In accordance with your Order of June 18, 1997, I am pleased to advise you that
I have obtained an Affidavit from Dianne M, Simmons and E, Scott Tittle, the children of
Gloria J. Tittle, concerning the sum that was expended from the Estate Aocount of the.
above-captioned Estate,
We are enclosing the Affidavit with this correspondence.
I would hope this would be sufficient and we would again request that the Order
of Court, which was presented to you In Juno of this year, be executed.
Certainly, If there Is any other Information which you need, or If you would like to
speak with me In chambers, I will be very happy to meet with you.
Incidentally, I have three additional Affidavits, all of them the same and all of them

Personally appeared and separately appeared before Notary Publics, In and for
said States and Oountles, DIANNE M. SIMMONS, of the State of Oallfornla, Oounty of
Riverside and SOOTT E. TITTLE, of the State of Wisconsin, Oounty of t.(fdtee...., ,
who being duly sworn according to law, deposes and say that:
1, We are DIANNE M. SIMMONS and E. SOOTT TITTLE, adult children of
Gloria J, Tittle, deceased, as captioned above,
2. Heretofore, and during the month of June 1997, your deponents caused a
Petition to be presented to the Oourt of Oommon Pleas, as referred to above, concerning
the sum of $5,259.60 as taken from the Estate Account of Gloria, J, Tittle, Deceased,
This Is referred to In the above.stated Petition and the reasons therefore are as set forth
In paragraph 11 of said Petition.
3. Thereafter, Hmry L. Bricker, Jr" Esquire, Attorney for the Estate of Gloria
J, Tittle, met with the Honorable Harold E. Sheely, President Judge, and was advised by
Judge Sheely, and thereafter, Imparted to us the Oourt's request that an Affidavit be
submitted stating how the money was withdrawn and what It was used for,
4, As stated In said Petition, forty percent (40%) of the distributable estate was
bequeathed to three minor children; the three minor children In question are the children
of Dianne M. Simmons and their names are Justin E, Simmons, Mallyn M, Simmons, and
Makenna O. Simmons, The three minor children in question are destitute; their father,
Neal Simmons, separated from his wife, Dianne, and the three children, and he has
refused to support the three children In question, Food and shelter were needed for them
and that Is the reason Ihat sum of $5,259,60 was taken from the Estate Account.

5. The sum of $5,259,60 was expendod as follows:
A. November 1, 1995. Rent for Dianne M. Simmons
with whom the three minor children resided.
necessitated by reason of desertion by husband and
non-support by husband: $1,200.00
B. January 1, 1996 . Rent: 1,200.00
a, February 19, 1996. Groceries: 132.00.
D. March, 1996 - Groceries: 177.60
E. April, 1996 . Groceries: 150,00
F. June 1, 1996 . Security deposit on new apartment
for Dianne M, Simmons and three minor children: 800,00
G, June 1, 1996 - Rent: 800.00
H. June 1, 1996 - Last month's rent. required payment
by reason of credit problems due to abandonment
by hUllband: 800,00
TOTAL EXPENDED: $5,259.60

5, Shortly after the Will was probated, an estate account was opened at Dauphin
Deposit Bank & Trust Company, and the account was maintained for a time I:ll the office
of Harry L. Bricker, Jr., the attorney for the ostate and tho other co. executor. Thereafter,
the account was transferred to E, Scott Tittle by reason of medical problems which were
then being suffered by the said Harry L. Bricker, Jr,
6, As the estate began to conclucfo, It was noted that the sum of $31,626,07
was available for distribution to the three minors and accordingly, a Petition was
presented to your Honorable Court requesting authority to proceed with the distribution
of the minors' share of the estate; annexed to that Petition was an Accounting for
Purposes of Distribution to Minors which stated that the sum of $31 ,626,07 was available
for distribution to the minors,
7. As the Petition noted, the social socurity number of Justin E, Simmons was
563-83-7211; the social security number for Mallyn M, Simmons was 554-93-6090; as the
Petition further notes, the child, Makenna C, Simmons, even though she was, at that time,
almost two years of age, had yet to receive a social security number,
0, Also attached to that Petllion was a proposed Order of Court which, on
March 1, 1996, was accepted and signEld by the Honorable Harold E, Sheely, President
Judge, A copy of that Order of Court Is attached hereto, made a part hereof, and marked
"Exhibit A", Tho Order of Court directs that the sum of $10,542.03 be distributed to the
minor child, Justin E, Simmons, and directs that said sum be deposited in a sequestered
or restricted account with Dauphin Deposit Bank & Trust Company; the Ordor of Court
goes on to state that the sum of $10,542,02 be distriblJted to the minor child, Mallyn M.
Simmons, and directs that said sum be deposited in a sequestered or restricted account

with Dauphin Deposit Bank & Trust Company. Finally, the Order of Court goes on to
state that the sum of $1 0,542,02 be deposited in Dauphin Deposit Bank & Trust Company
for Makenna C. Simmons when a social security number is obtained for the said
Makenna C. Simmons.
9, The sum of $10,542.03 was deposited as directed for Justin E, Simmons,
and the sum of $10,542,02 was deposited as directed for Mailyn M, Simmons, However,
because Makenna C, Simmons, tho youngest of the three children, had to have a Social
Security number to open her account, no account was opened for her and the funds in
question continued to remain in the estate checking account.
10, Thereafter,lt was learned that a Social Security number had been obtained
for Makenna; that number is 610-90-5937, and at that time the allorney for the estate,
Harry L. Bricl\er, Jr., attempted to arrange to have the sum of $10,542,02, in accordance
with the Court's Order of March 1, 1996, deposited in an account at Dauphin Deposit &
Trust Company for the said minor child and he learned at that time that there was a
shortfall in the estate account in the amount of $5,259,59,
11. When asked about the shortfall it was learned that the sum of money which
was taken out was taken out by E, Scott Tittle and Dianne M, Simmons and used for the
three children in question, It was further learned that the husband of Dianne M,
Simmons, Neal Simmons, deserted his family and was net paying support and the funds
in question wore used to provide the very basic necessities for the existence of these
three children. Further, it was believed by E, Scott Tillie and Dianne M, Simmons, that
they were justified in using the estate assets in that fashion since obviously it was not the
desire of the decedent that her grandchildren become destitute, or in fact, starve to death
