PETITION OF JOHN A. KYLE AND DAREE S. KYLE.
LEGAL GUARDIANS OF BRITTANIE A. GEORGE. A MINOR. AND
ADMINISTRATORS OF THE ESTATE OF KIMBERLY L. KYLE. DECEASED~
FOR APPOINTMENT OF A GUARDIAN OF THE ESTATE OF BRITTANIE A.
GBORGE. A MINOR. AND APPROVAL AND ALLOCATION OF SETTLEMENT OF
WRONGFUL-QEATH AND SURVIVAL CLAIMS ARISING FROM THE DEATH OF
KIMBERLY L. KYLE. DECEAQED
AND NOW, come JOHN A. KYLE and DAREE S. KYLE, by their
attorneys, Fowler, Addams, Shughart & Rundle, and respectfully
represent:
1. The Petitioners are John A. Kyle and Daree S. Kyle,
adult individuals residing at 246 West Pomfret Street, Carlisle,
Cumberland County, Pennsylvania.
2. The Petitioners are administrators of the Estate of
Kimberly L. Kyle, deceased, Cumberland Cmmty Estate No. 21-93-
0393.
3. The Petitioners ar.e also the maternal grandparents of
the person of Brittanie A. George, a minor, born February 2, 1989
and are her primary physical custodians pursuant to Order of
Court dated May 20, 1993 in Custody Proceedings in the Court of
Common Pleas of Cumberland County docketed to No. 947 civil 1992.
4. The minor lives and resides with her maternal
gr.andparents at the above address and is the sole heir to the
estate of Kimberly L. Kyle, deceased, and sole beneficiary under
the Wrongful Death statute.

5. Your Petitioners, as administrators of the Estate of
Kimberly L. Kyle, deceased, and as guardians of the parson of
Brittania A. George, a minor, present this petition for the
appointment of a guardian of the Estate of Brittanie A. George, a
minor, and for approval of a settlement to recover damages for
the Wrongful Death of Kimberly L. Kyle, deceased, the minor's
natural mother, killed in an automobile accident on May 8, 1993.
6. On May 8, 1993, shortly before 12:30 a.m., the minor's
natural mother, Kimberly L. Kyle, deceased, was traveling alone
North on state Route 34 in South Middleton Township when her
vehiole collided with a southbound vehicle operated by Mary Jane
Cleary. Through no fault of Kimberly L. Kyle, deceased, the
vehicle operated by Mary Jane Clearly swerved into the northbound
lane in which Kimberly L. Kyle w~s traveling, causing a head-on
collision. As a result of the collision, Kimberly L. Kyle and
Mary Jane Cleary were killed, and Rene Bowling, Lori L. Lawson,
and Colleen M. Roseberry, passengers in the vehicle operated by
Mary Jane Cleary, were injured.
7. The liability insurance carrier for Mary Jane Cleary has
offered the Estate of Kimberly L. Kyle and the passengers in the
vehiole operated by Mary Jane Cleary a settlement in the full
amount of its third party limits of liability, $50,000. Counsel
for the various plaintiffs have agreed that $50,000 would be
allooated as follows:

Estate of Kimberly L. Kyle - $22,500
Rene Bowling - $19,375
Colleen M. Roseberry - $4,125
Lori L. Lawson - $4,000
8. The petitioners, with the advice of counsel, Dale F.
Shughart, Jr., are willing to settle and compromise this claim
for the offer of $22,500.
9. The Petitioners propose that the offered settlement
amount of $22,500 be allocated to the Wrongful Death action of
Brittanie A. George, a minor, the sole heir to the Estate of
Kimberly L. Kyle, deceased, and the sole beneficiary under the
Wrong Death Statute.
10. The offered settlement amount of $22,500 represents
monies which Kimberly L. Kyle, deceased, would have contributed
to the upbringing of her daughter, Brittanie A. George, a minor.
The Estate of Mary Jane Cleary is insolvent and will not be able
to compensate Brittanie A. George, a minor, for the wrongful
death of her natural mother, Kimberly L. Kyle, deceased.
11. Although the Estate of Kimberly L. Kyle, deceased, is
insolvent based upon the inheritance tax return filed, your
Petitioners as Administrators of the Estate are holding
nonprobate assets in the sum of approximately $7,000 which
Petitioners wish to distribute to Farmers Trust company as
Guardian of the Estate of Brittanie A. George. petitioners

request authority to remain Guadians of $582 of tangible property
currently being used by Brittanie A. George.
12. Petitioners' undersigned counsel has discussed the
distribution of the Estate with Farmers Trust Company which has
agreed to accept distribution of the remaining balance of
nonprobate assets in the Estate upon informal accounting from
your Petitioners.
13. still unresolved is the claim under Kimb~rly L. Kyle's
uninsured motorist coverage, which is in the amount of $100,000.
The claim has been presented to Kimberly L. Kyle's insurance
company for the full amount of such coverage.
14. The Petitioners propose that Farmers Trust Company, One
West High street, Carlisle, Cumberland County, Pennsylvania, be
appointed guardian of the Estate of Brittanie A. George, a minor.
The consent of the proposed guardian is attached as Exhibit lIA".
15. Your Petitioners believe it would he advantageous to the
minor to accept the offer and that this settlement is in the best
interest of the minor. They request that distribution be made as
follows:
A. To Farmers Trust Company as guardians of
the Estate of Brittanie A. George,
a minor, $22,000.00
B. Fowler, Addams, Shughart & Rundle
attorneys fees - 2,500.00
16. The Petitioners have entered an Agreement with their
attorneys, Fowler, Addams, Shughart & Rundle, whereby the

attorney's foes would be paid at the hourly rate of $100 per hour
for time expended. Petitioners have been!advised that an excess
of forty (40) hours of time have been involved in regard to this
claim to date and that pending a prompt settlement of the
underinsured motorist claimed approximately fifty (50) hours of
attorney time would be involved in resolving these claims. The
undersigned attorneys for your Petitioners have agreed to accept
the sum of $2,500 from this settlement and to sllbmit the balance
of their request for fees with a subsequent Petition for court
approval to be filed on the under insured motorists claims.
17. Your Petitioners, in their capacity as Administrators
of the Estate of Kimberly L. Kyle, deceased, and as Guardians of
their minor granddaughter, Brittanie A. George, have been advised
by counsel and understand that should this settlement be
approved, the minor would not be entitled to any further payments
from the Estate of Mary Jane Cleary. They further understand and
have been advised by counsel that they will be required to
execute a Release totally and fully diSCharging the Estate of
Mary Jane Cleary and its insurance carrier of any obligation to
pay any sums to the minor under the third party insurance
cover.age of said Mary Jane Cleary. Petitioners' attorney has
assured them that their right to proceed for their underinsured
oover.age of Kimberly L. Kyle's first party insurer (which is the
same as the Estate of Mary Jane Cleary's third party insurance

AND NOW, come JOHN A. KYLE and DAREE S. KYLE, by their
attorneys, Fowler, Addams, Shughart & Rundle, and respectfully
represent:
1. The Petitioners are John A. Kyle and Daree S. Kyle,
adult individuals residing at 246 West Pomfret Street, Carlisle,
Cumberland County, Pennsylvania.
2. The Petitioners are administrators of the Estate of
Kimberly L. Kyle, deceased, Cumberland County Estate No. 21-93-
0393.
3. The Petitioners are also the maternal grandparents of
the person of Brittanie A. George, a minor, born February 2, 1989
and are her primary physical custodians pursuant to Order of
Court dated May 20, 1993 in CUAtody Proceedings in the Court of
Common Pleas of Cumberland County docketed to No. 947 civil 1992.
4. The minor lives and resides with her maternal
grandparents at the above address and is the sole heir to the
estate of Kimberly L. Kyle, deceased, and sole beneficiary under
the Wrongful Death Statute.
5. Your Petitioners, as administrators of the Estate of
Kimberly L. Kyle, deceased, and as guardians of the person of
Brittanie A. George, a minor, present this petition for approval
of a settlement to recover damages for the Wrongful Death of
Kimberly L. Kyle, deceased, the minor's natural mother, killed in
an automobile accident on May 8, 1993.
6. On M~y 8, 1993, shortly before 12:30 a.m., the minor's
natural mother, Kimberly L. Kyle, deceased, was traveling alone
North on state Route 34 in South Middleton Township when her
vehicle collided with a southbound vehicle operated by Mary Jane
Cleary. Through no fault of Kimberly L. Kyle, deceased, the
vehicle operated by Mary Jane Clearly swerved into the northbound
lane in which Kimberly L. Kyle was traveling, causing a head-on
cOllision. As a result of the collision, Kimberly L. Kyle and
Mary Jane Cleary were killed, and Rene Bowling, Lori L. Lawson,
and Colleen M. Roseberry, passengers in the vehicle operated by
Mary Jane Cleary, were injured.
7. By Order of Honorable George E. Hoffer entered on
June 27, 1994, the Court approved a settlement between Erie
Insurance Group, the insurance company providing third party
liability insurance for Mary Jane Cleary, Estate of Kimberly L.
Kyle and passengers in the vehi~le operated by Mary Jane Cleary
for the full amount of third party limits of liability, $50,000,
the Estate of Kimberly L. Kyle to receive the sum of $22,500. A
true and correct copy of the Order of June 27, 1994 is attached
hereto, made a part hereof and marked Exhibit "A".
8. The aforesaicl Order of June 27, 1994, Exhibit "A",
allooated the entire recovery to the Wrongful Death action of
Brittanie A. George.
9. The Order of June 27, 1994, Exhibit "A", appointed
Farmers Trust company of Carlisle, Pennsylvania as guardian of
the Estate of Brittanie A. George.
10. Kimberly L. Kyle's insurance company, the Erie
Insurance Group, has offered the full limits of under insured
motorist coverage, the sum of $100,000, in settlement of the
claim.
11. Your Petitioners believe it would be advantageous to
the minor to accept this offer and that this settlement, which
represents the entire amount of insurance available through
Kimberly L. Kyle's under insured motorist coverage, is in the best
interest of the minor. They request that distribution be made as
follows:
A. Farmers Trust Company, Guardians
of the Estate of Brittanie A. George,
a minor
$97,500.00
B. Fowler, Addams, shughart & Rundle,
attorney fees
2,500.00
12. Petitioners have entered an Agreement with their
attorneys, Fowler, Addams, shughart & Rundle, whereby attorney
fees will be paid at the hourly rate of $100 per hour for time
eXpended. Petitioners have been advised that in excess of
50 hours of attorney time have been involved in resolving all
claims arising from the accident. The Order of June 27, 1994,

Exhibit "A" authorized the payment of $2,500 from the settlement
with Mary Jane Cleary's insurer, Petitioners' attorneys having
agreed to request the balance of their fees with the request for
approval of the settlement of the underinsured motorist claim.
13. Your Petitioners, in their capacity as administrators
of the Estate of Kimberly L. Kyle, deceased, and as guardians of
their minor granddaughter, Brittanie A. George, have been advised
by counsel and understand that should this settlement be
approved, the minor would not be entitled to any further payments
from Erie Insurance Company under the under insured motorist
coverage available through Kimberly L. Kyle'S automobile
insurance policy, and that the payment to be received represents
the entire amount of coverage available under said pOlicy. They
further understand and have been advised by counsel that they
will be required to execute a Release fully and totally
disCharging Erie Insurance of any obligation to pay any further
sums to the minor under the first party insurance coverage of
said Kimberly L. Kyle.
14. At the time of her death, Kimberly L. Kyle, was a
permanent employee of Pennsylvania Blue Shield in Camp Hill,
Pennsylvania earning the sum of $8.00 per hour and gross weekly
pay in excess of $300 per week. The prospects for advancement and
inoreases in pay at Capital Blue Shield were excellent.
15. The total amounts offered in settlement, $22,500 from
the insurance company of the Estate of Mary Jane Cleary and
$100,000 from Erie Insurance, Kimberly L. Kyle'S under insured
