LAST WILL AND TESTAMENT
I, MABEL I. FOSTER, of Upper Fmnkford Township, Cumberland County,
Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish Rnd
declare this to be my Last Will and Testament, hereby revoking any and ali fonner Wills or
Codicils by me made,
1.
I direct that all my just debts, funeml expenses, testamentary expenses and all Inheritance
taxes (whether such taxes may be payable by my estate or by any recipient of any property) shall
btl paid from my residuary estate as soon as pmcticable after my decease and as part of the
admlnistmtion of my estate, My Executor shall have no duty or obligation to obtain
reimbursement for any such tax so paid, even though on proceeds of Insumnce or other property
not passing undcr this Will.

I give, devise and bequeath all of my estate, both real and personal property, In equal
shares, unto my children, GLADYS GAYMAN, BETI'Y NELSON, LEROY FOSTER, RUTH
HOOVER and GEORGE FOSTER, absolutely, I hereby direct that as part of his said share of
my estate, my son, GEORGE FOSTER, shall receive In kind my mountain land in Upper
Fmnkford Township, Cumberland County, Pennsylvania, consisting of 16 acres and 44 perches
(as described In Cumberland County Deed Book "P", Volume 32, Page 593), and that the value
of said mountain land shall be detennined by an appmlsal perfonned by a qualified real estate
appmlser selected by a majority of my Executors. Should the value of the mountain land as so
detennlned exceed one. fifth of the total value of my estate available for distribution, then
GEORGE FOSTER shall have the right to pay into my estate the amount of such excess within
120 days of the date of the appmlsal lInd shall then receive title to all such mountain land,
Should GEORGE FOSTER fall to pay such sum Into my estate as so specified, then he shall
receive title to an undivided Interest In such mountain land of such percentage as is necessary
to compose one. fifth of the total value of my estate available for distribution, which Interest shall

be held In common with my other children, GLADYS GAYMAN, 8ElTY NELSON, LEROY
FOSTER and RU1lI HOOVER, each of whom shall receive an equal undivided Interest In the
remaining percentage of such mountain land, It Is my Intention in this paragraph to achieve an
equality of distribution among my five (5) said children, with GEORGE FOSTER's ~hare being
composed, to the extent possible given the goal of equality, of the said mountain land.

any real or personal property of any nature; to selt, lease, pledge, mortgage, transfer, exchange,
dispose of or grant options In regard to any or all property of any kind fomllng a part of my
estate for such tenns and such prices as the,y may deem advisable; to borrow money for any
purposes connected with the protection and preservation of my estate; to mortgage or pledge any
rr.al or personal property fonning a part of my estate or to join In or secure the partition of
same; to compromise any claims or demands of my estate against others or of others against my
estate; to make distribution in kind and to cause any share to be composed of cash, property or
undivided fractional shares in property different in kind from any other share; and to exe.cute

nus AGRBEMENT of sale Is entered Into this day of May, 1994, by and
between BETI'Y NELSON, RUTH HOOVER and GEORGE FOSTER, Executots of the
ESTATE OF MABEL I. FOSTER, deceased, late of Upptlr Frankford Township, Cumberland
County, Pennsylvania, hereinafter called "Seller", and BRIAN FOSTER of 724 Grahams Woods
Road, Newville, and ROBYN REINHART of 400 Airport Road, Shlppensburg, Cumberland
County, Pennsylvania, hereinafter called "Purchase.''',
IT IS MUTUALLY AGREED AS FOLLOWS:
I. The Seller agrees to sell, grant and convey to the Purchaser, and the Purchaser
agrees to purchase and accept the conveyance of the following described real estate situate In
Upper Frankford Township, Cumberland County, Pennsylvania, bounded and described as
follows:
ON the West and North by lands now or fonnerly of John Chronister and
Cemetery lot; on the East by a public road; and on the South by lands now or
fonnorly of Charles Baughman. CONTAINING three (3) acres and twenty-four
(24) perches, more or less, together with the Improvements, rights, privileges and
appurtenances to the same belonging,
BIDNG the same premises which George S, Sollers and Sara C, Sollers,
his wife, by Deed dated August 13, 1941, and recorded in the Cumberland
County Recorder of Deeds' Office in Deed Book "K", Volume 12, Page 75,
granted and conveyed to Edward J, Foster and Mabel I. Foster, his wife, The
said Edward J, Foster having died September 8, 1981, title In said premises
vested entirely in the said Mabel I. Foster. The said Mabel I, Foster having died
April 5, 1994, Lellers Testamentary were issued by the Register of Wills of
Cumberland County on April 14, 1994 to Betty Nelson, Ruth Hoover and George

LAST WILL AND TESTAMENT
I, MABEL I. FOSTER, of Upper Frankford Township, Cumberland County,
Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish and
declare this to be my Last Will and Testament, hereby revoking any and all fonner Wills or
Codicils by me made,
1.
I direct that all my just debts, funeral expenses, testamentary expenses and all inheritance
taxes (whether such taxes may be payable by my estate or by any recipient of any property) shall
be paid from my residuary estate as soon as practicable after my decease and as part of the
administration of my estate. My Executor shall have no duty or obligation to obtain
reimbursement for any such tax so paid, even though on proceeds of Insurance or other property
not passing under this Will,

I give, devise and bequeath all of my estate, both real and personal property, in equal
shares, unto my children, GLADYS GAYMAN, BErrY NELSON, LEROY FOSTER, RUTH
HOOVER and GEORGE FOSTER, absolutely. I hereby direct that as part of his said share of
my estate, my son, GEORGE FOSTER, shall receive in kind my mountain land in Upper
Frankford Township, Cumberland County, Pennsylvania, consisting of 16 acres and 44 perches
(as described in Cumberland County Deed Book "P", Volume 32, Page 593), and that the value
of said mountain land shall be detennlned by an appraisal pllrfonned by a qualified real estate
appraiser selected by a majority of my Executors, Should the value of the mountain land as so
detennlned exceed one-fifth of the total value of my estate available for distribution, then
GEORGE FOSTER shall have the right to pay into my estate the amount of such excess within
120 days of the date of the appraisal and shall then receive title to all such mountain land,
Should GEORGE FOSTER fall to pay such sum into my estate as so specified, then he shall
receive title to an undivided interest In such mountain land of such percentage as is necessary
to compose one-fifth of the total value of my estate available for distribution, which Interest shall

FOSTER as Executors of my estate,

I direct that my Executors shall not be required to file a bond to secure the faithful
perfonnance of their duties in any jurisdiction.

I authorize and empower my personal representatives, in their sole and absolute
discretion, to purchase or otherwise acquire and retain any investments of which I die seized or
any real or personal property of any nature; to sell, lease, pledge, mortgage, transfer, exchange,
dispose of or grant options in regard to any or all property of any kind fonning a part of my
estate for such tenns and such prices as they may decm advisable; to borrow money for any
purposes connected with the protection and preservation of my estate; to mortgage or pledge any
real or personal property fonning a part of my estate or to join in or secure the partition of
same; to compromise any claims or demands of my estate against others or of others against my
estate; to make distribution in kind and to cause any share to be composed of cash, property or
undivided fractional shares in property different in kind from any other share; and to execute

Pennsylvania. being of sOllnd and disposing mind and memory, do hereby make, publish and
declare this to be my Last Will and Testament, hereby revoking any and all fonner Wills or
Codicils by me made,
I.
I direct that all my just debts, funeml expenses, testamentary expenses and all inheritance
taxes (whether such taxes may be payable by my estate or by any recipient of any propenYl shall
be paid from my residuary estate as soon as practicable after my decease and as part of the
administration of my estate, My Executur ~liill have no duty or obligation to obtain
reimbursement for any such tax so paid. even though on proceeds of insurance or other propeny
not passing under this Will,

I give, devise and bequeath all of my estnte, both real and personal propeny, in equal
shares, UIllO my children, GLADYS GAYMAN, BEITY NELSON, LEROY POSTER. RUTH
HOOVER and GEORGE FOSTER, absolutely, I hereby direct that as pan of Ius said share of
my estate, my son. GEORGE FOSTER, shall receive in kind my mountain land in Upper
Frankford Township, Cumberland County, Pennsylvania, consisting of 16 acres and 44 perches
(as described in Cumberland County Deed Book "P", Volume 32, Page 593), and that the value
of said mountain land shall be determined by an appraisal performed by a qualified real estate
appraiser selected by a majority of my Executors, Should the value of the mountain land as so
detennined exceed one-fifth of the total value of my estate available for distribution, then
GEORGE FOSTER shall have the right to pay into my estate the amount of such excess within
120 days of the date of the appraisal and shall then receive title to all such mountain land,
Should GEORGE FOSTER fail to pay such sum into my estate as so specified, then he shall
receive title to an undivided interest in such mountain land of such percentnge as is necessary
to compose one-fifth of the totnt value of my estate available for distribution, which interest shall

be held in common with my other children, GLADYS GAYMAN, BETIY NPLSON, LEROY
FOSTER and RUTH HOOVllR, each of whom shall receive an equal undivided Interest in the

equality of distribution among my five (5) said children, with GEORGE FOSTER's share being
composed, to the extent possible given the goal of equality, of the said mountain land,

I nominate, constitute and appoint BE'ITY NELSON, RUTH HOOVER and GEORGE

I direct that my Executors shail not be required to file a bond to secure the faithful
perfonnance of ~heir duties in any jurisdiction,

I authorize and empower my personal representatives, in their sole and absolute
discretion. to purchase or otherwise acquire and retain any investments of which I die seized or
any real or personal propeny of any nature: to sell, lease. pledge, mongage, transfer, exchange,
dispose of or grant options in regard to any or ail propeny of any kind fonning a pan of my
estate for such tenns and such prices as they may deem advisable: to borrow money for any
pUflloses connected with the protection and preservation of my estate: to mongage or pledge any
real or personal propeny fonning a pan of my estate or to join in or secure the partition of
same: to compromise any claims or demands of my estate against others or of others against my

from all actions, suits, payments, accounts, reckonings, claims and demands whatever. from the
beginning of the world to the day of the date of these presents,
AND, THEREFORE, I, the said GLADYS GAYMAN, agree to refund to Betty Nelson, Ruth
Hoover and George Foster, Executors af(lresaid, any portion of the distribution to which I am not
properly entitled, and to the extent of said distribution, to indemnify said Executors for claims made
against them as Executors, and to reimburse to said Executors all expenses and costs incurred in
connection with any such claims,
AND \ hereby consent and agree thai the Orphans' Court of Cumberland County may
discharge the said Betty Nelson, Ruth Hoover and George Foster, Executors, upon application,
without further notice to me,
