KNOW ALL MEN BY THESE PRESENTS that I, KENNETH L. BEAR, one of the
residuary legatees under the Last WilllInd Testamenl of FLORENCE C. BEAR, late of Lower
Frankford Township, Cumberland County, Pennsylvania. deceased. do hereby acknowledge that I
have this day had and received of and from RICHARD D. BEAR, Executor under the Last Will and
Testament of the said FLORENCE C. BEAR, my share of estate re~idue, for a total distribution of
Twenty-five Thousand Dollars ($25,000,00). in full satisfaction and payment of my legacy under
the terms of said Last Will and Testament.
AND, THEREFORE, I, the said KENNETH L BEAR, do by these presents remise. release,
quit-cllIim, and forever discharge the said RICHARD D. BEAR, Executor aforesaid, his heirs,
executors and administrators, of and from the aforesaid legacy, and of and from all actions, suits,
payments, accounts. reckonings, claims and demands whatever, from the beginning of the world to
the day of the date of these presents.
AND, THEREFORE, I, the said KENNETH L. BEAR, agree to refund to RICHARD D,
BEAR. Executor aforesaid, any portion of the distrihution to which lam not properly entitled, ami
to the extent of said distribution, to indemnify said Executor for claims made against him as
Executor, and to reimburse to said Executor all expenses and costs incurred in connection with any
such claims,
AND I hereby consent and agree that the Orphans' Court of Cumberland County may
discharge the said RICHARD D, BEAR upon application, wilhout further notice to me.

The Petition of Richard D, Bear. pursuant to 20 Pa,C,S.A, *3356, respectfully represents
as follows:
1. Florence C, Bear ("Decedent") died on March 16, 1994, testate, leaving her Last
Will and Testament dated February 1, 1984, which was duly probated before the Register of Wills
of Cumberland County on March 21,1994,
2, The Register of Wills granted Letters Testamentary to Petitioner on March 21,
1994,
3, Paragraph 2 of said Will states in part as follows: "I give, devise nnd bequeath all
of my estate, both realnnd personal property, in equal shares unto my sons, RICHARD D, BEAR
and KENNETH L. BEAR,"
4, At the time of death Decedent held fee simple titie to real estnte situate in Lower
Frankford Township, Cumberland County, Pennsylvania, known as 910 Ensy Road. Cnrlisle,
Pennsylvnnin, with impmvements thereon, described in accordance with Exhibit "A" aU ached
hereto,
5, In addition 10 Petitioner Richnrd D, Bear, the olher party in interest is Kenneth L.
Bear, son of Decedent, 131 Blossom Drive, Wincht'ster, Virginia, 22602,
6, Kenneth L. Benr has received the sum of $25,000,00 in full satisfaction and
pnyment of his legacy under the terms of said Will, as evidenced by a Release dutcd Februury 9,
