ARTICLE III
If, at the time of my death, I am the owner of the real estate
situate in Rye Township, Perry County, Pennsylvania, pursuant to a
Deed dated September 26, 1973 and recorded in Deed Book 232, Page
186, Perry County Recorder of Deeds Office, and if, at the time of
my d~ath, I am survived by EDGAR R. LINGLE and LAURA E. LINGLE, his
wife, or either of them, I grant unto the said EDGAR R. LINGLE and
LAURA E, LINGLE, his wife, or the survivor of the, an option to
purchase said real estate at a price to be determined by an
appraisal of the fair market value of said real estate, as of the
time of my death, by a member of the American Institute of Real
Estate Appraisers, to be selected by my Executor. I direct that
such option must be exercised by written notice thereof, delivered
to my Executor within sixty (60) days following receipt from my
Executor of a copy of the appraisal by the Appraiser. Should EDGAR
R. LINGLE and LAURA E. LINGLE, his wife, or the survivor of them,
fail to exercise such option within tne manner set forth above, or
should they or the survivor of them notify my Executor in writing
of the release of such option prior to its expiration, I give,
devise and bequeath such real estate as a part of my residuary
Estate. If EDGAR R. LINGLE and LAURA E. LINGLE, his wife, or the
survivo~ of them, exercises the option in accordance herewith, I
direct that settlement on the sale of the real estate be concluded
within sixty (60) days of the date of the exercise of said option.
I further direct that such option shall be personal to EDGAR R.
LINGLE and LAURA E. LINGLE, his wife, or the survivor of them, and
that they, or the survivor of them, shall have no right to assign
or convey said option to any third party.
I give, devise and
remainder of my Estate,
