Then the defendant threatened to kill the plaintiff and her 16-year old daughter, Bianca Leonhard, picked a large stereo speaker up off of the floor, and threatened to throw it at them. The plaintiff sustained swelling, soreness, and bruising about her ankle as a result of this incident and sought medical allention for her injury at the Carlisle Hospital. b) In or about the fall of 1996, the defendant pushed the plaintiff into the bathroom, struck her about her head with a hair brush several times breaking the brush on her head, pulled the towel rack off of the wall, and struck her on the head with it. When the plaintitT ran from the defendant, he followed her into the hallway, and as she crouched on the floor in a fetal position to protect herself. the defendant pummeled her with his fists about her body, pulled at her clothing and her hair, and pressed his hand over her mouth and nose preventing her from breathing. Then the defendant grabbed a broom and brandished the handle like a spear and repeatedly thrust it at the plaintiff and the children and swung the handle about causing them to fear he was going to strike them with it. c) On or about September 14, 1994, the defendant grabbed the plaintiff by the front of her hair and jerked her head down to the floor in one swift and forceful movement. The plaintiff sustained soreness and immobility to her neck as a result of this incident. The plaintiff sought medical allention ITom her family physician and missed three days of work. 5. The plaintiff believes and therefore avers that she and her minor child, Bianca Leonhard, are in immediate and present danger of abuse from the defendant and that they are in need of protection from such abuse. 6. The plaintiff desires that the delendant be enjoined Irom harassing and stalking the plaintiff, and from harassing her relatives, or the minor children 7. The incident that led to this charge occurred last evening at his home here in Cumberland County and involved a minor injury to the finger of his daughter, Bianca, who was one of the parties on Judge Bayley's order that he is enjoined from abusing. At the hearing today the Defendant was represented by Arla Waller, Esquire, Assistant Public Defender. The parties worked out an agreement in which the Defendant admits that he is in contempt for violating Judge Bayley's order. The parties agreed that there would be no jail term imposed by me and that the Defendant would be removing himself completely from his house by Friday, February 14, 1997.
