Whereas, Paul E. Smith and Wendy J. Smith, of Cumberland County,
Pennsylvania is about to execute contemporaneously herewith, a
contract, with Haubert Homes Inc., of 2151 Linglestown Road, Suite
200, liarrisburg, pennsyl'lania for the ere-::tion of a two story,
frame dwelling upon a lot of land situate on Lot Number 57,
Wetherburn Road, Enola, Pennsylvania bounded and described as
follows, to wit:
BEGINNING at a point on the northern dedicated right-of-way
line of Wetherburn Road (50' wide) at the dividing line of Lot No.
58 and Lot No. 57, said point also being located 168.60 feet west
of the western extremity of an arc connecting the northern
dedicated right-of-way line of Wetherburn Road and the western
dedicated right-of-way line of Cavan Crossing (50' wide); thence
by the northern right-of-way line of Wetherburn Road by a curve to
the right having a radius of 125.00 feet and an arc length of 61.02
feet to a point; thence by same North 46 degrees 02 minutes 54
seconds West 42.76 feet to a point; thence by line of Lot No. 56
North 43 degrees 57 minutes 06 seconds East 110.00 feet to a point;
thence by other lands of Logans Run, phase III South 46 degrees 02
minutes 54 seconds East 42.88 feet to a point; thence continuing
by other lands of Logans Run, phase III South 57 degrees 00 minutes
56 seconds East 7.25 feet to a point; thence by line of Lot No. 58
South 15 degrees 58 minutes 58 seconds West 109.58 feet to a point,
the place of BEGINNING.
CONTAINING approximately 8,464 square feet.
Being Lot No 57 on the Final subdivision Plan of Logans Run,
Phase II, recorded July 13, 1994, in plan Book 68, Page 50.
BEING the same property which Logan's Run Associates, by its
deed of even date and about to be recorded in~he Cumberland County
Recorder of Deeds office has granted and conveyed to Paul E. Smith
and Wendy J. Smith, his wife.
NOW, January 10, 1997, at the time of and immediately before
the execution of the principal contract, and before any authority
has been given by the said OWNER to the said CONTRACTOR to commence
work on the said building, or purchase materials for the same in
consideration of the making of the said contract with OWNER and the
further consideration of One Dollar, to CONTRACTOR paid by OWNER
it is agreed that no lien shall be filed against the building by
the contractor, or any sub-contractor, nor by any of the material
men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly
waived.
