shc had thirty (30) days 10 filc an appcal from Ihe dale of Ihe judgment. Furthcnnorc Petitioncr was
aware on Ihat datc of Ihe decision as it was givcn by Ihe judge from thc beneb.
3. Dcfcndant being out of lown for two weeks following the datc of thc hcaring is irrelcvant
in as mucb as sufficicnt timc cxislcd belween December 12, 1996 and Dcccmbcr 26, 1996 for hcr
to file an appcal.
4. It is submillcd Ibat numcrous courl documents were filcd bctwcen Ihc limc pcriod of
Decembcr 12,1996 and Dcccmbcr 26,1996 by many individuals, all of who, morc likely than not,
"wcrc busy gelling rcady for thc holidays" <IS well.
5. II is furthcr submilled thai DefendarU's belief that holidays werc not included in Ihe Ihirty
(30) days is irrelcvant as the Ihirty (30) day expiration was on December 26, 1996 which is not a
holiday. and ignorance of Ihc law is nol a valid cxeuse.
