ITEM ONE I I direot that all my debts and funeral expenses,
inoluding my gravemarker shall be paid from my residuary estate as
soon as practicable after my decease as a part of the expense of
the administration of my estate.
ITEM TWOI I give, devise and bequeath my entire estate as followsl
A. I give, devise and bequeath the sum of FIVE THOUSAND DOLLARS
($5,000.00) to my dear friend, MONICA FREDERICK.
B. I give, devise and bequeath the remainder of my estate,
wherever situate, to my ohildren, CHRISTINA N. HOWARD, CHRISTOPHER
C. HOUSTON, and STEPHEN D. HOUSTON, equally, per stirpes.
ITEM THREEI I appoint my oon, CHRISTOPHER C. HOUSTON, Executor of
this my laet will. Should he fail to qualify or cease to act as
Executor, I appoint my daughter, CHRISTINA N. HOWARD, to act as
Exeoutrix with the oame rights, powers and duties.
ITEM FOURs All eotate, inheritanoe, oucceosion and other taxeo,
imposed or payable by reaoon of my death, and intereet nnd
penalties thereon, with reopect to all property comprising my groos
estate for tax purpooes, whether or not ouch property paoses under
this will, shall be paid out of the prinoipal of my residuary
estate, without apportionment or right of reimbursement.
ITEM FlVEI I direot that my personal representative or guardian
shall not be required to give bond for the faithful performance of
their duties in any jurisdiction.
ITEM SIXI In addition to the right.s and powers given to ths
fiduoiaries by law or elsewhere in thio will, I give to my Executor
during the full time neoeooary and for the administration of my
estate the following rights and powers to be exeroised in his sole
discretion.
A. To retain any r.eal or personal property which mar at any time
form a part of my estate so long ao he or she deems t advisable.
B. To invest in any real or personal property without
restrictions to legal investments.
c. To repair, alter, improve or lease for any period of time any
real or personal property and to give options for leases.
D. To sell at publio or private sale, for oash or credit, with or
without security, to exchange or to partition real or personal
property, and to give options for leases.
E. To make distribution in kind.
F. To compromioe claimo.

A condition of the Agreement of Sale for the
sale of the property was that the Estate
was to finalize agreements releasing a
restriction on the property that the property
oould be used for residential purposes only.
This involved obtaining releases of these
restrictions from 12 different property owners.
One of the property owners, Mr. and Mrs. J.
Keith Hocker, requested payment to them for the
release of the restriction of $200. (see
attached letter to the Hockers)

AGREEMENT RELEASING RESTRICTIONS
THIS AGREEMENT, made this _____ day of , 1995,
by and between the Estate of Maj-Britt N. Houston, the Borough of
Carlisle, Cumberland County, Pennsylvania, hereinafter referred to
as "Owner", and Thomas C. Case and Donna J. Case, his wife, of
Carlisle, Cumberland County, Pennsylvania, hereinafter referred to
as "Case".
WITNESSETH I
WHEREAS, the said Maj-Britt N. Houston died on June 28, 1994, with
Letters Testamentary being issued by the Register of Wills of
Cumberland County, Pennsylvania at 1994-00575, on July 7, 1994,
appointing Christopher C. Houston, as executor of the Estate of
Maj-Britt N. Houston; and
WHEREAS, the said Maj-Britt N. Houston was, at the time of her
death, the owner of all those certain tracts or parcels of land
situate in the Borough of Carlisle, formerly in South Middleton
Township, Cumberland County, Pennsylvania, containing approximately
1.6 acres, more or less, being more particularly described in Deed
Book G, Volume 27, Page 349, hereinafter referred to as "Owner's
Premises"; and
WHEREAS, Owner's Premises is comprised of two tracts of land, Tract
No. 1 of which is subject to the following restrictions I
1. That the use of the land conveyed shall be restricted
to and limited strictly to residential purposes.
2,. That no building shall be erected nearer than 100 feet
from the present southern line of the Walnut Bottom Road
nor nearer than 25 feet to any of the side lines of said
property.
3. That no alley shall be open along the rear line of the
lot conveyed; and
WHEREAS, Case are the owners of all that certain tract or parcel of
land situate in the Borough of Carlisle, known and numbered as 918
Forest Court, CarliSle, Cumberland County, Pennsylvania, with said
tract of land being more particularly described in Deed Book Y,
Volume 35, Page 371, hereinafter referred to as "Case's Premises";
and
WHEREAS, Case's Premises are encumbered with Q number of
restrictive covenants which includes, the followingl

1. That 'the use of the land herein conveyed is restricted
and limited str.ictly to residential purposes/and
2. That the land adjoining for 100 feet from any point on
the lines of the lot herein conveyed shall be restricted
and limited strictly to residential purposes/ and
WHEREAS, the aforesaid restrictions imposed upon Owner's Premises
and Case's Premises were imposed by conveyances out of conunon
owners, Elizabeth B. Niesley, Roy H. Wenger, and Albert Adams/ and
WHEREAS, with Owner's Premises and Case's Premises being imposed
with the aforesaid restrictions out of a conunon owner, it is
necessary for Owner to obtain a release from Case to have the
following restriction imposed on Owner's Premises voided I
That the use of the land conveyed shall be restricted to and
limited strictly to residential purposes.
and .to have the following restriction imposed on Case's Premises
voided as it applies to Owner's Premises I
That the land adjoining for 100 feet from any point on
the lines of the lot herein conveyed shall be restricted
and limited strictly to residential purposes/ and
WHEREAS, it is the desire of Owner and Case that the aforesaid
restrictions as imposed upon Owner's Premises and the aforesaid
restriction as imposed upon Case's Premises as it applies to
Owner's Premises be voided.
NOW, THEREFORE, in consideration of the sum of ONE and 00/100
DOLLARS ($1.00) to Case in hand paid by Owner and other good and
valuable consideration, the parties do agree as follows I
1. RECITALS. The recitals as set forth above are incorporated
herein by their entirety.
2. RELEASE. The parties agree that the restriction imposed upon

enumerated commercial purposes, as set forth in Paragraph 2 above,
that prior to the commencement of the use of the Owner's premises
for the aforesaid commercial purposes, that Owner or Owner's
successors and assigns shall construct, at its cost and expense, a
six foot. tall wood stockade-style fence on the boundary line

Under current Pennsylvania law a 900 gallon septic tank must be used for
a home with three bedrooms or f~er. If 6 people reside in a 3-bedroom house,
the tank should be pumped every 1.3 years. If the aame system serves a family
of 2, the tank would be ready for pumping every 5.2 years. Systems installed
before the current rules and regulations may have septic tanks 911laller than

often than once a year..
It is important to note that the soil absorption fielrl will not fall
iml1l8diately when a full tank is not pumped. However, the septic tank is no
longer protacting the soil absorption field from solids. Continued neglect
may result in failure and the so11 absorption field may need to be replaced.
In soma casas, replaceMent of the abaorption area may not be pOSSible due to
site limitations.

Septic tank pump and haul contractors can dun your tank. It is a good
idea to supervise cleaning to ensure that it Is done properly. To extract all
the material from the tank, the scum layer nlIst be broken up and the sludge
layer stirred up into the liquid IlOrtion of the tank. This 11 usually done by
alternately aiphoning Uquirl from the tank and reinjecting it into. the bottom
of the tank. The laptic tank should be pumped out through the large central

FAMILY SETTLEMENT AGREEMENT
THIS STATEMENT, made this 28th day of February, 1996, by
Christopher c. Houston, Stephen D. 1I0uston, and Christina H. Howard
(hereinafter referred to as "the Benef.ioiaries") and Christopher C.
Houston, Executor (hereinafter referred to as "the Executor").

WHEREAS, Maj-Britt N. Houston, of Carlisle, Cumberland County,
Pennsylvania, died on June 28, 1994; and
WHEREAS, on July 7, 1994 Letters Testamentary were granted to the
Exscutor at File No. 1994-00575 in the Register of Wills Offioe for
Cumberland County, Pennsylvania; and
WHEREAS, the said Executor has administered the Estate of Maj-Britt
N. Houston, up until the present time and h&s paid all debts of the
estate, including Inheritance Tax owed; and
WHEREAS, the Estate of Maj-Britt N. Houston has been in receipt of

previously made to them and the distributions as outlined in this
Agreement are "at risk" distributions pursuant to 20 P.S. 3532.
The eaid Beneficiaries hereby release the Executor with respect to
acts or omissions in the administration and distribution of the
estate and hereby agree(s) to return such funds as were distributed
under the administration of the estate as may be required for the
payment of any proper claims not discharged prior to this
distribution.
7. The said Beneficiaries designate this statement as a
"satisfaction of award"and hereby authorize and direct the Clerk
of Orphans' Court to make satisfied of record any award which may
subsequently be made by the Court with respect to the distribution
made to the distributees in this Agreement.
8. The said Beneficiaries aoknowledge that this Family Settlement
Statement shall be filed with the Clerk of Orphans' Court in final
