THE MASTER: Today is Friday, March 24, 2000.
This is the date set for a pre-hearing conference in the
This action was commenced by the filing of a
above captioned divorce proceedings. Present in the
conference room are the Plaintiff, Donna A. Spangler, and
her counsel Kathy M. Shughart, and the Defendant, Eric J.W.
Spangler, and his counsel Michael S. Travis.
divorce complaint on January 13, 1997, raising grounds for
divorce of irretrievable breakdown 0f the marriage and
indignities. Counsel indicated that the parties will sign
and file affidavits of consent and waivers of notice of
intention to request entry of divorce decree so that the
divorce can be concluded under Section 3301(c) of the
Domestic Relations Code.
Those affidavits and waivers
should be filed within seven days of today's date with the
Prothonotary. With respect to the indignities claim, that
action was non-prossed because of failure to file a Bill of
Particulars.
The Defendant filed a counterclaim on June 2,
1999, raising the economic issue of equitable distribution;
the Plaintiff filed an amended complaint on September 2,
1999, raising the economic claims of alimony, alimony
pendente lite, and Counsel fees and costs.
The parties were married on November 16,
1991, and separated January 19, 1997. The parties are the
natural parents of three children, Shannon Ashley, born
February 11, 1988; Ryan Joseph, born February 20, 1990; and
Kevin Michael, born June 28, 1992. The parties, by
agreement on June 30, 1998, stipulated that the children
would be in the primary custody of wife.
After negotiations this morning, counsel have
indicated that the parties have reached an agreement with
respect to the outstanding economic issues.
An agreement is going to be placed on the
record in the presence of the parties. No changes can be
made to the substantive agreement as placed on the record;
however, the parties and counsel can review the draft of the
agreement for typographical errors and can make any
correction of typographical errors as required. Once the
agreement has been transcribed and any corrections of
typographical errors have been made, the parties will be
requested to affix their signatures affirming the terms of
settlement as placed on the record.
However, after the agreement has been placed
on the record, no substantive changes can be made to the
agreement even though the agreement is not signed; the

parties will be bound by the terms of the settlement whell
they leave this hearing room.
When the Master receives a signed copy of
the agreement affirming the terms of settlement, or if the
parties or one of the parties refuses to sign, the Master
will proceed to prepare an order vacating his appointment so
that counsel can prepare a praecipe transmitting the record
to the Court requesting a final decree in divorce.

errors rather than having the parties and counsel return
later today to do the review. Mr. Travis.
MR. TRAVIS:
l. With respect to division of personal property, the
parties have agreed to divide between them and have already
divided between them, to their mutual satisfaction, joint
bank accounts, stock portfolios, personal effects, household
furniture and furnishing and all other articles of personal
property used in common.
Husband specifically retains ownership of his Merck stock
options; his investment savings account, No. l75092; his
ESPP with his employer; certificate of deposit, No.
135439-40; checking account, No. 135439-11; savings account,
No. 135439-01; and securities account, No. 1075-48459.
Wife specifically retains ownership of her checking account,
No. 159393-11; savings account, No. 159393-01.
Husband will retain control of the certificates of deposit
investments for the children which are deemed property for
the children.
2. In exchange for the above mutual agreements contained
through this agreement, husband shall pay to wife the sum of
$100,000.00 cash. The payment of the $100,000.00 will be
made within thirty (30) days to wife.
3. The voluntary payments for wife and children in the
amount of $450.00 per week shall continue until April 1,
2000. At that time the child support will be $1,375.00 per
month and wife will receive alimony in the amount of $575.00
per month. The alimony paid to wife will be non-modifiable
and shall be paid for a period of sixty (60) months
beginning in the month in which the divorce decree is
entered. The payment of alimony shall terminate in the
event that either party dies or wife cohabits with a person
of the opposite sex or remarries. The alimony shall
automatically terminate upon the receipt by wife of the 60th
payment.
4. With respect to life insurance, husband will maintain a
life insurance policy naming the children as the
beneficiaries of his policy in an amount not less than
$l50,OOO.00 until the youngest child reaches the age of 18.
5. With respect to automobiles, the parties are owners
of two automobiles, a 1999 Isuzu Trooper and a 1993
Chevrolet Lumina driven by wife. Neither car is encumbered
by a loan. Wife shall have sole and exclusive possession of
the Chevrolet Lumina and husband shall have sole and
exclusive possession of the Isuzu Trooper. Husband shall
also have title to a 1994 motorcycle and the parties will
take whatever action is required to transfer documents of
ownership as soon as possible following entry of the divorce
decree.
Both parcies agree to assume all responsibility and hold
each other harmless for any and all liability, costs and
expenses associated with the ownership of the above
vehicles. Cost for any transfer or fees shall be borne
equally by the parties.
6. With respect to distribution of the real property,
husband and wife hold title as tenants by the entireties to
the premises identified as 418 Linden Street, Mechanicsburg,
Pennsylvania. The parties agree that wife shall have sole
and exclusive possession of the property. Husband shall
transfer to wife his right, title, and interest in said real
estate within thirty (30) days of today's date. Husband's
counsel shall hold the deed to the property until it is
refinanced. There is also a mortgage encumbering the
property with GMAC Bank in the approximate amount of
$79,000.00. Wife shall obtain a refinance or have the
mortgage assigned to her name within a period of three (3)
years. If she fails to have the property either assigned
or refinanced in her llame, at that point, the property will
be listed for sale with all agent acceptable to both parties
and any equity on the sale of the property would be the
property of wife. Any costs incurred in a refinance will be
borne equally between the parties. Upon wife's refinancing
the property, husband's counsel shall deliver the deed to
wife.
7. With respect to pension and retirement accounts,
husband and wife shall maintain separate pensions, IRAs
and/or retirement accounts. Wife relinquishes any and all
right, title, and interest she may have in existing or
future retirement assets or benefits of husband's pension,
retirement, cash balance retirement plan, 401 (k), investment
savings, ESPP or other accounts.
Husband also relinquishes any right, title, and interest he
may have in all existing or future retirement assets or
benefits of wife's pension, retirement, 401(k), or similar
accounts.
B. With respect to medical insurance, husband and wife
shall be responsible for providing their own medical
insurance. The parties agree to hold each other harmless
for the costs of obtaining any insurance and for medical
expenses not covered by insurance after the divorce. Also,
with respect to medical insurance, husband shall continue to
provide medical insurance for the children.
9. With respect to marital debts, there are no marital
debts of the marriage other than individual student loans.
The parties agree to be responsible for their own student
loans. The parties agree that neither has contracted for
any debts or other obligations since separation.
10. With respect to filing of taxes, husband nnd wife agree
to file separate tax returns for the tax year in which the
divorce decree is entered. Wife will take the deduction for
the mortgage and related expenses and an exemption for the
minor child, Ryan. Husband will have the exemption for
Shannon and Kevin. This is to continue until the children
are no longer dependents.
1l. With respect to counsel fees, each party shall be
responsible for paying his or her own legal fees and
expenses. However, husband has advanced $2,000.00 for
payment of wife's counsel fees which shall be deducted from
the cash lump sum payment of $100,000.00.
l2. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishe& any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims,

dated June 9, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on January 13, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. No economic claims were raised in the
complaint.
On June 2, 1999, the Defendant filed an answer to the
complaint and a counter.claim. The counterclaim raised the
economic claim of equitable distribution.
I am going to proceed on the assumption that grounds for
divorce are not an issue and that the parties will either sign
affidavits of consent or have been separated for a period in
excess of two years. Based on that assumption, I am directing
each counsel to file a pretrial statement in accordance with
P.R.C.P. 1920.33(b) on or before, Friday, July 9, 1999. Upon
receipt of the pre-trial statements, I will immediately schedule
a prehearing conference with counsel to discuss the issues and,

Wife will receive the house, Chevy Lumina, and $75,000.00 cash. Wife agrees to obtain
home mortgage in her name. Husband will pay for the motorcycle debt, and both parties will be
responsible for any individual credit card debts.
Husband will pay $ I ,21 1.00 in child support, which includes the amount o(
unreimbursed daycare. Additionally, husband will pay the amount ofS377.00/montl1 for two
years in alimon)'.
In return, Wife waives here right to receive any additional spousal support, alimony,
alimony pendent elite. and any interest in Husband's Pension, 401(k), ESPP or other retirement
or benefit account. She will maintain her own health insurance, and Husband will manage the
children's savings. formerly in certificates of deposit. The parties will file ajoint tax return for
the year 1998 and separate income tax ren.:ms for the year 1999. They will jointly divide any

1999, raising the economic claims of alimony, al imony
pendente lite, and counsel fees and costs,
The parties were married on November 16,
1991, and separated January 19, 1997, The parties are the
natural parents of three children, Shannon Ashley, born
February 11, 1988; Ryan Joseph, born February 20, 1990; and
Kevin Michael, born June 28, 1992, The parties, by
agreement on June 30, 1998, stipulated that the children
would be in the primary custody of wife,
After negotiations this morning, counsel have
indicated that the parties have reached an agreement with
respect to the outstanding economic issues,
An agreement is going to be placed on the
record in the presence of the parties, No changes can be
made to the substantive agreement as placed on the record;
however, the parties and counsel can review the draft of the
agreement for typographical errors and can make any
correction of typographical errors as required. Once the
agreement has been transcribed and any corrections of
typographical errors have been made, the parties will be
requested to affix their signatures affirming the terms of
settlement as placed on the record,
However, after the agreement has been placed
on the record, no substantive changes can be made to the
agreement even though the agreement is not signed; the
parties will be bound by the terms of the settlement when
they leave this hearing room,
When the Master receives a signed copy of
the agreement affirming the terms of settlement, or if the
parties or one of the parties refuses to sign, the Master
will proceed to prepare an order vacating his appointment so
that counsel can prepare a praecipe transmitting the record
to the Court requesting a final decree in divorce,

errors rather than having the parties and counsel return

MR, TRAVIS:
1. With respect to division of personal property, the
parties have agreed to divide between them and have already
divided between them, to their mutual satisfaction, joint
bank accounts, stock portfolios, personal effects, household
furniture and furnishing and all other articles of personal
property used in common,
Husband specifically retains ownership of his Merck stock
options; his investment savings account, No. 175092; his
ESPP with his employer; certificate of deposit, No,
135439-40; checking account, No, 135439-11; savings account,
No. 135439-01; and securities account, No, 1075-48459,
Wife specifically retains ownership of her checking account,
No, 159393-11; savings account, No, 159393-01,
Husband will retain control of the certificates of deposit
investments for the children which are deemed property for
the children.
2. In exchange for the above mutual agreements contained
through this agreement, husband shall pay to wife the sum of
$100,000,00 cash, The payment of the $100,000.00 will be

amount of $450,00 per week shall continue until April 1,
2000, At that time the child support will be $1,375.00 per
month and wife will receive alimony in the amount of $575,00
per month, The alimony paid to wife will be non-modifiable
and shall be paid for a period of sixty (60) months
beginning in the month in which the divorce decree is
entered, The payment of alimony shall terminate in the
event that either party dies or wife cohabits with a person
of the opposite sex or remarries, The alimony shall
automatically terminate upon the receipt by wife of the 60th

4, With respect to life insurance, husband will maintain a
life insurance policy naming the children as the
beneficiaries of his policy in an amount not less than
$150,000.00 until the youngest child reaches the age of 18.
5. With respect to automobiles, the parties are owners
of two automobiles, a 1999 Isuzu Trooper and a 1993
Chevrolet Lumina driven by wife, Neither car is encumbered
by a loan, Wife shall have sole and exclusive possession of
the Chevrolet Lumina and husband shall have sole and
exclusive possession of the Isuzu Trooper, Husband shall
also have title to a 1994 motorcycle and the parties will
take whatever action is required to transfer documents of
ownership as soon as possible following entry of the divorce
decree,
Both parties agree to assume all responsibility and hold
each other harmless for any and all liability, costs and
expenses associated with the ownership of the above
vehicles, Cost for any transfer or fees shall be borne
equally by the parties,
6. With respect to distribution of the real property,
::'lsband and wife hold title as tenants by the entireties to
the premises identified as 418 Linden Street, Mechanicsburg,
Pennsylvania, The parties agree that wife shall have sole
and exclusive possession of the property, Husband shall
transfer to wife his right, title, and interest in said real
estate within thirty (30) days of today's date, Husband's
counsel shall hold the deed to the property until it is
refinanced, There is also a mortgage encumbering the
property with GMAC Bank in the approximate amount of
$79,000.00, Wife shall obtain a refinance or have the
mortgage assigned to her name within a period of three (3)
years. If she fails to have the property either assigned
or refinanced in her name, at that point, the property will
be listed for sale with an agent acceptable to both parties
and any equity on the sale of the property would be the
property of wife, Any costs incurred in a refinance will be
borne equally between the parties. Upon wife's refinancing
the property, husband's counsel shall deliver the deed to
wife.
7, With respect to pension and retirement accounts,
husband and wife shall maintain separate pensions, lRAs
and/or retirement accounts, Wife relinquishes any and all
right, title, and interest she may have in existing or
future retirement assets or benefits of husband's pension,
retirement, cash balance retirement plan, 40l(k), investment
savings, ESPP or other accounts,
Husband also relinquishes any right, title, and interest he
may have in all existing or future retirement assets or
benefits of wife's pension, retirement, 40l(k), or similar
accounts.
8, With respect to medical insurance, husband and wife
shall be responsible for providing their own medical
insurance. The parties agree to hold each other harmless
for the costs of obtaining any insurance and for medical
expenses not covered by insurance after the divorce, Also,
with respect to medical insurance, husband shall continue to
provide medical insurance for the children,
9, With respect to marital debts, there are no marital
debts of the marriage other than individual student loans.
The parties agree to be responsible for their own student
loans, The parties agree that neither has contracted for
any debts or other obligations since separation,
10, With respect to filing of taxes, husband and wife agree
to file separate tax returns for the tax year in which the
divorce decree is entered. Wife will take the deduction for
the mortgage and related expenses and an exemption for the
minor child, Ryan. Husband will have the exemption for
Shannon and Kevin. This is to continue until the children
are no longer dependents,
11, With respect to counsel fees, each party shall be
responsible for paying his or her own legal fees and
expenses. However, husband has advanced $2,000.00 for
payment of wife's counsel fees which shall be deducted from
the cash lump sum payment of $100,000,00.
12. Except as herein otherwise provided, each party may

ratify and affirm the agreement previously made and intend
to bind myself to the settlement as a contract obligating
myself to the terms of settlement and subjecting myself to
the methods and procedures of enforcement which may be
imposed by law and in particular Section 3105 of the
Domestic Relations Code.

"Mother," ERIC J, W. SPANGLER, hereinafter referred to as "Father,"
WHEREAS, Mother and Father are the natural parents of three minor
children, Shannon Ashley Spangler, born February 11, 1988; Ryan Joseph
Spangler, born February 20. 1990; and Kevin Michael Spangler, born June
28, 1992; and
WHEREAS. Mother and Father were married on November 16, 1991;
and
WHEREAS. Mother and Father have since separated; and
WHEREAS, Mother filed a divorce action on January 15, 1997; and
WHEREAS, the parties desire to act in the best interest of the minor
children; and
WHEREAS, the parties desire to settle and resolve the questions of
custody of the minor children;
NOW THEREFORE, it is agreed and stipulated by the pa..ties as
follows:
1, LEGAL CUSTODY Mother and Father share joint legal custody
of the minor children,
2, PHYSICAL CUSTODY
A, Mother shall have prirnary physical custody of the minor
children, Shannon Ashley Spangler, Ryan Joseph Spangler, and Kevin
Michael Spangler.
B, Father shall enjoy liberal partial physical custody rights with
a rninimum of alternating weekends from Friday at 5:00 p.rn. until Sunday at
5:00 p,m" and such other mutually agreeable tirnes as determined by the
parties,
3, HOLIDAYS
A, The parties shall alternate the holidays of Memorial Day,
Fourth of July, Labor Day and Thanksgiving. In odd numbered years, Father
shall have Memorial Day and Labor Day and Mother shall have Fourth of July
and Thanksgiving, In even nurnbered years Mother shall have Memoriel Day
and Labor Day and Father shall have Fourth of July and Thanksgiving,
Holiday visits shall be from 9:00 a.m. until 6:00 p,m,
B. The day of the children's birthday's and Easter shall be split
between Father and Mother as mutually agreed.
C, The Christmas holiday shall be split into segments as
follows: Segment A shall consist of 12:00 noon on Christmas Eve until
12:00 noon on Christmas Day and 12:00 noon on December 29th to 5:00
p,m. on January 1 st. Segment B shall consist of 12:00 noon on Christrnas
Day until 12:00 noon on Decernber 29th. In odd numbered years, Mother
shall have Segment A and Father shall have Segment B. Conversely, in even
nurnbered years, Mother shall have Segment B and Father shall have
Segment A,
D, Father shall enjoy custody from 9:00 a.m, until 6:00 p,m.
on Father's Day and on his birthday,
E. Mother shall enjoy custody from 9:00 a.m. until 6:00 p.rn,
on Mother's Day and on her birthday.
F. The holiday schedule shall supersede the regular alternating
weekend schedule.
4, SUMMER VACATION
