LAST WILL AND TESTAMENT
I, LESTER D. Y ARLE'rT, of Middlesex 'I'owl1shlp, Cumberland County,
Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish
and deolare this to be my Last Will and Testament, hereby revoking any and all former
Wills or Codiolls by me made.
1.
I direct that all my just debts, funeral expenses, testamentary expenses and all
Inheritance taxes sha\1 be paid from my residuary estate as soon as praotlcable after
my deoease and as part of the administration of my estate.
2.
I give and bequeath the sum of One Thousand Dollars ($1,000.00) to MIDDLESEX
UNITED METHODIS'I' CHURCH.
3.
I give, devise and bequeath all the rest, residue and remainder of my estate, both
real and perdonal property, unto my wife, MABEL W. Y ARLETT, absolutely, and I
hereby appoint my said wife as Executrix of this, my Last Will and 'restament.
4.
In the event my said wife sha\1 predecease or fall to survive me, then I give,
devise and bequeath a\1 the rest, residue and remainder of my estate as follows I One-
third (1/3) thereof to the Issue of my sister, SARAH EVELHOCH, one-third (1/3)
thereof to my sister-in-law, EDNA G. SHEAFFER, and one-third (1/3) thereof to my
sister-in-law, MARY G. MORHISON, all of said shares shall be absolute. I hereby
appoint FARMERS TRUST COMPANY, Carlisle, Pennsylvania, as Executor under the
provisions of this fourth paragraph of my Last Will and Testament.
5.
I direct that my said Executrix or Executor sha\1 serve without being required to
fUe a bond In any court to secure the faithful performance of their duties.

Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish
and deolare this to be my Lust Will and Testament, hereby revoking any and all former
Wills or Codlells by me made.
1.
1 direct that all my Just debts, funeral expenses, testamentary expenses and all
inheritance tuxes shall be paid from my residuary estate as soon as practicable after
my decease and as part of the administration of my estate.
2.
I give and bequeath the sum of One Thousand Dollars ($1,000.00) to MIDDLESEX
UNITED ME1'HODIS1' CHURCH.
3.
I give, devise and bequeuth all the rest, residue and remainder of my estate, both
real and personal property, unto my wife, MABEL W. YARLETT, absolutely, and I
hereby appoint my said wife as Executrix of this, my Last Will and Testament.
4.
In the event my said wife shall predecease or fall to survive me, then I give,
devise and bequeath all the rest, residue and remainder of my estate as follows I One"
third (1/3) thereof to the Issue of my sister, SAHAH EVELHOCH, one-third (1/3)
thereof to my sister-In-law, EDNA a. SHEAFFER, and one-third (1/3) thereof to my
slstor-In-Iaw, MAHY G. MOHHISON, all of said shures shall be absolute. I hereby
appoint JlAHMEHS THUS'!' COMPANY, Carlisle, Pennsylvania, ns Executor under the

19B'f, by and between LES'I'EH D. YAHLE'I"1' and MABEl, W, YARLE'fT of MiddleslJx
Township, Cumbcrland County, Penllsylvallia (hereinafter referred to as "Settlors"),
and FAHMERS THUST COMPANY, Carlisle, Cumberland County, Pennsylvania
(hereinafter I'eferred to as "Trustee"),
WHEREAS, Settlors desire to create a trust by depositing with the Trustee
certain property; and
WHEREAS, the Settlors may hereafter desire to deposit with Trustee additional
property,
NOW, THEREFOHE, the Trustee agrees to hold all said property so deposited
now or hereafter under the terms of this Agreement and to manage, invest and
reinvest said property in trust for the following purposes and uses:
ARTICLE I
The Trustee shall eollect the income from the Trust Estate and shall pay all
proper eharges and expenses. The net income of the 1'rust Estate after payment of all
such charges and expenses shall be held, adm inistered and invested by the Trustee, to
be distributed, together with the net Income and such accumulated income and corpus,
as hereafter provided. All dividends payable and shares of stock on the corporations
declaring the dividend shall be treated as principal without regard to the number of
shares payable.
ARTICLE n
During the lifetime of the Settlol'S, the net income of the trust, if any, shall be
paid to or for the benefit of the Settlors, in monthly installments, and the principal of

the trust, If uny, or any POI'tiO!1 of the principal, shall be paid as Settlors, or Someone
acting legally on their behalf, may demand. Even though the Settlors UI'O not
adjudicated Incompetent, if they IIl'e under a logal disability or because of mental or
physicul disability they ure, In the opinion of the Trustee hereundel', unable to muke
reasoned demands for amounts from the principal, the Trustee hereunder shall pay for
their benefit such amount from the principal as may be neeessary to malntuln for them
a standard of Ilvlng approximately equal to that mulntalned by them during their
lifetime, and to meet their expenses arising from ill health, or invalldlsrn. Upon the
death of either of the Settlors, the principal of the trust and accumulated income
therefrom, If any, shull be held under the uforesald provisions for the surviving Settlor
for his or her Ilfe.
ARTICLE m
Upon the death of both Settlors, the Trustee shall distribute the same to the
personal representative of such deceased Settlor to be administered as part of such
deceased Settlor's estate and distributed under the terms of such Settlor's Last Wfll
and Testament.
ARTICLE IV
In addition to the powel's conferred by case law, by statute, and by other
provisions hereof, my Trustee and its successors, shall have the following diseretionary
powers applicable to all property held by it which powers shall be effective without
order of any eourt and shall exist until final distributiol1l
(a) To retain any property of any nature received by it for whlltever period it
shall deem advisable,

(b) '1'0 invest and reinvest all or any part of said property in such stocks, bonds,

without regard to stututes llmiting the property which a fiduciary ITIny pUl'chase;
(c) To scll, transfel', exchunge or othcrwlse dispose of, any part of said
property, for cash or on terms, publicly 01' pl'lvately, or to lense, even for a term
exeeeding five (5) yeul'S or the duration of this Trust, without linbility on the
purchasers or lessees to see to the appliea tion of the proceeds, and to give options for
these purchases without the obligation to repudiate them in favor of a higher offer;
(d) To execute and deliver any deeds, leases, assignments or other instl'uments
as may be necessary to carry out the provisions of this '/'rust;
(e) To borrow money, including the right to borrow money from any bank and
to mortgage or pledge any asset of the Trust as securi ty;
(C) To assume continuance of the status of any beneficiary with regard to
death, marriage, divorce, llIness, incapacity and the like in the absence of information
deemed reliable without liability for disbursements made on such assumption;
(g) To pay f,'om the corpus of the Trust, or the income therefrom, all debts,
claims, taxes or simllar charges;
(h) To make any distribution hel'eunder either in kind or in money, or partially
in kind and partially in money, Distribution in kind shall be made at the market value
of the property distributed, and the Trustee, in its absolute discretion, may cause the
share distributed to any distributee to be eomposed of property simllar to or different
from that distributed to any other distributee;
(I) To exercise any subscription right in connection with any security held
hereunder, to consent to or participate In any recapitalization, reorganization,

(j) To invest in endowmcnt, Insurance or annuity policies on the lives of
beneficiaries of this Tl'ustl
(k) 1'0 continue in any partnership, Joint venture, Joint ownership or other
business enterprise in which Settlors have an interest and contribute to this trust;
(I) To compromise claims;
(m) To continue for whatever period of time as It shall deem necessary any
ownership as a tenMlt in common or as a partner, In real estate or other property and
to act as Settlors could have done while Settlors were living;
(n) 1'0 do all other acts In Its judgment neeessary or desirable for the propel'
management, Investment and distribution of this Trust.
ARTICLE V
During the lifetimes of Settlors, or either of them, both Settlors or the survivor
shall have the right at any time, and from time to time, by an instrument in writing
forwarded ~o the Trustee, to alter, amend or revoke this agreement, either in whole or
in part, provided, however, that if altered or amended, the duties, powers and
responsibilities of the Tl'ustee shall not be substnntially ehanged without consent. In
the case of revocation, the trust estate shall be conveyed by the Trustee to the
Settlors or the survivor 01' in accordanee with written directions given to Trustee by
the Settlors or Settior.
