have agreed to pay for testing the well water by a
water-testing laboratory. BUYERS hereby re lease,
quitclaim and forever discharge SELLER, SELLER 's
agents, subagents, employees and any officer or partner.

corporation who may be liable by or through them from
any and all claims, losses or demands, including

acknowledge that having received a report on
potability, they accept the report and the water
condition on the premises.
b. BUYERS acknowledge that no statements have been
made to them by any parties to this transaction
regarding the condition of the septic system. BUYERS
herein acknowledge that BUYERS have been informed that
subject property has a private on-lot sewage system and
is aware of the opportunity to have the system
inspected by a septic company. BUYERS release,
quitclaim and forever discharge SELLER, SELLER's agent,
subagents, employees and any officer or partner of any
of them and any other person, firm or corporation who
may be liable by or through them from any and all
claims, losses or demands, including personal injuries
and all the consequences thereof, whether now known or.
not, which may arise from results which could be
determined by conducting a test of the on-lot sewage
system.
XII. WOOD INFESTATION.
BUYERS' at their expense have ordered from a pest control
operator certified by the Pennsylvania Department of Agriculture,
a written "Wood Destroying Insect Infestation and Resultant
Damage Report".
SELLER shall not be responsible for the repair of any
structural damage or for. any treatment and BUYERS shall accept
the property with the defects revealed by inspection, without
abatement of price.
XIII. AGREEMENT.
No other agreement or provisions of this Agreement have
been reached between the parties hereto except as are set forth
herein and no express representations or warranties, either
express or implied, are made by either of the parties hereto
except as are set forth herein. This Agreement may not be
changed, modified or amended, in whole or in part, except in
writing, signed by both parties.
XIV. REPRESENTATIONS.
BUYERS hereby expressly represent that BUYERS have had ample
opportunity, to inspect the subject premises and to investigate

WHEREAS, the sllid Arlene Rumberger became in her
lifetime seised, in fee, of and in a certain lot situate
in the Township af East Pennsboro, Cumberland County,
Pennsylvania, now known as 44 Acri Meadow Road and more
particularly described hereinafter, and being so thereof
seised, departed thts life on February 9, 1994, having
first made her Last Will and Testament in writing, dated
August 14 I 1991, with Codicil to the LaRt Will and
Testament of Arlene F. Rumberger, dated September 17,
1993, duly probated and registered in the Office of the
Register of Wills, Cumberland County, on March 21, 1994,
Will File Number 21-94-264 wherein and whereby, inter
alia, she authorized her Executrix, Janice L, Rumberger,
toSell her real estate and letters testamentary were
duly issued by the said Regis ter of Hills on March 21,
1994.
NOW THIS INDENTURE WITNESSETH, That the said GRANTOR for
and in consideration of the sum of Eighty-six Thousand Four
Hundred Eighty ($86,480,00) Dollars, lawful money of the
United States, to her in hano paid by the said GRANTEES at
snd before the ensealing and delivery thereof, the receipt
whereof is hereby acknowledged, has granted, bargained, sold,
released and confirmed and by these Presents does grant,

LAST WILL AND TESTAMENT
KNOW ALL MEN BY THESE PRESENTS, that 1, ARLENE F. RUMBERGER,
presently residing at 44 Acri Meadow Road, Enola, Cumberland
County , Pennsylvania, being in good heal th and of sound and
disposing memory, do hereby mske, declare, and publish this as my
Last Will and Testament, hereby revoking all former wills and
codicils thereto heretofore made by me at any time.

PAYMENT OF EXPENSES
1.
Payment of Expenses:
I direct that my Executrix,
hereinafter named, shall have the power, but not the duty, to pay
all my just debts, expenses of my last illness and funeral
expenses from my estate as soon after my decease as shall be
found convenient.
II. Cash Gifts:
A. I give the sum of Three Thousand Five Hundred
($3,500.00) Dollars to my daughter, ROSE NARIE DAWSON, if she
survives me. If she does not survive me, her gift shall be paid
to my daughter, PATRICIA JOANN GEARHART, if she survives me.
B. I give the sum of Five Thousand ($5,000.00) Dollars to
my daughter, PATRICIA JOANN GEARHART, if she survives me.

GIFTS
III. Personal and Household Effects I I bequeath my
automobile, household and persona 1 eHec ts and other tangib le
personalty of like nature (not including cash or securities),
together with any exis t:f.ng insurance thereon, to my daughter,
JANICE LYNN RUMBERGER, if she survives me by thirty days. Should
my daughter not be living on the thirty-first d~y after my death,
I bequeath such tangible personalty and insurance thereon to my
daughter, PATRICIA JOANN GEARHART.
IV. Residuary Estate:
A. I give, devise and bequeath the rest, residue and
remainder of my estate, whether real, personal or mixed, and of
any nature whatsoever and wherevr.r situated, unto my beloved
daughtpr, JANICE LYNN RUMBERGER, if she survives me by 30 days.
B. In the event that my daughter, JANICE LYNN RUMBERGER,
should predecease me or die within thirty days of the date of my
death, then I give, devise and bequeath the rest, residue and
remainder of my estate, whether real, personal or mixed, and of
any nature whatsoever and wherever situated, to my daughter,
PATRICIA JOANN GEARHART.
V. Powers of Appointment I No provision of this will shall
exercise any power of appointment I may have.

FIDUCIARIES
VI. Executors: I hereby nominate, constitute and appoint my
daughter, JANICE LYNN RUMBERGER, as Executrix of this, my Last
Will and Testament., In the event that my said daughter shall
predecease me, or be unwill ing or unable to act as Executrix,
then I nominate, constitute and appoint my daughter, PATRICIA
JOANN GEAR~~RT, as Executrix of this my Last Will and Testament.
No Executrix shall be required to post bond.
ADMINISTRATIVE PROVISIONS
VII. Management Provisions: My Executrix shall have, in
addition to the powers and authority conferred upon her by law,
the following additional powers and authority:
A. Sell/Lease:: To sell at public or private sale,
exchange, lease, mortgage or pledge any property, real or
personal, at any time constitut.ing a portion of my estate, end
upon such terms and conditions as the Executrix shall deem wise,
B. Invest: To invest any money at any time in such bonds,
stocks, notes, real estate, mortgages, life insurance, annuities
or other securities, or such property, real or personal, as the
Executrix shall deem wise, without being limited by any statute
or rule of law regarding investments by an executrix.
C. Retain: To retain, without recurring any liability, as
investments, any property owned by me at the time of my death, as
long as she deems it wise, and even though such property is not
the kind of property an executrix would purchase as an

H. Borrowl To borrow money from any person, f.irm or
corporation, for the purpose of protecting and preserving or
improving my estate hereunder I to execute promissory notes or
other obligations for amounts so borrowed.
I. Employ: To employ legal counsel, accountants, brokers,
inves tment advisors, cus todiarls, managers and other agents and
employees and to pay them reasonable compensation out of the
funds held hereunder to which said compensation'is attributable.
J. Other: To do all other acts in her judgment necessary
or desirable for the proper and advantageous management,
investment and distribution of my estate.
VIII.
Death T~: I direct that all transfer and
inheritance taxes, state or Federal, assessed because of my
death, whether the funds, property or insurance pr.oceeds to which
such taxes are attributable pass under this Will or not, shall be
paid out of my residuary estatel that my Executrix pay, or
provide for payment of all such taxes at such time, or times, and
in such manner as my Executrix deems best.

any such reorganization, consolidation, readjustment or sale, to
exercise any conversion privilege or subscription right given to
her as the owner of any securities constituting a portion of my
estate; to accept and hold as a portion of my estate securities
resulting from any such reorganization, consolidation,
readjustment, sale, conversion, or subscription.
F. Expenses of Est~: To pay all costs, taxes, charges and
expenses in connection with the administration of my estate.
G. Allocate: To determine what ill "Income" and what is
"Principal" hereunder, and her decision thereon shall be final
and to purchase securities at a premium or discount, and to apply
or charge said premium or discount against income or principal as
the Executrix may determine.
