2, The allegedly illegitimate child Is a minor, Jesse Robert Domene, who Is represented by
his natural mother and natural guardian, Lynsle Domene, She Is represented by Paul J,
Esposito, Esquire, of Goldberg, Katzman & Shipman, P. C,
3, Decedent's mother, Thelma Diane Hurley Is represented by R, Mark Thomas, Esquire,
4, Decedent's father, John R, Hurley, Is represented by Michael L Bangs, Esquire, of
Andes, Vaughn & Bangs,
6, There Is currently being held by the Central Pennsylvania Teamsters Pension Fund a
sum In excess of $16,000,00 which designates as the payee/beneficiary decedent's former
wile, Martha Hurley, also known as Martha Vaughn,
6, Martha Hurley, also known as Martha Vaughn Is represented by Christopher Houston,
Esquire,
7, Decedent was divorced from his said former wile by a Divorce Decree of 9 November
1990, docketed to 26 Civil 1988 In the Cumberland County Prothonotary's Office,

8, PEF Code Seotlons 6111,1, 6'111.2 deal wllh conveyanoe and/or designation of various
property rights, Including those to be abrogated and nullified III the event of a divorce,
9, PEF Code Seotlon 6111,2 would absolve the said Teamster's Pension Fund from any
lIablllly for distribution to decedent's formor wife (although by all appearances she Is no
longer entitled to the funds) unless a court order Is Issued stating otherwise,
10, The said Teamster's Pension Fund Is willing to distribute these funds to the Register of
Wills/Clerk of the Orphans' Court of Cumberland County, provided:
a.) All parties hereto sign an express release of all claims or potential claims
and the like against the said Teamster's Pension Fund, lis administrators,
trustees, counsel and any and all other persons or entities associated therewith,
b,) All parties hereto agree to have the questions concerning entitlement to
the said funds deolded by the Orphans' Court Division of Cumberland County,
Pennsyl..anla,
WHEREFORE, the parties hereto, Intending to be legally bound hereby, and to bind their
heirs, exeoutors, administrators, agents, and assigns, In consideration of one ($1,00) dollar
and other good and valuable considerations passing from each to the other, the receipt whereof Is
hereby acknowledged, agree as follows:
1. The Central Pennsylvania Teamsters PenRlon Fund will Issue a oheck for
the total balance now credlled to Terry Hurley's account In said Fund payable to
"the Register of Wills of Cumberland County" and shall mall the same to Charles
E, Shields, III who shall promptly deposll the same with the said Register of
Wills,
2. The parties hereto agree to have the question of entitlement to this fund
decided by the Orphans' Court of Cumberland County, however, this agreement
shall not work to waive or forfeit any right of appeal wllhln the state court
system. The parties do agree, however, that they will not begin nor pursue any
aotlon In the faderal courts In any event,
3. The parties hereto (except for the Central Pennsylvania Team Pension
Fund, which takes not position on this Issue) also agree that seven and one-half
(7 1/2%) per cent of the fund In question, regardless of In whom the entitlement
Is ultimately found to reside, shall be payable to Charles E, Shields, III as fair
and reasonable compensation towai'd his services In obtaining the fund and
administering the estate of Terry W, Hurley,
3a, The said parties hereto (excepting the Pension Fund) further agree that
an additional sum of either six (6%) per cent or fifteen (15%) per cent as the
oase may be, shall be withheld from distribution until a final ruling Is msde by
the Department of Revenue as to the Inheritance tax question ooncernlng these
funds.
4, The parties hereto agree to and by their joinder herein and do hereby
release, remise snd quit claim and forever discharge, and by these presents, for
themselves, their heirs, executors, administrators, agents and assigns, do
remise, release, quitclaim and forever discharge the said Central Pennsylvania
Teamster's Pension Fund, Its administrators, trustees, oounsel and any and all
other persons or entities associated therewith, lis successors and assigns, and
every of them, 01 and from all, and all manner of action and actions, cause and
causes of action and actions, sulls, debls, dues, duties, sum and sums of money,
accounts, reckonings, bonds, bills, specialties, covenants, oontracts, agreoments,
promises, variances, damages, Judgments, extents, executions, claims and
demands, whatsoever, In law or eqully, or otherwise howsoever, which against
the said Central Pennsylvania Teamster's Pension Fund, They ever had, now
have, or which they, their hairs, executors, administrators, agents and assigns
hereafter can, shall, or may have, for upon or by reason of any matter cause, or
thing whatsoever, from the beginning of the world to the day of the date of these
present,

Decedent di.ed August 26, 3.993, survived by his minor child, his parents and
former wife (not his child's mother) ,
At the time of Decedent's unmarried and intestate death, there was a pension
fund in excess of $16,000,00 held by the Central Pennsylvania Teamsters which
designated decedent's former wife, Martha Vaughan, as beneficiary, After much
negotiation, the estate's former Administrator obtained a release of the fund to
the Cumberland County Register of Wills/Clerk of the Orphans' Court,
The funds are currently held in a Certificate of Deposit pending a decision'
of the Orphans' Court as to the distribution of said funds,
The Department of Revenue has determined (by Private Letter Ruling) that the
Central Pennsylvania Teamsters Pension Fund benefits are llQt subject to
Pennsylvania Inheritance Tax,
The above distribution is proposed in accordance with the agreement reached
between the four parties, i. e, mother, Thelma Diane Hurley, father, John R,
Hurley, Lynsie Domene, natural mother and guardian of Jesse Robert Domene, minor
child, and former wife, Martha Vaughan,

TO THE HONORABLE JUDGES OF THE SAID COURT.
NOW COMES CHARLES E. SHIELDS, III and respectfully represents as follows:
1, Petitioner, CHARLES E, SHIELDS, III, Is a member In good standing 01 the Cumberland
County Bar.
2. In the autumn of 1994. your Petitioner was personally approaohed by Michael
Bangs, Esq. and Mark Thomas. Esq, and was asked to do them a professional and personal favor
regarding the above-oaptloned estate; namely, to serve as administrator thereuf.
3, The reason for the request was that the deoedent had died Intestate and that his
parents, Thelma D. Hurley (represented by Mr, Thomas) and John R. Hurley (represented by
Mr, Bangs) were divorced and were, In short, unable to agree on much of anything Involving the
estate, Including who should have the right to administer It,
4, It was represented 10 Petitioner at the time that there were only a few assets, that the
decedent's mother had paid the funeral and related expenses and that assets would be sufficient to
meet all expenses. Among the assets was a pension fund whloh was supposedly already
determined to be a part of the estate,
5. Despite the readily apparent proposition that Petitioner would likely make no money
on his service as administrator/counsel for the estate, given the likely amount of time to be
consumed, he agreed to the request by two (2) other members of the bar,
6, The representations made to him have turned out to be grossly Inaccurate, This Is not
to Insinuate that either Mr. Thomas or Mr, Bangs were aware of these Inaccuracies at the time
the representations were made,
7, Petitioner now has a file whlch, whon measured by a ruler, exceeds three (3) Inches
In thlcknees, Much of the file has been generated by Petitioner In his efforts to simply get

enouph data together to file an Inheritance tax return .. which he has not yet been able to do.
8. Petitioner was foroed to undertake extensive and drawn-out efforts to have the
pension fund paid over to an esorow acoount at the Register of Wills, There are lour (4)
olalmants to this lund: Thelma 0, Hurloy; John R, Hurley; an alleged Illegitimate ohlld
represented by Paul Esposlto, Esq,; and a lormer wife, who olalms to be entitled to the proceeds
because the forms to remove her as a benellolary were never properly !llIed out. She Is
represented by Christopher C, Houston, Esq,
9, It was only through Petitioner's tenaolous and persistent efforts over many months
that the pension lunds were eventually released and plaoed In esorow, The pension lund'a
attorney originally wanted the matter litigated In the lederal cOlin In Philadelphia,
10, By agreement 01 all panles, Petitioner Is to be paid seven and one-hall (7 1/2%)
per oent 01 the lunds in the Esorow account (now In excess 01 $22,000.00), (See copy of
agreement attached as Exhibit A).
11, Petitioner gave the parties until July 1, 1996 to try to reaoh an agreement as to a
division of the escrow lunds, He has not received any communication on the matter Irom anyone
or their counsels exceptlrom Mr, Hurley who is now representing himself QLQ. aB"
12, It Is apparent that no agreement has been reached and that no agreement will be
reached.
13, In late June 01 1996, It was revealed to Petitioner that there are likely other
various assets whloh have not been reponed to Pelltloner.
14, A letter 01 Inquiry 01 lAte June to Mr, Thomas requesllng a statement under oath on
this matter by Mrs, Hurley remains unanswered as 01 the time 01 preparallon 01 this Petition,
15. Petitioner Is currently In control 01 an estate checking account with slightly less
than two thousand ($2,000,00) dollars In It,
16, Although Petitioner has had no personal problem In dealing with either Hurley, It Is
apparent that they cannot and will not agree C/n anything -- even the family exemption provided
by law.
17, Petitioner now laces the prospect 01 being forced to litigate all 01 these matters,
18, Pelltloner undertook what wall supposed to be a simple admlnlstrallve matter, In
good faith, despite lack 01 any real likelihood 01 any prollt.
19, Representations made to Petitioner were grossly Inacourate and, as a result, he has
expended great amounts 01 time and overhead on the matter,
20. From December 24, 1995 to June of 1996, Pelltloner was hospitalized three (3)
times with heart problems. He Is on restricted hours 01 work as It Is and has had to turn down
July 10, 1816
