WHEREAS, KIMBERLY K. WEAVER, of 213 West Coover Street,
Mechanicsburg, Pennsylvania, 17055 (hereinafter called "Owner")
is about to execute contemporaneously herewith, a contract, with
S ~ A CUSTOM BUILT HOMES, a Pennsylvania corporation having an
office address of 1147 Harrisburg Pike, Carlisle, Pennsylvania
17013 (hereinafter called "Contractor"), for the erection of a
two (2) story residential building upon a lot of land described
as:
ALL THAT CERTAIN tract or parcel of land situate in South
Middleton Township, Cumberland County, Pennsylvania,
containing 20,450.98 square feet and being described as
Lot No. 23, Phase I of Forgedale Crossing, which plan is
recorded in the Cumberland County Recorder of Deeds Office
in Plan Book 64, Page 93.
NOW, January IltL, 1997, at the time of and immediately
before the executio~e principal contract, and before any
authority has been given by the said Owner to the said Contractor
to commence work on the said building, or to purchase materials
for the same, in consideration of the making of the said contract
with Contractor and the further consideration of One and 00/100
($1.00) Dollar, to Contractor paid by Owner, it is agreed that no
lien shall be filed against the above described premises and the
building and improvements to be erected thereon, by the
contractor, or any subcontractor, or by any of the materialmen or
workmen, or any other person for any labor provided or materials
purchased, or for extra labor provided or materials purchased for
the erection of said building and improvements, the right to file
such liens being expressly waived.
This Stipulation is made and intended to be filed with the
County Prothonotary within ten (10) days after date, in
accordance with requirements of Act of Assemble of Pennsylvania,
in such case provided.
