ADELE WARD FIDELER
I, ADELE NARD FIDELER, of 3610 Logan Street, Camp lIill,
Cumberland County, Pennsylvania, do hereby make this my Last Will
and Testament, revoking any former IHlls and Codicils made by me.
FIRST: I direct that all my just debts and funeral expenses
be paid as soon as may be possible in the due course of adminis-
tration.
SECOND: I give and bequeath all tangible personal property,
(excluding, naturally, from said property so described cash, bank
accounts, stocks, bonds, evidence of indebtedness, etc.) owned by
me at the time of my death to my sons, Richard W. Fideler,
Mechanicsburg, Pennsylvania, and Paul R. Fideler, Maynard,
Massachusetts, share and share alike. I dir.ect that my Executors
in their sole discretion shall distribute all or any part of such
property in equal shares or shall sell the same and by distribu-
tion of cash in lieu of personalty make the distribution equal
among those entitle to take.
In the event that there shall be items of personalty which
shall be desired by more than one of my sons or those entitled to
take through a deceased son, I direct that the choice shall be
made alternately item by item, by rotation of choice on the basis
of age, with the elder son to have first choice. Should a son
not survive me, his spouse (or his issue) shall be entitled to
his share.

THIRD: I give the rest and remainder of my estate, real,
personal and mixed, to my sons, Richard W. Fideler ann Paul R.
Fideler, share and share alike.
Should my son, Richard W. Fideler, predecease me, his share
shall be divided as follows: one-third (l/3) to his wife,
Elisabeth, if living, and the balance to his issue, per stirpes,
subject to the trust protections set forth hereinafter. In
default of such issue, said two-thirds (2/3) of my son's share
(or, if Elisabeth does not survive me, the totality) shall go to
my son, Paul R. Fideler, if living, or to his issue, or in
default of said issue, to my sister, Mary O'Keeffe, and my
sister, Florence McCue, in equal shares, or to the survivor
thereof.
Should my son, Paul R. Fideler, predecease me, his share
shall be divided as follows: one-third (l/3) to his wife, Karen,
if living, and the balance to his issue, per stirpes, subject to
the trust protections set forth hereinafter. In default of such
issue, said two-thirds (2/3) of my son's share (or, if Karen does
not survive me, the totality) shall go to my son, Richard W.
Fideler, if living, or to his issue, or in default of said issue,
to my sister, Mar~ O'Keeffe, and my sister, Florence McCue, in
equal shares, or to the survivor thereof.
FOURTH: I name as my Co-Executors my sons, Richard W.
Fideler and Paul R. Fideler. Should either be unable or unwill-
ing to serve, the other shall serve alone. Should both be unable
or unwilling to serve, I name as my Executrix Elisabeth Fideler.
FIFTH: I direct that no bond or bonds shall be required of
any Executor, Co-Executor, Executrix, Trustee or Co-Trustee named

in this Will for the faithful performance of his or her duties in
any jurisdiction whatsoever.
SIXTH: I direct that all estate, transfer, succession,
inheritance, legacy and similar death taxes, including interest
and penalties thereon, if any, upon or with respect to any
property required to be included in my gross estate under the
provisions of any tax law, and whether passing hereunder or under
any codicil hereto or otherwioe, or upon or with respect to any
person with respect to the transmission of any such property,
shall be paid without proration from my residuary estate.
SEVENTH: Should any issue of Richard W. Fideler be a
beneficiary under Item THIRD, and be less than twenty-five (25)
years of age, I name as Co-Trustees for said beneficiary my
daughter-in-law Elisabeth and my son, Paul R. Fideler, and should
any issue of Paul R. Fideler be a beneficiary under Item THIRD,
and be less than twenty-five (25) years of age, I name as Co-
Trustees for said beneficiary my daughter-in-law Karen and my
son, Richard W. Fideler. I authorize and empower my Trustees at
any time to designate a third Trustee. If the parent named
herein as Trustee shall fail to qualify or shall cease to act as
Trustee, I authorize and empower the remaining Trustee to desig-
nate a successor Trustee. If the non-parent named herein as
Trustee shall fail to qualify or shall cease to act as Trustee, I
authorize and empower Keefer, Nood, Allen & Rahal, or its succes-
sor, to designate an individual as successor Trustee.
In addition to such powers as they may have by law, I fully
authorize and empower the Trustees with respect to any and all
property held in trust hereunder during minority, which I define
as as an individual less than twenty-one 12l) years of age, to

hold, manage, invest and reinvest property vested in a minor,
whether as principal or income, and to majority and final dis-
tribution thereof, in their sole discretion and without applying
to any court for permission to do so.
EIGHTH: If any beneficiary under Item THIRD is under
twenty-five (25) years of age, I direct that his or her interest
be held in trust by the Co-Trustees hereinabove designated until
such beneficiary reaches twenty-five (25) years of age.
My Co-Trustees shall apply such amounts of income and
principal as they, in their sole discretion, deem proper for the
support, education and welfare of such beneficiary, and may
accumulate any unexpended balance of income to the extent permit-
ted by law. I direct my Co-Trustees to consider invasion of the
corpus not only for health and educational purposes, but also for
such amenities as travel, automobiles, and training in athletic
or cultural activities. Such amounts may be applied directly or
may be paid to the beneficiary or to the person with whom such
beneficiary resides or to the person who has the care and control
of such beneficiary, and the receipt of such person shall be a
complete release of my Co-Trustees.
Should a beneficiary die prior to reaching the age of
twenty-five (25) years leaving issue, his interest shall be
allocated among said issue by my Co-Trustees and held in trust
for said issue, subject to the same trust provisions of this
will.
The interest of a beneficiary who dies at any age prior to
reaching the age of twenty-five (25) years leaving no issue,
shall remain in the trust to the benefit of the surviving benefi-
ciaries.

NINTH: I give to any Executor, Executrix or Executors and
to any Trustee or Trustees named in this Will or any Codicil
hereto all of the powers now applicable by law to fiduciaries in
the Commonwealth of Pennsylvania and in particular, through the
Probate, Estates and Fiduciaries Code, as effective and as in
effect on the date hereof, during the administration and until
the completion of the distribution of my estate, and until the
termination of all trusts created hereunder and until the com-
pletion of the distribution of the assets of such trusts.

Encloses is a petition for probate and grant of letters for the Estate of Adele Ward
Fideler. Paul R. Fideler was named co-executor with Richard W. Fideler, who's petition
was previously filed with your office.
Paul Fideler is a resident of Massachusetts. It is our understanding that we would
be able to qualify him as a co-executor of this estate by forwarding the enclosed petition
to him with the oath of personal representative being completed by the appropriate officer
for the probate court in the county in which Mr. Fidcler resides. As wlll you note, the
oath of personal representative has been completed by (he First Assistant Register of the
probate court of Middlesex County, Massachusetts.
