use, generation, manulacture, storage, lreatment, disposal, release or threatened release 01 any hazardous waste or substance by any person On,
under, about or tram the Property; (b) Granlor has no knowledge of, or reaSOn to believe thai there has been, except as preVIOusly disclosed 10
and acknowledged by lender In wriling, (i) any use, generalion, manufacture, storage, Ireatment, disposal, release, or threalened release of any
hazardous wasle or subslance on, under, about or 'rom the Property by any prior owners or occupants or the Property or (II) any actual or
lhreatened litigation or claims of any kind by any person relaling to such malters; and (c) Excepl as previously disclosed 10 and acknowledged by
lender in writing, (l) neither Granlor nor any tenanl, conlractor, agent or other authorized user of the Property shall use, generate, manufacture,
store, treal, dispose of, or release any hazardous waste or substance on, under, aboul or from the Property and (il) any such actIVIly shall be
conducted In complIance wllh all applicable lederal, slate, and local laws, regula lions and ordinances, Including Without limitatIOn those laws,
regula lions, and ordinances described above, Grantor aulhonzBs lender and lis agenls to enter upon Ihe Property to make such inspechons and
lesls, at Grantor's expense, as lender may deem appropriate 10 determine compliance 01 the Property wilh this section of Ihe Mortgage. Any
Inspections or lasts made by Lender shall be tor lender's purposes only and shall not be construed 10 creale any responsibility or Iiabilily on Ihe
part or lender 10 Granlor or to any other person. The representalions and warranties conlained heroin are based On Grantor's due diligence In

indemnify and hold harmless Lender againsl any and aU claims, losses, Iiabihlies, damages, penalties, and expenses which lender may direclly or
indirectly suslaln or suffer resulling Irom a breach or this seclion of the Mortgage or as a consequence of any use, generation, manufacture,
slorage, disposal, release or threatened release occurring prior 10 Grantor's ownership or Interest in the Property, whether or not the same was or
should have been known 10 Grantor. The provisIons 0' this section of the Morlgage, including the obligation to indemnify, shall survive the

cOInsurance clause, and WIth a standard mortgagee clause in favor of Lender, Policies shall be wrillen by such Insurance companies and In suCh

proceeds from the insurance become payable on loss, the provisions in Ihis Mortgage lor dIVIsion of proceeds shall apply only 10 thaI porllon of
