HomeMy WebLinkAbout97-00238 9 '7, ,) 2 J'/ (17 j, D ~R /J 1'1 RELEASE OF MECHANICS' 1,1 ENS WAIVER OF MECHANICS' CLAIM WE, THE UNDERSIGNED Contractor and Subcontractors, for and in consideration of the sum of One Dollar ($1,00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged do, for ourselves, our respective heirs, executors, administrators, successors andjor assigns remise, release and waive, to and in favor of FIGLIO MIO VIBAGGIO, INC., Owner of the below described property, its successors and assigns, our right under the Mechanics Lien Law of 1963, Act of August 24, 1963, P,L, 1175 No, 497 (49 P,S, 5 1101, et seq.) as amended, to file or enter on record any Mechanics' Lien or Liens, Mechanics' claim or claims on or against: ALL THAT CERTAIN tract or parcel of land situate in Silver spring Township, Cumberland County, Pennsylvania, identified as Tract 2 on Final Limited Subdivision Plan of Two Lots for Larry Hatter & J. Marc Bauerle prepared by Hartman & Associates, Inc, dated April 20, 1993, last revised June 11, 1993, and recorded in Cumberland County Plan Book 66, Page 92, being more particularly bounded and described as follows, to wit: LAW Of/leu; BEGINNING at a point, said point being located on the southern legal right-of-way line of the Carlisle pike (U,S, Route 11) and the western legal right-of-way line of Maple Drive; thence along the western legal right- Of-way line of Maple Drive South 08 degrees 45 minutes 00 seconds East a distance of 150,77 feet to a point on the northern legal right-of-way line of Birch street; thence along same North 86 degrees 36 minutes 40 seconds West a distance of 198,63 feet to a concrete monument at the southeastern corner of Silver Spring Plaza, A Condominium; thence along same North 03 degrees 53 minutes 39 seconds East a distance of 146,99 SNnOAKER. e"ENNCMAN 6. SPARr ~ t \ feet to a P,K, nail (set) on the southern legal right- of-way line of Carlisle Pike aforementioned; thence along same South 86 degrees 45 minutes 00 seconds East a distance of 166,38 feet to the point and place of BEGINNING, BEING the same premises which J, Marc Bauerle and Larry L, Hatter, co-partners, t/d/b/a Stor-Mor, a Pennsylvania partnership by their deed dated August 2, 1993 and recorded August 3, 1993 in the Office of the Recorder of Deeds for Cumberland County, Pennsylvania in Deed Book "L", Volume 36, Page 200, granted and conveyed unto Figlio Mio Visaggio, Inc, for any and all work done upon and materials furnished by us in the erection, building, repair, alteration and/or completion of the above parcel or any structure thereon (the "project") or that may be hereafter done or furnished on the same, so that a certain mortgage from the Financial Trust Company to the said Owner secured or to be secured by the above-described property shall be a first lien on said property, so far as our claims are concerned, The undersigned Contractor hereby further certifies and warrants that the below identified Subcontractors constitute all Subcontractors who have provided work or materials on or for the above project and that this Release and Waiver shall bind any other subcontractors or materialmen who may provide work or materials after the date hereof and who are not identified below, L.^W OFFlCe!l SNELDAKE:R.
