Raymond J. Maokey, Jr. and Maralynn E. Maokey, as Administrators
of the Estate of Toby W. Maokey, by and through their attorneys
Manoke, Wagner, Hershey & TUlly, who respectfully represent:
1. Petitioners are adult individuals residing at 123
Opossum Road, Carlisle, Cumberland County, Pennsylvania, and were
the parents and natural guardians of Toby W. Mackey.
2. As a result of a motor vehiole accident on June 19,
1994, Toby W. Mackey was killed as a result of the negligence of
Ranoe G. Myers.
3. As a result of said aooident and as a result of
negotiations with the various insurance companies involved, The
Celina Group as insurance oarrier of Rance G. Myers has offered
polioy limits of $15,000 as evidenced by the release attached
hereto as Exhibit "A".
4. Further, as a result of an insuranoe polioy for
under insured motorist coverage, Allstate Insurance has offered
the polioy limits of $125,000 as evidenoed by the Under insured
Motorist Release attaohed hereto as Exhibit "B".
5. On July 26, 1994, Letters of Administration were
granted to Raymond J. Maokey, Jr. and Maralynn E. Maokey as
evidenoed by Exhibit "C" which is attached hereto and made a part
hereof.
6. The name and address and relationship of eaoh person
potentially entitled to share in the damages are as follows:

7. Your petitioners desi~e the gross settlement of
$140,000 to be allocated as $126,000 as wrongful death damages
and $14,000 to decedent's estate as survival damages.
8. The Department of Revenue, through Vickie Trimmer, has
oonourred in the allocation set forth in paragraph seven of this
Petition.
9. There are no outstanding claims against the Estate of
Toby W. Mackey.
10. The undersigned to the action believes that the
~roposed allocation is fair and reasonable.
11. As a result of a contingenoy fee agreement reached and
agreed upon by the petitioners and the law firm of Manoke,
