mind and memory, do hereby make, publisb And declare this to be
my Last Will and 'l'eotament, hereby revoking all former Wills and
Codicils heretofore by me made.
FIRST:
I direct that All my just debts, funeral
expenseD and adminiotration expenseH be paid no soon as practi-
cable after my death.
SECOlWI
If my wife, Gorda ROSB, shall survive me,
I give, devise and bequeath all of my property and estate, both
real and personal, of whatsoever kind Rnd wheresoever situate,
of which I shall die seized or possessod or of which I shall be
entitled to dispose at the tim9 of my death to my said wife,
Gerda Ross.
TIllRD I
In the event that my naid wife, Gerda ~oss,
shall predeceaue me or she and I shall die under such circumstan-
ees that there is innufficient evidence to determine the question
of survivorship between us, then I give, devise and bequeath all
of my property and estate, of whatsoever kind and wheresoever
situate, to my issue, in equal shares, per stirpes and not per
capital provided, however, that if any child of mine then surviv-
ing me shall not have attained the oge of twenty-one (21) years
at the time of my death, I give, devise ond bequeath the share
of such child to the trustee hereinafter named, IN TRUST NI\VER-

dispose of the net income and principal therefrom as follows:
So long as sueh child shall he under the ngo of twenty-one (21)
yonrs, to collect the not incume therufrom and to payor apply so
much of the net income therefrum nnd such purtion uf the principa
as the trustue in her sule discretion shall from time tu time
deem advisable and proper for the support, education, maintenance
and general welfnre uf such child, with consideratiun to the needs
and assets of buch income beneficinry, nnd I direct the trustee
to accumulate any net incume not so pnid or app1i.ed and add it to
principal periodically, at least annunlly, and if and when such
child shall attain the nge of twenty-one (21) years, to transfer,
pay uver or deliver to him or her the principal, but if such
child shall die before attaining such age, then upon his or her
death, to transfer, pay uver or distribute tho principal with
accumulated income to and among the then living issue of such
beneficiary in equal shares, and in default of such issue, then
to and among my then living issue, in equal shares, per stirpes
and not per capita.
FOURTH:
In the event that neither my wife, Gerda
RODo, nor any inDue uf mine shall survive me, or they and I shall
die under such circumstances that there is insufficient evidence
to determine the question of survivorship among us, then I give,
devise and bequeath my property and estate to my parents, Lucille
Ross and Wesley Ross, or the survivor of them. If neither of my
said parents shall survive me, then I give, devise and bequeath
my property and estate as followa:

I confer upon my executor and the trustee
with respe~t to the management and administration of any property

conferred by Section 11-1.1 of the Estates, Powers and Trusts Law
or comparable statute of the State of New York in effect at my

reason, any property whether or not owned by me at the time of
my death without court order, and I exonerate my executor and
trustee from any liability therefor.

others to the extent permitted by law and to pay them for servic s

In the eVent that my said wife, Gerda Ross,
predeceases me or becomes an adjudicated incompetent or dies
under such circumstances that there l.s l.nsufficient evl.dence to
determine the question of survivorship betlveen us while I'/C are
residing or visiting in the United States, then I nominate, con-
stitute and appoint my sister and her husband, Nancy Haggard and
Eugene Haggard. as guardians of the person of my children who are
under the age of eighteen (18) years at the time of my death, to
serve as such without bond.
In the event that such death or ineompetenc
shall occur while we are residing or visiting outside the United
States, I nominate, constitute and appoint Willi Oberseider and
Anneli(,se Oberseid()r of Ansbaeh, !vest Germany, as guardians of th
person of my children who arc under the age of eighteen (18) year,

FAMILY SETTLEMENT STATEMENT
THIS STATEMENT, made this 16 f-\ day of March, 1995, by Gerda Ross.
WITNESSETH I
WHEREAS, Ronald W. Ross, of Carlisle, Cumberland County,
Pennsylvania, died on May 31, 1994/ and
WHEREAS, on July 19, 1994, Letters Testamentary were granted to
Gerda Ross at File No. 1994-00623 in the Register of Wills Office
for Cumberland County/ and
WHEREAS, the said Gerda Ross has administered the Eotate of Ronald
W. Ross up until the present time and has paid all debts of the
estate inclUding inheritance tax owed/ and
WHEREAS, the Estate of Ronald W. Ross has paid the following debts
