PETITION FOR APPOINTMENT OF AN
EMERGENCY GUARDIAN
1. Petitioner is Samuel Bodine an adult individual residing
at Cold Springs, Apt. T-77, Manchester, Pennsylvania 17345,
2. Respondent is Julia Bodine an adult individual residing
at 1100 Crains Gap Road, Carlisle, Pennsylvania 17013,
3, Mrs. Bodine is a 67 year old women who has a history of
major depression, Mrs, Bodine was hospitalized at Harrisburg State
Hospital under the care of a psychiatrist, Dr, Mira in 1986.
Subsequent to that time she has had minor depressive episodes and
more recently has apparently been suffering from a major depre8sive
episode, As a result of this condition, Mro, Bodine is unable to
manage her affai~o or even make the rudimentary decisions in
reference to her current care ao well as pl.ans for the future,
4, Mrs, Bodine .1S a widow, having three children, Samuel
Bodine is the child of a second marriage to Richard W, Bodine, a
deceased individual, Mrs. Bodine had a prior marriage and has a
daughter named Harriet Carlisle Holeman-Scott residing at 1239
Clipper Road, North Myrtle Beach, South Carolina 29582 and Dickie
Holeman, U.C.P. Group Home, 2nd Street, Snow Hill, North Carolina
28580.
5, Mrs, Bodine has been a resident in the Carliale area for
a period in excess of 25 years and has resided continuously at the
Crains Gap address. Since Mr. Bodine's death some 16 years ago,
Mrs. Bodine has capably managed her affairs. Mre. Bodine has
income from a state police pension, a public school employees
retirement, social security as well as dividend and interest income
from CO's and stocks. Mrs. Bodine works part-time in the food
s~rvice for the Carlisle School District. Mrs. Bodine had income
in 1993 of approximately $13,500,00.
6. Mrs. Bodine hae assets which consist of the home located
on Crains Gap Road with a value in excess of $100,000.00, American
brands stock worth in excess of $16,000,00, Pepsico stock worth in
excess of $55,000.00, Delaware fund worth $2,000,00, CD I S worth
$11,800.00, a savings account with approximately $2,600,00 in it ae
well as a checking account,
7. Mra, Bodine had been able to pay for major purchases
within a short time of making same, In 1990 she bought a Ford
vehicle costing $6,286.00 and paid that off on February 8, 1991.
In May of 1992 she purchased a Lowrey organ costing $4,195.00 and
financed that for 60 months but in fact paid off the amount in full
on August of 1992, In 1991, Mrs. Bodine's well had to be replaced
on October of 1991 costing in excess of $1,200.00 and that bill was
paid in full.
8. Because of Mrs. Bodine's condition, she misapprehended
her financial circumstances and came to believe that she was unable
to maintain herself and pay her monthly expenses. Certaln members
of the family misinformed her and made her believe that after
paying all necessary expenses that she only had $40,00 of

disposable income at the end of a month. Certain members of the
family made her believe that repairs to her home would cost in
excess of $30,000.00,
9, Petitioner believes that Mrs. Bodine is in need of in-
patient psychiatric care due to her fragile condition. Certain
members of the family have told Mrs, Bodine that she cannot afford
the cost of hOIDpital care and that if she goes to a hospital for
care her home will have to be sold at a sheriff's Dale.
10. Mrs, Bodine's daughter, Mrs. Carlisle Holeman-Scott
talked her mother into giving her a power-of-attorney to manage her
affairs. Mrs, Bodine signed the power-of-attorney on Wednesday,
June 15th, On that same day, Mrs. Bodine and Mrs. Scott were
observed in the Farmers Trust liquidating certain assets of Mrs.
Bodine. On Friday, June 17th, Mrs, Scott took her mother to South
Carolina, allegedly for a visit, however, Petitioner believes that
it is Mrs. Scott's intent to liquidate Mrs, Bodine's assets, take
control of the same and keep her mother in South Carolina,
11, Mrs. Bodine because of her condition needs a period of
time with treatment to recover so that she can make an assessment
on her own of her desire to leave the Carlisle area, to sell her
home as well as make other decioion affecting her future,
12, Petitioner reque~to that an emergency guardian be
appointed so as to void the power-of -at torney, Mrs. Scott has
indicated that she wants to have all of Mrs, Bodine's real and
personal property in the Commonwealth of Pennsylvania liquidated
before the end of August.
13. Petitioner suggest that one of the following persons be
appointed as temporary guardians of Mrs. Bodine's estate. The
following individuals are disinterested and Petitioner believes
will work to effectuate the best interest of Mrs. Bodine until such
time as her health recovers so that she is able to make decisions
on her own. The following persons are Mr, Robert Roberts, Mr, Gene
Purcell or Mr. Bill Sweet, All are retired Pennsylvania State
Policemen and know Mrs. Bodine,
WHEREFORE, Petitioner respectfully requests that the court set
a hearing on this request for an emergency appointment;
b. To appoint one of the aforementioned persons or some
other disinterested person as temporary guardian of Mrs, Bodine's
estate;
c. To make an investigation tiS to Mrs, Bodine's freedom and
understanding of her grant of a power-of-attorney;
d. To file a petition for a full guardianship proceeding
should Mrs. Bodine's condition remain unchanged at the expiration

duughter to he her attol'l1ey-in-facl. It is denied that Respond~nt was "talked into" cxecuting a
power of uttorney. In fuct, Respondent helieves thntthe exccution of the power of uttol'l1ey is
another demonstration of hcr ahility to manager her affairs and muke competent and responsihle
d~cisions concerning her futlll'e. It is spccificully denied thut Respondcnt und her duughter
liquiduted ussets of Respondelli on Junc 17, 1994 or on uny other dny. In fact, Respondentund
her daughter went to the hank on that day to umend the signature card for her hunk nccountto be
consistent with the executed power of attorney. Petitioner has completely misunderstood these
uctions und the intentions of Respondent und her duughter.
II. Denied. Respondent hus und continues to make all decisions necessury for her cure und
future needs.

fact, her uctions demonstfllte thut no such intention exists. No need exists for the voiding of a
