WHEREAS, the Pennsylvania Inheritanoe Tax Return has been filed
and audited by the Pennsylvania D$partment of Revenue to date, and

WHEREAS, the 1994 Federal and State Inoome Tax for the decedent
for the period January 1, 1994 tc April 14, 1994, cannot be filed
until after December 31, 1994, and
WHEREAS, to the best of the Executrix' knowledge, information and
belief, there are no creditors or potential creditors of the decedent,
and
WHEREAS, the ExeGutrix proposes to make a partial distribution of
the Estate assets, reserving adequate funds to pay 1994 Income Taxes.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that we, Gary D.
Lininger, John C. Clelan, Karen E. DeMartyn, Paul K. Lininger and
Lori A. Kefover, being the legatees of Kathryn J. Lininger, deceased,
and the only persons entitled to share in said residuary estate, do
hereby declare that we have examined the foregoing Account and
Proposed Schedule of Distribution and find the same to be true and
oorreot and in strict corlformance with eaid Will and do hereby agree
to a partial distribution of the Estate assets at the present time.
The partial distribution shall include (a) payment of all speoific
bequests upon receipt from each legatee of a proper reoeipt and
releasa, (b) retention of the Bum of sixty ($60.00) Dollars by the
Exeoutrix to pay any and all unpaid inoome taxes and debts, if any,
and (0) payment of the residuary estate to John C. Clelan, Karen E.
DeMartyn, Paul K. Lininger and Lori A. Kefover in the amount set
opposite each name on the Proposed Schedule of Distribution.
NOW, THEREFORE, we, and each of us, Gary D. Lininger, John C.
Clelan, Karen E, DeMartyn, Paul K. Lininger and Lori A. Kefover,
acknowledge that we have received the amount to which we are entitled
to reoeive under decedent's Will, except for the sum of Sixty ($60.00)
Dollars retained by the Executrix, including principal and interest.
NOW, THEREFORE, Lori A. Kefover acknowledges that she has
retained the sum of Sixty ($60.00) Dollars in a bank account from
which she agrees tn pay the 1994 Federal and Pennsylvania Inoome Tax
owed by deoedent for the portion of 1994 preoeding the date of death.
The retained amount shall be paid to John C. Clelan, Karen E.
DeMartyn, Paul K. Lininger and Lori A. Kefover, in equal shares, on or
before April 14, 1995,

release and forever discharge the said Lori A. Kefover, her heirs and
personal representatives, of and from all actions, claims, demands,
suits at law or equity by reason of any act, matter, cause or thing
whatsoever which in any manner involves the settlement cf decedent's
Estate,
AND, desiring to avoid the delay and expense cf the settlement of
the Estate by filing the foregoing account of her administration in
the Office of the Register of Wills and by having the balanoe for
distribution as shown by the Account distributed by Order of Court,
we, and each of us, do hereby agree that the foregoing statement
concerning the manner of settlement may be recorded with the same
effect as if the same had been submitted to and approved by the Court
of Common Pleas, Orphans' Court Division.

AND NOW,' the ~rday of December, 1994, a Family Settlement
Agreement having been executed by all parties in interest in the
Estate of Kathryn J. Lininger, deceased, and filed in the Office of
the Register of Wills of Cumberland County, December, 15, 1994, IT IS
ORDERED AND DECREED that the interest of the decedent in the following
, described real estate be distributed as provided in decedent's Will,
to wit: Gary D, Lininger. The description of the premises is:
ALL that certain tract of land situate in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and
descdbed in accordance with survey and plan thereof made by Ernest J.
Walker, Professional Engineer, dated August 20, 1966, as follows:
BEGINNING at a point on the center line of Pennsylvania State
Highway Route No. 944 leading from Enola to Sterretts Gap/ known as
Wertzville Road, at lands now or formerly of Charles M. Lovendusky and
wife; thence along said last mentioned lands South 2 degrees 20
minutes West 300 feet to an iron pin at other lands now or formerly of
Lawrence L. Brown and Ruth C. Brown, his wife; thence along said last
mentioned lands North 88 degrees 36 minutes West 200 feet to a point
at lands of George C. Moore and Dorothy R. Moore, his wifel thence
along said last mentioned lands North 2 degrees 20 minutes East 299.53
feet to the center line of Pennsylvania State Highway No. 944, leading

The petition of John M, Eakin respectfully represents:
1.) Your petitioner is attorney for Lori A. Kefover,
Executrix of the Last Will and Testament of Kathryn J. Lininger,
deceased.
2.) Decedent died April 14, 1994, the owner of one-half
interest in a tract of land in silver spring TownShip, improved
with a dwelling known as 6897 Wertzville Road, Enola,

3.) Decedent's Will devised said real estate to her son,

4.) The real estate was appraised on the date of death at

5.) The estate has been settled, the Inheritance Tax paid
