COMPLAINT
AND NOW, comes Financial Trusl Company, through ils allomey, William A. Duncan,
Esquire, and tiles this Complaint in Mortgage Foreclosure, of which the following is a
statement:
I. PlainlifT is Financial Trusl Company, a corporal ion organized and exisling under Ihe
laws of the Commonwealth of Pennsylvania with ils main office and principal place of business
localed all West High Slreel, Carlisle, Cumberland Counly, Pennsylvania 17013.
2. Defendanl, JOHN KAZOR, JR., an adull individual, and Defendanl, BONNI T.
KAZOR, an adull individual, are husband and wife, and reside at 527 Garland Drive, Carlisle,
Cumberland County, Pennsylvania
3. On or aboul August 24,1993, Defendanls made, execuled and delivered 10 PlainlifTa
nole and a real estale mortgage financing ONE HUNDRED FOUR THOUSAND and 00/100
Dollars ($104,000.00), a copy of said note and said real eslale mortgage being allached hereto
as Exhibils "A" and "B", respeclively, and are incorporated herein by reference as though fully
sel forth.
4. Said nole and said real est ale mortgage have not been assigned.
5. John Kazor, Jr., and Bonni T. Kazor are the sole record owners in fee simple of said
premises subject to said mortgage, by virtue of a Deed daled and recorded June 26, 1972, in
the Cumberland Counly Recorder's Office in Deed Book "R", Volume 24, Page 525, more
specifically set forth in Exhibit "C", atlached hereto and made a part hereofby reference.
6. Said note and said real eslale mortgage are in default because Defendsnls herein have
failed to pay the payments that were due and owing for the months of OClober 1996,
November 1996, and December 1996.
7. The PlsintifThas given to the Defendants written nOlice of intention to foreclose on
said mortgage as required by law under Act 6, daled Oclober 3 ], ] 996, a copy of which is
marked Exhibits "D" and "E", and attached hereto and made a part hereof by reference.
8. The PlainlifThas given written notice of default as required by the Homeowner's
Emergency Assistance Act of 1983, dated October 31, ]996, a copy of which is marked
Exhibits "F" and "G", and attached herelo and made a part hereof by reference.
9. By reason oflhe aforesaid default, Ihe enlire principal balance of ONE HUNDRED
SIX THOUSAND ONE HUNDRED TWELVE and \8/\ 00 ($106, I ] 2.] 8) Dollars, wilh
inlerest thereon at the rale of 8.96 % per annum compuled from November 15, ] 996, with lale
charges and attorney's fees are now due and payable.
10. The Defendanls are liable to the PlaintifTfor the following on said mortgage loan:
