GUEVARA, of the Township of Hampden, County of cumberland and Commonwealth of Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish and declare this as and for my Last Will and Testament, hereby revoking and making void all former wills and codioils by me at any time heretofore made. FIRST. I order and direct that all my just debts and funeral e~penses be paid by my Executor or Executrix, ~s the case may be, hereinafter named, as soon as conveniently may be done after my decease. SECOND. I give, devise and bequeath all the rest, residue and remainder of my Estate, real, personal and mixed, whatsoever and wheresoever situated, unto my son, namely, DONALD J. GUEVARA, absolutely and in fee simple. THIRD. If my said son, DONALD J. GUEVARA does not survive me, then and in that event, I give, devise and bequeath my said entire residuary estate in equal shares unto his children hereafter born but living at the time of my death, share and share alike, absolutely and in fee simple, sUbject, however, to the protective provisions of Item Fourth hereinbelow. FOURTH. In the event that any person entitled to a d~stributive portion of my Estate has not attained the age of twenty~three (23) years at the time of distribution thereof, I order and direct that each such share shall be paid over and delivered unto DAUPHIN DEPOSIT BANK AND TRUST COMPANY of Harrisburg, pennsylvania, as my testamentary Trustee, IN SEPARATE TRUSTS, NEVeRTHELESS, to hOld, manage, invest and reinvest for and until the beneficiary attains the age of Ii.- " L-\W OFFICES SNELEI^K~R & ELICKER ~ ...." , .. ~ twenty-three (23) years, at which time said Trust shall be terminated and the then remaining balance thereof shall be distributed unto the beneficiary, absolutely, During the existence of such Trust, (1) I authorize and empower my said Trustee to use, consume, expend and apply, from time to time, such amounts of income and principal as the said Trustee shall determine by the exercise of its sole discretion to be necessary and proper for the education of the beneficiary [the term "education" to be construed to mean college or other post-highschool training which is designed to promote the adult productivity of the beneficiary or to enhance his or her quality of life], and (2) I order and direct that all assets in said Trust and the income therefrom shall be free from and not subject to the voluntary or involuntary disposition by the beneficiary whether by pledge, assignment, sale, attachment, execution or by any other means whatsoever, it being my intention that the benefits of said Trust shall be disbursed only by the discretionary distribution by said Trustee as provided hereinabove. LASTLY. I nominate, constitute and appoint my son, DONALD J. GUEVARA, to be the Executor of this, my Last Will and Testament, but if for any reason my said son should faJ.1 to qualify as such Executor or cease 80 to serve, then and in that event, I nominate, constitute and appoint my friend, YVONNE DOBSON, to be the Executrix hereof, each and both to serve without bond or other security as a condition for qualification hereunder.
