Definition of Market Value: The most probable price
which a property should bring in 11 competitive and open
market under all conditions requisite to a fail' sale; the
buyer and seller each acting prudently, knowledgeably and
aS5uming the price is not affected by undue stimulus.
Implicit in this definition is thE! conclusion of a sale as

be a reasonable and probable use for which there will be a
demand in the foreseeable future, and the use of the

The subj ect property conforms well in this area which
enjoys a mixed land use pattern which is predominately
single family residential and vacant land,
After a careful inspection of the area and examination
of the demand and land-use restrictions, it is the
appraisers opinion that the highest and best use of the

The subject property is located in silver spring
Township, cumberland COllilty, pennsylvania, approximatelY 10
miles west of the city of Harrisburg.
Harrisburg, the capital of pennsylvania is centrally
located between 'the states two largest cities, Philadelphia
to the east and pittsburgh approximatelY 200 miles to the
west.
Harrisburg is easily accessible by a network of
highways such as 1-81 and 1-83, the pennsylvania TUI:npike
and Routes 11-15, all of which provide access to the subject
property.

data as a group through an array of the data for patterns
such as a scatter diagram, a linear regression or
curvilinear regression; or multiple regression which
requires considerable data
The units of comparison can be either physical of
economic. Physical units would include comparisons based on
square feet of building space, ntmiller of apartment rooms or
uni t.!l or aC1'as, Economic units of comparison include gross
potential or effective income or net operating income. In
my opinion, physical characteristics are important, but they
take a back seat to the financial numbers because the
investment market, i.e., buyers and seller!!, are acting
predominately upon the history and potential for financial
returns.
In essence, the market approach and the income approach
carry the most weight in valuing income properties,

RELEASE
KNOW ALL MEN BY THESE PRESENTS, that we, RUTH A. MYERS, FOSTER
W. STONER and RALPH~. HOY, Executor of the Last Will and Testament of
VIOLET S. HOY, and all the persons entitled to share in the
distribution in the Estate of the decedent, do hereby declare that we
have examined the foregoing Account and Schedule of Distribution and
find them to be true and correct and in strict accordance with said
will and we acknowledge that we have this day received from RALPH ~.
HOY, Exeoutor, the items in kind and cash to which we are entitled as
per said Schedule of Distribution, in full payment and satisfaotion of
all sums owing to us under said Will.
NOW, THEREFORE, we do by these presents remise, quitclaim and
forever discharge RALPH 1<.. HOY, his heirs and assigns of an from all
actions, claims of demands whatsoever for or by reason of any act,
matter, cause or thing whatsoever to the date hereof.
WE FURTHER AGREE, to avoid the delay and expense of filing the
foregoing Account in the Court of Common Pleas of Cumberland county,
that the same may be recorded with the same effect as if it had been
submitted to and confirmed by the Court.
WE FURTHER AGREE that if any debts or demands other than those
set forth in the Account shall be recovered from or payable to the
Estate, that the same shall be paid from the reserve established by
RALPH ~. HOY, Executor / in the amount of $3,000.00 and if that sum is
insufficient, the amount necessary to pay the same shall be paid to
the Executor by Ruth A. stoner.

Agreement having been executed by all parties in interest in the
Estate of Violet S. Hoy, deceased, and filed in the Office of the

PETITION FOR DECREE TO AWARD REAL ESTATE
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The petition of John M. Eakin respectfully represents:
1.) Your petitioner is attorney for Ralph R. Hoy, Executor
of the Last Will and Testament of Violet S. Hay, deceased.
2.) Decedent died March 1, 1994, the owner of an undivided
one-half interest in a tract of land in silver spring Township,
improved with a dwelling known as 171 Millers Gap Road, Enola,
Pennsylvania. (Exhibit A attached hereto)
3.) Ralph R. Hoy, the Executor I is the owner of the other
undivided one-half interest therein.
4.) Decedent's Will devised a life estate in her undivided
one-half interest to said Ralph R. Hoy with the remainder to her
daughter, Ruth A. Stoner, who has since married and is known as
Ruth A. Myers.
5.) The real estate was appraised on the date of death at
$206,000.00, the undivided one-half interest of the decedent
being $103,000.00.
6.) The estate has been settled, the Inheritance Tax paid
and distribution made by virtue of a Family Settlement Agreement
dated October 11, 1994 and recorded in the Office of the Register
of Wills.
