COUNT I
LEGAL INSUFFICIENCY OF COMPLAINT
4. In Paragraphs 28 and 29, Plaintiff alleges a violalion of "Plaintiffs
eighth, [sic] and fourteenth amendment rights to be free from cruel and unusual
punishmenl" through Defendants' alleged failure to provide Plaintiff wilh medical
treatmenl.
5. Although Plaintiff alleges a general violation of the eighth and
fourteenth amendments of the United States Constilulion, Plaintiff fails to allege a
violation of any federal or slate slatule by Defendants.
6, Plaintiff fails to allege in the Complaint that any of Defendants'
actions were a result of a deliberate indifference to Plaintiffs serious medical needs.
COUNT II
LEGAL INSUFFICIENCY OF COMPLAINT
7. In Paragraphs 30 and 31, Plaintiff alleges a violation of Article I, fi 1
and ~ 13 of the Pennsylvania Constitulion when Defendants allegedly failed to provide
Plainliff with medical treatment,

Courl of Common Pleas,
11. It is inappropriate to allege a violation of a criminal slatute in a civil
law SUil which requests relief in the form of a declaratory judgment, an injunclion, and an
award of compensatory and punitive damages,

THE BACKGROUND OF THIS ORDER IS AS FOLLOWS:
On January B, 1997, Plaintiff Raymond Warme, an inmate at
the State Correctional Institution at Camp Hill ("SCI-Camp Hill"),
filed a complaint in the Court of Common Pleas of Cumberland
County, Pennsylvania, alleging violations of the United States and
Pennsylvania Constituticns and 1B Pa.C.S.A. 52705. The Defendants
are Martin Lasky, medical director at SCI-Camp Hill; William Young,
a medical doctor at SCI-Camp Hill; Theresa Law, Health Care
Administrator at SCI-Camp Hlll; and John Palakovich, an employee of
SCI-Camp Hill, On February 26, 1997, Defendants Law and
Palakovich, with the concurrence of the other Defendants, removed
this case to this Court. Warme is proceeding pro se.
The Clerk of Court assigned responsibility for this case to
us but referred it to United States Magistrate Judge J. Andrew
Smyser for preliminary consideration.
On July 2, 1997, Magistrate Judge Smyser issued a report in

official capacities and denied in all other respects and that the
motion to dismiss of Defendants Lasky and Young be denied. No
objections were filed to Magistrate Judge Smyser's report and
recommendation,
In their motion to dismiss, Law and Palakovich aver that
this Court lacks subject matter jurisdiction over Warmers claims
against them in their official capacities. 28 U.S.C. ~1447(c)
states in pertinent part:
If at any time before final judgment [in a case which has
been removed from state court] it appears that the district
court lacks subject matter jurisdiction, the case shall be
remanded.
The Eleventh Amendment to the United States Constitution prevents a
district court from exercising subject matter jurisdiction over
claims against states and state agencies, Roach v, West Virginia
Regional Jail and Correctional Facility Authority, 74 F.3d 46, 49
(4th Cir, 1996). Law and Palakovich have removed this case to this
Court and have subsequently challenged our jurisdiction to hear
some of Warmers claims against them. When a case has been removed
from state court and is barred by the Eleventh Amendment to the
United States Constitution, a district court must remand the case
to the state court in which the case originated, Roach, 74 F.3d at
49; Clyde v, Thornburgh, 533 F, Supp. 279, 282 (E.D. Pa, 1982)
(Luongo, J,),
Because we lack jurisdiction over Warmers claims against Law
and Palakovich, we will remand this case to the Court of Common
Pleas of Cumberland County, Pennsylvania. Although we lack

jurisdiction over only some of Warme's claims against some of the
Defendants in this action, we are of the view that it would be
inappropriate to split the claims set forth in Warme's complaint
between two courts. Consequently, we will remand the entire case
to state court. In light of the clear statutory language of 28
U,S.C, ~1447(c), we consider it inappropriate for the Commonwealth
Defendants to have removed this case to this Court.
Because we lack subject matter jurisdiction over some of
Warme's claims and decline to exercise jurisdiction over the
remainder of the claims, we will decline to address the merits of
Defendants' motions to dismiss. We will instead for statistical
purposes deny the motions as moot, For the reasons set forth
above, we will also de~line to adopt Magistrate Judge Smyser's
report and recommendation.
NOW, THEREFORE, IT IS ORDERED THAT:
1, We decline to adopt the report and recommendation of
Magistrate Judge Smyser (Document 21) .
2, This case is remanded to the Court of Common Pleas of
Cumberland County, Pennsylvania,
3. For statistical purposes, the motion to dismiss filed
by Defendants Law and palakovich (Document 6) is denied as moot.
4, For statistical purposes, the motion to dismiss filed
by Defendants Lasky and Young (Document 10) is denied as moot.
5, The Clerk of Court shall send a copy of this order to
Magistrate Judge Smyser.
