LAST WILL AND TESTAMENT
I, NORA M. ESER, of Middlesex Township, Cumberland County,
Pennsylvania, being of sound and disposing mind and memory, do
hereby make, publish and declare this to be my Last Will and
Testament, hereby revoking any and all former Wills or Codicils
by me made.
1 .
I direct that all my just debts, funeral expenses, and
administrative expenses be paid from my estate, as soon as
practicable after my death.
2.
I give and devise to my daughter, SHIRLEY ANN ESER, a
building lot to be subdivided from my real estate in loliddlesex
Township, Cumberland County, Pennsylvania. The expenses of such
subdivision shall be borne by my estate and the area of such lot
shall be determined by taking the minimum area necessary to
qualify as a building lot under the then current atate and local
subdivision regulations. It is 10Y intention that such lot shall
comprise the portion of my real estate on which a certain
trailer owned by my said daughter is currently located.
3.
I give, devise and bequeath the full sums in any and all
bank accounts of which I die seized unto my grand-daughter,
ALICIA NICHOLE ESERI provided, however, that these funds shall
be held in trust by my TI'ustee under the terms and conditions
described in sub-paragraphs (a) through (f) of paragraph 4
hereof.
4.
All the rest, residue and remainder of my estate I give,
devise and bequeath in equal shares unto my daughter,

SHIRLE! ANN ESER and my two grandchildren, ALICIA NICHOLE ESER
and RICHARD A. ESER, one-third (1/3) to each, provided, however,
that the shares of my said grandchildren shall be held in
separate trusts by my Truotee under the following terms and
conditions I
(a) I direct that my Trustee shall hold, invest, and
reinvest the share of such beneficiary, collect the income
arising therefrom, and after paying all expenses incident to the
management of the Trust, to use and apply as much of the income
and principal as may be necessary in the sole discretion of my
Trustee for the support, well-being and education of such
beneficiary.
(b) I direct that the income arising from said Trust shall
be payable directly to ouch beneficiary as he or she shall
attain the age of eighteen (18) years.
(c) I direct that each of the said benefioiaries shall
have the right of withdrawal of his or her share of the Trust at
the age of twenty-five (25) yea~s.
(d) In the event any of the said beneficiaries shall fail
to attain the age for distribution of any part of his or her
share and shall be survived by issue, then his or her share
shall be held by my Trustee for said issue and distrJ.buted to
them equally as each shall attain the age of twenty (20) years.
The share or undistributed share of any of the said
beneficiaries who shall not be surviv~d by issue shall be
distributed by my said Trustee to such remaining grandchild in
accordance with the terms hereof.
(e) Prior to the distribution of the principal of any
share, my said Trustee shall have the sole discretion to ,i.nvade

the principal of said share for the support, maintenance and
education of such beneficiary or issue of such beneficiary,
regardless of age.
(f) To the extent that the same is permitted by law, none
of the beneficiaries hereunder shall have any power to dispose
of or to charge by way of anticipation any interest given to
such beneficiary; and all. sums payable to such beneficiaries
hereunder shall be free and clear of the debts, contracts,
alienations and anticipations of the beneficiaries, and all
liabilities for levies and attachments and proceedings of
whatsoever kind, at law or in equity.
5.
I nominate, constitute and appoint FARMERS TRUST COMPANY as
Executor and Trustee hereunder.
6.
r direct that neither my Executor nor my Trustee shall be
required to file a bond to secure the faithful performance of
its duties in any jurisdiction.
7 .
I authorize and empower my Executor and Trustee, in its
sole and absolut.e discretion, to purchase or otherwise acquire
and retain any investments of which I die seized or any real or
personal property of any nature; to sell, lease, pledge,
mortgage, transfer, exchange, dispose of or grant options in
regard to any or all property of any kind forming a part of my
e~tate for such terms and such pricee as it may deem advisable;
to borrow money for any purposes connected with the protection
and preservation of my estate; to mortgage or pledge any real or
personal property forming a part of my estate or to join in or

Pennsylvania, being of sound and disposing mind and memory, do
hereby make, publish and declare this to be my Last Will and
Testament, hereby revoking any and all former Wills or Codicils
by me made.
1.
I direct that all my just debts, funeral expenses, and
administrative expenses be paid from my estate, as soon as
practicable after my death,
2.
I give and devise to my daughter, SHIRLEY ANN EBER, a
building lot to be subdivided from my real estate in Middlesex
Township, Cumberland County, Pennsylvania. The oxpenses of such
subdivision shall be borne by my estate and the area of such lot
shall be determined by taking the minimum area necessary to
qualify as a building lot under the then current state and local
subdivision regulations. It is my intention that such lot shall
comprise the portion of my real estate on which a certain
trailer owned by my said daughter is currently located,

I give, devise and bequeath the full sums in any and all
bank accounts of which I die seized unto ,my grand-daughter,
ALICIA NICHOLE EBER; provided, however, that these funds shall
be held in trust by my Trustee under the terms and conditions

and RICHARD A. ESER, one-third (1/3) to each; provided, however,
that the shares of my said grandchildren shall be held in
separate trusts by my Trustee under the following terms and
conditionsl
(a) I direct that my Trustee shall hold, invest, and
reinvest the share of such beneficiary, collect the income
arising therefrom, and after paying all expenses incident to the
management of the Trust, to use and apply as much of the income
and prlncipal aEl may be necessary in the Bole discretion of my
Trustee for the support, well-being and education of such
beneficiary.
(b) I direct that the income arising from said Trust shall
be payable directly to such beneficiary as he or she shall
attain the age of eighteen (18) years.
(c) I direct that each of the said beneficiaries shall
have the right of withdrawal of his or her share of the Trnst at
the age of twenty-five (25) years.
(d) In the event any of the said beneficiaries shall fail
to attain the age for distribution of any part of his or her
share and shall be survived by issue, then his or her share
shall be held by my Trustee for said issue and distrlbuted to
them equally as each shall attain the age of twenty (20) years.
The share or undistributed share of any of the said
beneficiaries who shall not be survived by issue shall be
distributed by my said Trustee to such remaini~g grandchild in
accordance with the terms hereof.
(e) Prior to the distribution of the principal of any
share, my said Trustee shall have the sole discretion to invade

education of such beneficiary or issue of such beneficiary,
regardless of age.
(f) To the extent that the same is permitted by law, none
of the beneficiaries hereunder shall have any power to dispose
of or to charge by way of anticipation any interest given to
such beneficiary; and all sums payable to such beneficiaries
hereunder shall be free and clear of the debts, contracts,
alienations and anticipations of the beneficiaries, and all
liabili ties for levies and attachments and proceedings of
whatsoever kind, at law or in equity.
5.
I nominate, constitute and appoint FARMERS TRUST COMPANY as
Executor and Trustee hereunder.
6.
I direct that neither my Executor nor my Trustee shall be
required to file a bond to secure the faithful performance of
its duties in any jurisdiction.
7.
I authorize and empower my Executor and Trustee, in its
sole and absolute discretion, to purchase or otherwise acquire
and retain any investments of which I die seized or any real or
personal property of any nature; to' seli, lease, pledge,
mortgage, transfer, exchange, dispose of or grant options in
regard to any or all property of any kind forming a part of my
estate for such terms and such prices as it may deem advisable;
to borrow money for any purposes connected with the protection
and preservation of my estate; to mortgage or pledge any real or
personal property forming a part of my estate or to join in or
