Plaintiff's by their attorney, Diane G. Radcliff, Esquire and
file this Complaint against the above referenced Defendants,
whereof the fOllowing is a statement:
1. The Plaintiffs are Klare S. Sunderland and Lea R,
Sunderland, adult individuals residing at 7 Deerburn Court,
MechaniC8:~,::rg, PA.
2. '~'h8 DQfcI,dants are Jay R. King and Mark A, King,
adult individuals trading and doing business as King's
Landscaping and having a business address of 1651 Baltimore
Pike, Hanover, York County Pa. 17331.
3. At all times herein relevant, Plaintiffs were and
have continued to be the owners of a certain tract of real
estate known as Lot 102, The Peninsula Subdivision, 7

Deerburn Court, Mechanicsburg, PA" hereafter referred to as
the "Sunderland Residence."
4. ~t all times herein relevant the Defendants have
been in d1'~ landscaping business offer ing and supplying
landscapi~~ services and products to members of the general
public,
5. Ac all times herein relevant the Plaintiffs were
dealing with the Defendants by and through the Plaintiffs'
contractor and agent, Heritage Builders, of 6968 Birchwood
Road, Harrisburg, Pa. 17119.
6. On or about November 6, 1995 the Plaintiffs by and
through their agent, Heritage Builders. entered into a
written contract with the Defendants wherein the Defendants
agreed to perform certain landscaping services for the
Plaintiffs at the Sunderland Residence for a price of
$50,000.00,
A true and correct copy of the contract is

attached hereto marked "Exhibit A" and made as part hereof.
7. Pursuant to the terms of the conl;ract and request
by the DE[ ~''1dants the Plaintiffs paid the Defendants the sum
of $12,500.00 on November 7, 1995 and $6,500.00 on February
23, 1996 fa. total payments of $19,000.00.
8. 1'he Defendants have failed to per form and comply
with the terms of the parties' written contract and have
breached the terms thereof in that the Defendants:
a. did not complete their obligations under the

landscaping plants of the caliper, size and
quality specified in the contract;

c, did not install the landscaping plants
properly in a good and workmanlike manner by
planting them at an imprcper depth;
~. did not install the stone walls properly in a
good and workmanlike manner by failing to
provide a drainage base or stone drainage
behind them,
9. The costs of correcting the Defendants improper
work and in completing the contract is greatly in excess of
the contract price between the Plaintiffs and Defendants.
10. The Plaintiffs have not retained the benefit of the
Defendants I partial performance since the plants suppiled by
the Defendnats were unuseable and not of the agreed upon
quality, size or caliper,
11. '!'he Plaintiffs have been damaged by the Defendant I s
breach of ~he Agreement by the $19,000.00 amount paid by the
Plaintiffs to the Defendants
12, '7i1e Plaintiffs have demanded the Defendants
reimbure :;l;e Plaintiffs for the said $19,000.00 but the

Defendants have failed and refused to pay the same.
13. The Plaintiffs have complied with all of their
obligations under the Agreement.
WHEREFORE the Plaintiff's demand judgement be entered
against the Defendant's in the amount of $19,000.00 plus

A. All planting, Sodding, trees, irrigation,

Only, for a period of 1 year and will provide
a 1 year guarantee on plants, trees, and

begin once all trees and shrubs have been

C. Irrigation system to be RainBird 1800 series.
Irrigation is to COver all landscaped areas

file this Complaint against the above referenced Defendants,
whereof the fOllowing is a statement:
1. The Plaintiffs are Klare S, Sunderland and Lea R.
Sunderland, adult individuals residing at 7 Deerburn Court,
Mechanicsburg, PA.
2, The Defendants are Jay R. King and Mark A. King,
adult individuals trading and doing business as King'S
Landscaping and having a business address of 1651 Baltimore
Pike, Hanover, York County Pa, 17331,
3. At all times herein relevant, Plaintiffs were and
have continued to be the owners of a certain tract of real
estate known as Lot 102, The Peninsula Subdivision, 7

Deerburn Court, Mechanicsburg, PA" hereafter referred to as
the "Sunderland Residence,"
4, At all times herein relevant the Defendants have
been in the landscaping business offering and supplying
landscaping services and products to members of the general
public,
5. At all times herein relevant the Plaintiffs were
dealing with the Defendants by and through the Plaintiffs'
contractor and agent, Heritage Builders, of 6968 Birchwood
Road, Harrisburg, Pa. 17119.
6. On or about November 6, 1995 the Plaintiffs by and
through their agent, Heritage Builders, entered into a
written contract with the Defendants wherein the Defendants
agreed to perform certain landscaping services for the
Plaintiffs at the Sunderland Residence for a price of
$50,000,00.
A true and correct copy of the contract is
attached hereto marked "Exhibit A" and made as part hereof,
7. Pursuant to the terms of the contract and request
by the Defendants the Plaintiffs paid the Defendants the sum
of $12,500,00 on November 7, 1995 and $6,500.00 on February
23, 1996 for total payments of $19,000,00.
8, The Defendants have failed to perform and comply
with the terms of the parties' written contract and have
breached the terms thereof in that the Defendants:
a, did not complete the i r obligations under the

c, did not install the landscaping plants
properlY in a good and workmanlike manner by
planting them at an improper depth;
d. did not install the stone walls properly in a
good and workmanlike manner by failing to
provide a drainage base or stone drainage
behind them.
9, The costs of correcting the Defendants improper
work and in completing the contract is greatly in excess of
the contract price between the plaintiffs and Defendants.
10. The plaintiffs have not retained the benefit of the
Defendants I partial performance since the plants suppiled by
the Defendnats were unuseable and not of the agreed upon
quality, size or caliper,
11, The plaintiffS have been damaged by the Defendant's
breach of the Agreement by the $19,000,00 amount paid by the
plaintiffs to the Defendants
12, The plaintiffs have demanded the Defendants
reimbure the plaintiffS for the said $19,000.00 but the
Defendants have failed and refused to pay the same.
13. The plaintiffS have complied with all of their

WHEREFORE the Plaintiff's demand judgement be entered

Work to be completed is as follows:
A. All planting, sodding, trees, irrigation,
retaining walls, and mUlching to be installed
according to landscape plan 095-1 and
landscape plant list 095-2. In addition,
to 325 plant allowance for terraced area in
front of house and deletion of Burning bush
in substitution for Glossy Abellia or any
plant of equal value.
B. Kings is to maintain landscape planting areas
only, for a period of 1 year and will provide
a 1 year guarantEe on plants, trees, and
irrigation system. The one year periOd will
begin once all trees and shrubs have been
planted and when the irrigation system has
been completely installed and found to be
working. (Does not include remulching.)
C. Irrigation system to be RainBird 1800 series.
Irrigation is to cover all landscaped areas
as well as SOdding/new lawn area.
D. All sod to be 100% Bluegrass. Sod all
disturbed areas.
E. Any changes to contract in regards to extra
cost shall be signed in writing by both
Heritage Builders and KING'S LANDSCAPING.

substitute any plant of equal value.
G. Total Completion of job is to be done by
December 20, 1995.
H. The job is to be started within 14 days of
receiving deposit and signing of contract.

PAYMENT TERMS
Total contract price $50,000.00
Breakdown: $12,500.00 due upon signing of contract
$12,500.00 due upon 50% completion of job
$12,500.00 due upon 75% completion of job
$12,500.00 upon total completion
