In oonjunction with that litigation, a separate aotion was filed in the Orphan's Court of Dauphin County in the matter of Estate of David J. Dreher, Deceased, No. 593 of 1990, contesting the entitlement of various parties to share in the wrongful death action. 6. The end result of the litigation is that the Petitioner's minor, JULIANNA M. MURRAY-DREHER, received a oheok on January 7, 1994, in the amount of Twenty-Five Thousand, Thirteen and 12/00 ($25,013.12) Dollars, which Petitioner further believes and avers on advice of counsel that requires the appointment of a Guardian for the Estate. (a) There has never been a Guardian appointed for the minor in this acti.on, or at any other time. 7. Petitioner desires to open a sequestered deposit account with Dauphin Deposit Bank & Trust Company, 213 Market street, Harrisburg, Pennsylvania, pursuant to 20 Pa. C.S.A. ~ 5103, for her minor's Estate, subject to the requirements set forth in the Pennsylvania Decedents, Estates & Fiduciaries Code. In the alternative, Petitioner desires to serve as a Co-Guardian . along with Dauphin Deposit Bank & Trust Company. (a) Dauphin Deposit Bank & Trust Company has no interest adverse to the PetJ,tioner's minor, JULIANNA M. MURRAY- DREHER, or each other. 8. Petitioner retained the firm of Sohmidt and Ronca, P.C., to represent the interest of her minor in all the related matters orl or about September 20, 1990. (A copy of that Agreement is attached hereto and marked Exhibit "A.") " 9. Billings were reoeived on a regular basis through Maroh of 1993, at whioh time the Agreement was modified in that the balanoe of the work was to be done on a pro-bono basis exoept for oosts. 10. There remains an outstanding balance due and owing to the law firm of Sohmidt and Ronca, P.c., in an amount of Three Thousand, One Hundred and FiftY-Eight and 65/00 ($3,l58.65) Dollars. 11. In addition, Petitioner has paid One Thousand, One Hundred ($1,100) Dollars out of her own pooket prior to the modification Agreement with Schmidt and Ronoa, P.C. 12. The Petitioner desires that the Court approve payment of these sums from the funds of the said minor, with the balance to be placed in a guardianship aooount or a sequestered deposit aooount with Dauphin Deposit Bank & Trust Company. (See attached oonsent of Petitioner and letter from Dauphin Deposit Bank & Trust Company attached as EXhibits "B" and "C.") WHEREFORE, the Petitioner requests that the Court, pursuant to Pennsylvania Orphan's Court Rule 12.5 and Pennsylvania Decedents, Estates and Fiduciaries 20 Pa. C.S.A. ~ 5103 and 20 Pa. C.S.A. ~ 5111, ~ ~~., to award a citation directed to the minor, JUlianna M. MURRAY, as Parent and Natural Guardian of JULIANNA M. MURRAY-DREHER, hereinafter referred to as t1client.t1 WITNESSETH: The law firm of SCHMIDT AND RONCA, P.c., for the oon- sideration hereinafter stipulated, has undertaken and does hereby undertake and agree with Client to act as Client's attorney in negotiating for a settlement, and if the same is not effected, in bringing, conducting and prosecuting an action against MICHAEL HILLS and PENN HARRIS TAXI SERVICE, arising out of a certain automobile accident which occurred on or about June 3, 1990, at the corner of 6th and State streets, city of Harrisburg, Pennsylvania, and in addition, to process, negotiate, litigate and/or arbitrate all claims for First Party Benefits and Under insured or Uninsured Motorist Benefits to which the Client is entitled to under his insurance policy or the Pennsylvania Motor Vehicle Financial Responsibility Law. In consideration of SCHMIDT AND RONCA, P.C. 's promise to faithfully represent Client in connection with all rights, actions and claims which Client now has or which may arise in the future as a result of the above, Client agrees as follows: 1. To supply promptly, truthfully and completely all information, data and material requested by SCHMIDT AND RONCA, P.C., as necessary or useful for the furtherance of these claims; 2. To pay all costs and expenses incidental to any liti- gation or negotiations of settlement undertaken on our behalf, such costs and expenses to be advanced by SCHMIDT AND RONCA, P.C. All such out-of-pocket expenses will be advanced by SCHMIDT AND RONCA, PoCo as they are incurred. Such expenses include,' but are not limited to, filing fees, expense of obtaining medical records, copying costs, fax costs, WESTLAW costs, long distance telephone costs, expert witness fees and sheriff's service costs. Client is responsible for the payment of these expenses when the case is resolved out of the Client's share of settlement proceeds or recovery. (Note: If no recovery, Client will not be responsible for costs and expenses.) 3.(a) In any tort action brought on Client's behalf, to pay, in addition to the foregoing costs and expenses, to SCHMIDT AND RONCA, P.C., for its services an amount equal to 25% of all funds or property aocruing to Client as a result of SCHMIDT AND RONCA, PoCo 's services in securing a settlement of these claims without litigation, an amount equal to 33-1/3% of all funds or property accruing to Client as a result of SCHMIDT AND RONCA, P.C. 's services in securing a settlement of these claims after litigation has been commenced; and an amount equal to 40% if such funds or property are secured during trial or as a result a verdict or jUdgment. In any matter submitted to arbitration, litigation is commenced when the arbitrators are appointed or when a petition to a~point arbitrators is filed, whichever first occurs. In any matter submitted to arbitration, "after the beginning of trial" means the first day the arbitrators have convened to hear testimony, It being further agreed and understood that trial begins after the selection of the jury in federal court, final call of the trial list in state court, or in non-jury trials at the opening statement. (b) To pay to SCHMIDT AND RONCA, P,C., a fee in the appropriate amount as set forth in the preceding subparagraph in the event Client should refuse an offer of settlement of Client's claim or claims, whether before or after the commencement of litigation, which settlement is recommended to Client by SCHMIDT AND RONCA, P.c., in writing. (c) It is further understood that the counsel fee payable as provided in this paragraph does not include services in any appeal after trial, and if an appeal should occur, the charge for such appeal shall be such as if mutually agreed upon between Client and SCHMIDT AND RONCA, P.C. (d) Client agrees not to settle or adjust the above claim or any proceedings based thereon without first consulting SCHMIDT AND RONCA, P.C. and obtaining its written consent. (e) Client agrees to fully cooperate with SCHMIDT AND RONCA, P.C. in the prosecution of the claim that compdses the sUbject matter of this Agreement. The Petitioner, Kimberley M. swan, is an adult individual residing at 2721 Mill Road, Box 267, Grantham, Pennsylvania 17027, and is the parent and natural guardian of Julianna M. Murray-Dreher, a minor. 2. On April 29, 1994, this Court acting through the Honorable Howard E. Sheely, P.J., did enter an Order setting up a custodial bank account with Dauphin Deposit Bank & Trust Company, and approving certain disbursements from the sum of Twenty-Five Thousand, Thirteen and 1.2/00 ($25,013.12) Dollars, which was received from the Estate of David J. Dreher, deceased, on behalf of his natural child, Julianna M. Murray-Dreher, a minor. 4. The Petitioner now desires to have the Court approve distribution of the sum of Five Thousand, Nine Hundred and Twenty-Five ($5,925) Dollars payable to the Harrisburg Academy, 10 Erford Road, Wormleysburg, Pennsylvania 17043, as a tuition payment for Kindergarten for Julianna for the school year 1994- 95. A hearing was held on August 8, 1994 to consider the request. FACTUAL FINDINGS 1. Petitioner, Kimberley M. Swan, resides at 2721 Mill Road, Box 267, Grantham, Pennsylvania, and is the parent and natural guardian of Julianna M. Murray-Dreher, a minor. 2. Petitioner earns no income. 3. Petitioner's husband, Dwight Swan, is an engineer and earns approximately $33,000 gross income yearly. 4. On April 29, 1994, this court did enter an Order setting up a custodial bank account with Dauphin Deposit Bank and Trust Company, and approving certain disbursements from the sum of twenty-five thousand, thirteen and 12/00 ($25,013.12) dollars, which was received from the Estate of David J. Dreher, deceased, on behalf of his natural child, Ju1ianna M. Murray-Dreher, a minor. 1 ,I :; Ii ,. ,. , Ii " " NO. 1994 - 00289 - ORPHANS' COURT DIVISION 5. As of the hearing date, slightly over $20,000 remains in the bank account. 6. JU1ianna, age 5, is a hearing-impaired child. 7. Petitioner believes that sending Julianna to attend kindergarten at Harrisburg AOlldemy would be in Julianna' s best interest. The Aoademy is aoad~miclllly ohallenging and its class sizes ar.e smaller than publio sohool, which would allow Aoademy teachers to respond botter to Julianna's hearing problem. a. Julianna has already passed the admissions testing for Harrisburg Aoademy. 9. Petitioner desires to have the oourt approve distribution of the sum of five thousand, nine hundred and twenty-five ($5,925) dollars, payable to the Harrisburg Academy, 10 Erford Road, Wormleysburg, Pennsylvania 17043, ae a kindergarten tuition payment for Julianna, for the school year 1994-95. 10. Petitioner intends the request to withdraw funds from Julianna's aooount to be a one-time ooourrenoe only. If , Ju],ianna oontinuos at the Aoademy after completing kindergarten, petitioner will seek finanoial aid from the Aoademy, where suoh aid beoomes available from first grade through twelfth grade.
