I am sorry for the delay in writing to you. You represent the estate of Mr. Henry Hanson III, who recently became deceased while employed at Dickinson College, Under Pennsylvania Law, certain pension benefits are excluded from the inheritance tax while other pension benefits are subject to this taxation. A threshold questions is the availability of the pension benefits in cash. Dickinson College permits cash withdrawals from TIAA-CREF annuities upon termination of employment, On Its face, this might suggest that these annuities would be subject to Inheritance tax. However, in conversations with Mr. Paul Dibert of the Pennsylvania Department of Revenue. Our attorneys were informed that when an employee dies while working for an employer, if no cash from the pension plan was available while employed, the benefits are excluded from Pennsylvania Inheritance Tax. Since Mr, Henry Hanson died while employed at Dickinson College and since cash is available only upon termination of employment, It is our understanding that his TIAA-CREF annuities would not be subject to Pennsylvania Inheritance Tax, I should state that TIAA-CREF cannot prOVide tax advice and can only provide our understanding of the law. If you have further questions regarding this matter, I would be happy to entertain them. I have not been able to perform the research that I wanted regarding actual cases.
