consideration of tho foregoing Petition for Allowance of
Expenditures from Principal of a Minor'S Estate, Pennsylvania
National Bank and Peggy Garcia Charney, co-guardians of the estate
of Daniel Garcia Charney, a minor, are hereby ordered to appear
before this Court at a hearing to determine whether said co-
guardians should be authorized to disburse to David G. Charney and
peggy Garcia Charney the sum of One Hundred Dollars ($100.00) per
month from the principal of the estate of Daniel Garcia Charney to
be used for the support, maintenance and education of Daniel Garcia
Charney. Said hearing ,shall be held in Court Room No. ~ of the
Cumberland County Courthouse in Carlisle, pennsyl.vania, commencing

5. Daniel Garcia Charney resides wi th his parents, David G.
Charney and Peggy Garcia Charney.
6. Daniel Garcia Charney is ten (10) years old, and he
attends public school.
7. The estate of Daniel Garcia Charney consists ot an asset
portfolio administered by Pennyslvania National Bank and inCluding
cash, cash equivalents, fixed income and equity investments
totaling $31,990.09 as of May 11, 1994.
B. The income derived from Daniel Garda Charney's estate
totals approximately $1,600.00 per year.
9. The income derived from Daniel Garcia Charney's estate is
consumed entirely by taxes and the costs of administering his
estate.
10. Daniel Garcia Charney I s parents are unable to provide for
his total support, maintenance and education.
11. It is necessary to invade the principal of Daniel Garcia.
Charney's estate in order to provide for his support, maintenance
and education.
12. It will be necessary to use the sum of One Hundred
Dollars ($100.00) per month from the principal of Daniel Garcia
Charney's estate in order to provide for his support, maintenance
and education.
WHEREFORE, petitioners respectfully request that the Court
issue an order directing and authorizing the expenditure of One
Hundred Dollars ($100.00) per month from the principal of the

consideration of the foregoing petition to 'I'erminate Guardianship
of a Minor'S Estate and to Establish a sequestered Account in the
Minor'S Name, it is herebY ORDERED that the guardianship
established for the estate of Daniel Garcia Charney by a June 12,
1987, Order of the Cumberland County Court of common Pleas, under
Docket No. 3439 -1986 civil, is hereby terminated.
It is further ORDERED that the balance of Daniel Garcia
Charney's estate, after satisfaction of all current obligations, be
deposited in one or more sequestered savings accounts in Daniel
Garcia Charney's name in banks, building and loan associations or
savings and loan associations insured by a Federal governmental
agency.
Peggy Garcia Charney, or the then-acting guardian of
Daniel Garcia Charney's person, may withdraw and expend so much of
the sequestered account(s) as is necessary to satisfy any taxes
incurred by Daniel Garcia Charney's estate. Except as authorized
by further court order, no other wi thdrawals shall. be made from the
sequestered account(s) until Daniel Garcia Charney attains the age
of majority.

PETITION TO TERMINATE GUARDIANSHIP OF A MINOR'S ESTATE
AND TO ESTABLISH A SEQUESTERED ACCOUNT IN THE MINOR'S NAME
AND NOW, come the petitioners, Pennsylvania National Bank and
peggy Garcia Charney, co-guardians of the estate of Daniel Garcia
Charney, a minor, by and through their attorneys, Lowell R. Gates,
P.C., and represent and aver as follows:
1. By virtue of an Order Approving Compromise Settlement
issued by the Cumberland county Court of Common Pleas on June 12,
1987, under Docket No. 3439 -1986 Civil, pennsylvania National Bank
was appointed co-guardian of the estate of Daniel Serafin Garcia,
born August 12, 1983.
2. By virtue of the aforesaid Order Approving Compromise
Settlement, Peggy Garcia, natural mother of Daniel Serafin Garcia,
was appointed co-guardian of the estate of Daniel Serafin Garcia.
Peggy Garcia is now married to David G. Charney and joins in this
petition as peggy Garcia Charney.
3. Daniel Serafin Garcia'S natural father, Serafin Garcia,
II, was killed in an automobile accident on May 30, 1986.
4. Daniel Serafin Garcia has been legally adopted by David
G. Charney and is now known as Daniel Garcia Charney.
5. Daniel Garcia Charney resides with his parents, David G.
Charney and Peggy Garcia Charney.
6. Daniel Garcia Charney is eleven (11) years old, and he
attends public school.
'7. The estate of Daniel Garcia Charney consists of an asset
portfolio administered by pennsylvania National Bank and including
cash, cash equivalents, fixed income and equity investm~nts
totaling $31,990.09 as of May 11, 1994.
B. The income derived from Daniel Garcia Charney's estate
totals approximately $1,BOO.00 per year.
9. pennsylvania National Bank charges $1,000.00 annuallY for
serving as co-guardian of Daniel Garcia Charney's estate.
10. Daniel Garcia Charney's estate pays approximatelY $150.00
annually for federal income taxes.
11. On June 10, 1994, a petition for Allowance of
Expenditures from principal of a Minor's Estate was filed with this
Court under the above docket number, and on June 17, 1994, this
Court issued a preliminary Order setting a hearing for August B,
1994.
12. On August B, 1994, the hearing was continued by Hon.
Harold E. Sheely, P.J.
13. Attached hereto are verification and consent forms
indicating that pennsylvania National Bank and Peggy Garcia Charney
consent to their termination as co-guardians of Daniel Garcia
Charney's estate and to the establishment of a sequestered account
in the name of Daniel Garcia Charney in accordance with 20 pa.C.S.
~5103.
