" AGREEMENT RELEASING RESTRICTIONS THIS AGREEMENT, made this _____ day of , 1995, by and between the Estate of Maj-Britt N. Houston, the Borough of Carlisle, Cumberland County, Pennsylvania, hereinafter referred to as "Owner", and Thomas C. Case and Donna J. Case, his wife, of Carlisle, Cumberland County, Pennsylvania, hereinafter referred to as "Case". WITNESSETH I WHEREAS, the said Maj-Britt N. Houston died on June 28, 1994, with Letters Testamentary being issued by the Register of Wills of Cumberland County, Pennsylvania at 1994-00575, on July 7, 1994, appointing Christopher C. Houston, as executor of the Estate of Maj-Britt N. Houston; and WHEREAS, the said Maj-Britt N. Houston was, at the time of her death, the owner of all those certain tracts or parcels of land situate in the Borough of Carlisle, formerly in South Middleton Township, Cumberland County, Pennsylvania, containing approximately 1.6 acres, more or less, being more particularly described in Deed Book G, Volume 27, Page 349, hereinafter referred to as "Owner's Premises"; and WHEREAS, Owner's Premises is comprised of two tracts of land, Tract No. 1 of which is subject to the following restrictions I 1. That the use of the land conveyed shall be restricted to and limited strictly to residential purposes. 2,. That no building shall be erected nearer than 100 feet from the present southern line of the Walnut Bottom Road nor nearer than 25 feet to any of the side lines of said property. 3. That no alley shall be open along the rear line of the lot conveyed; and WHEREAS, Case are the owners of all that certain tract or parcel of land situate in the Borough of Carlisle, known and numbered as 918 Forest Court, CarliSle, Cumberland County, Pennsylvania, with said tract of land being more particularly described in Deed Book Y, Volume 35, Page 371, hereinafter referred to as "Case's Premises"; and WHEREAS, Case's Premises are encumbered with Q number of restrictive covenants which includes, the followingl I 1. That the land adjoining for 100 feet from any point on the lines of the lot herein conveyed shall be restricted and limited strictly to residential purposes/ and WHEREAS, the aforesaid restrictions imposed upon Owner's Premises and Case's Premises were imposed by conveyances out of conunon owners, Elizabeth B. Niesley, Roy H. Wenger, and Albert Adams/ and WHEREAS, with Owner's Premises and Case's Premises being imposed with the aforesaid restrictions out of a conunon owner, it is necessary for Owner to obtain a release from Case to have the following restriction imposed on Owner's Premises voided I That the use of the land conveyed shall be restricted to and limited strictly to residential purposes. and .to have the following restriction imposed on Case's Premises voided as it applies to Owner's Premises I That the land adjoining for 100 feet from any point on the lines of the lot herein conveyed shall be restricted and limited strictly to residential purposes/ and WHEREAS, it is the desire of Owner and Case that the aforesaid restrictions as imposed upon Owner's Premises and the aforesaid restriction as imposed upon Case's Premises as it applies to Owner's Premises be voided. NOW, THEREFORE, in consideration of the sum of ONE and 00/100 DOLLARS ($1.00) to Case in hand paid by Owner and other good and valuable consideration, the parties do agree as follows I 1. RECITALS.
