I, EDITH M. SCHWARTZ, presently of Cumberland Coun-
ty, Commonwealth of Pennsylvania, being of sound mind and
disposing memory, realizing the uncertainty of t.his life, do

not be considered appropriate for a fiduciary apart

B. To sell, exohange, give options upon, partition
or otherwise dispose of any property which Executor
may hold from time to time, at public or private
sale or otherwise, for cash or other consideration
or on credit, and upon such terms and such considera-
tions as Exvcutor shall see fit.
C. To invest and reinvest the trust estate from
time to time in any property, real or personal,
including securities of domestic and foreign corpora-
tions and investment trusts, bonds, preferred
stocks, common stocks (whether fiduciary or non-fidu-
ciary), mortgages, mortgage participations, even
though such investment (by reason of its character,
amount, proportion to the total trust estate, or
otherwise) would not be considered approprLate for a
fiduciary apart from this provision.
D. In dividing int.o separate trusts or shares or in
distributing same, to divide or distribute in cash,
in kind or partly in cash and partly in kind, as
Executor thinks fit. For purposes of division or
distribution, to valus the estate and any part there-
of, reasonably and in good faith, and such valuation
ahall be conclusive upon all parties. To whatever
extent division or distribution is made in kind, my
Executor shall, so far as Executor finds practica-
ble, allocate to the respective beneficiaries approx-
imately proportionate amounts of each kind of securi-
ty or other property in the estate.

I, EDITH M. SCHWARTZ I presently of Cumberland Coun-
ty, . Commonwealth of Pennsylvania, being of sound mind and
disposing memory, realizing the uncertainty of this life, do
hereby make, publish and declare this to be my Codicil amenq-
ing my Last Will and Testament dated January 17, 1989, as
followsl

I hereby amend paragraph IV of my said Last Will and
Testament as fo11owsl
I give and bequeath the sum of $25,000.00 to my son,
PAUL M. SCHWARTZ, JR., and the sum of $25,000.00 to my daugh-
ter, JOAN L. COSTELLO, in consideration of their kind help and
assistance in the management of the Cradle 'N 'l'ot Shoppe. I
further give and bequeath any interest that I Inay hold in the
business Cradle 'N Tot Shoppe, including all related assets,
to my son, PAUL M. SCHWARTZ, JR., and my daughter, JOAN L.
COSTELLO, in equal shares, share and share alike.

I hereby delete Paragraph VI of my said Last Will

At the time of the decedent's death, she was the sole
proprietor of a business known as the Cradle N' Tot Shoppe
which is located in the Codar Cliff Mall, Camp Hill,
pennsylvania. We have requested a valuation of the sole
propr etorship by the business's accountant, John
Perazzelli,. C.P,A. We have advised the accountant of the
supplemental information which is required by Revenue to
value the business. We have received part of the required
material from the accountant, but not all documentation in
order to file the return by the filing deadline.
A5 legal counsel for the estate, I am formally
requesting a grant of an extension of the filing of the
pennsylvania Inheritance Tax Return for the Estate of Edith
M. Schwartz. It is my understanding that the extension
request and grant must be made before the return is due.
Please advise me of your decision regarding the grant of
extension as soon as possible.
We have estimated the net value of the estate to be
$358,000.00. All beneficiaries are six (6%) percent
beneficiaries. Total tax on the estimated value of the

Dollars ($25,000.00) to my son, Paul M. Schwartz, Jr., and the
sum of Twent~-five Thou~and Dollars ($25,000.00) to my daugh-
ter, Joan L. Costello, in consideration of their kind help and
assistance in the management of the Cradle'N Tot Shoppe.

I bequeath and devise all the rest, residue and
remainder of my estate, real and personal and mixed, including
any property over which I may have any power of appointment in
three equal shares, one such share unto my son, Paul M.
Sohwartz, Jr. or his issue if he has predeceased me; one such
share unto my daughter, Joan L. Costello, or her issue if she
has predeceased mel and one such share to be divided equally

value as determined by an appraisal conducted by a qualified
appraiser, member of the American Institute of Real Estate
Appraisers or any successor organization who is regularly
conducting his business as an appraiser in the Harri,sburg
Mett'opoli tan Area. Said fair market value is to be determined
as of the d~te of my death. My said son shall be required to
elect to exercise this right of purchase within a period of
ninety (90) days after the date of my ~eath or else said power
shall he withdrawn and of no further force and effect.
VII.
,No principal or income payable or to become payable
under this Will or under any Trust created by this Will shall
be subject to anticipation or assignment by any beneficiary
thereof or to attachment by or to the interference or control
of any creditor of any such beneficiary, or be taken or
reached by any legal or equitable process in satisfaction of
any debt or liability of such beneficiary prior to its actual
receipt by the beneficiary.

I direct that all estate, inheritance and succeAsion
taxes, and interest and penal ties thereon, which llIay be due

This is in response to y -'ur request fC'r an extension to ~ile
the Inheritance Tax Return for the above-referenced estate.
In accordance with Section 2136(d) of the Inheritance and
Estate Tex Act 255 of 1982, thl' time for filing the return ie exteuded
for an additional period of six (6) months. Thia extension will avoid
ths imposition of a penalty for failure to make a timely return.
However, it do~s not prevent interest from accruing on any tax
remaining unpaid after the delinquent date.
The return must be filed with the Register of Willa on or
before September 18, 1995. Because Sention 2136(d) of the 198? Act
allows for only one extra period cf six (6) months, no additional
extension(s) will be granted that would exceed the maximum time
permitted.
