NOTICE
You have been sued in Court. If you wish to defend against
the claims set forth in the following pages, you must take action
within twenty (20) days after this Complaint and Notice are served
by entering with the Court your defenses to the claims set forth
against you. You are warned that if you fail to do so the case you
proceed without you as a Judgment may be entered against you by the
Court without further notice for any money claimed in the Complaint
or for any other claim or relief requested by the Plaintiff. You
may lose money or property or other rights important to you.
YOU SHOULD TAKE THIS PAPER TO YOUR LAWYER AT ONCE. IF YOU DO
NOT HAVE A LAWYER OR CANNOT AFFORD ONE, GO TO OR TELEPHONE THE

Cumberland County Recorder's Office in Mortgage Book 721, Page 620,
a copy of which is attached hereto, marked Exhibit "A", and made
a part hereof by reference, which mortgage contains and is a lien
upon the property situate at 435 Market Street, New Cumberland,
Borough of New Cumberland, Cumberland County, Pennsylvania, 17070,
being improved upon with a dwelling.
5. Said loan was further evidenced and secured by a note
which accompanied said Mortgage dated Februal'Y 17, 1983, a copy of
which is attached hereto, marked Exhibit "B", and made a part
hereof by reference.
6. Harris Savings Bank, in consideration of the said
mortgage and accompanying note, advanced to Mark W. Noll and
Kathleen J. Noll the sum of Thirty Two Thousand Five Hundred and
NO/100 Dollars ($32,500.00).
7. The premises subject to said mortgage is more
specifically set forth in Exhibit 'C' , attached hereto and made a
part hereof by reference.
8. Mark W. Noll and Kathleen J. Noll are the sole owners of
the said premises contained in said mortgage.
9. Said mortgage and note have not been assigned in whole
or in part by the Plaintiff herein.
10. Mark W. Noll and Kathleen J. Noll are the record owners
in fee simple of said premises by virtue of a Deed dated May 10,
1978 and recorded in the Cumberland County Recorder's Office in
Deed Book , Page
11. No judgment has previously been entered on said mortgage
or note in any jurisdiction, and said instruments are less than
twenty (20) years old.
12. The said mortgage is in default because Defendants herein
have failed to pay the monthly payments of $467.55 that were due
and owing for the months of June, July, August, September, October,
November and December, 1996.
13. The Plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated August 7, 1996, copies of which are marked Exhibits
"D"and "E" and attached hereto and made a part hereof by reference.
14. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
August 7, 1996, copies of which are marked Exhibits "F" and "G"
and attached hereto and made a part hereof by reference.
15. The entire principal amount of Thirty Two Thousand Five
Hundred and NO/100 Dollars ($32,500.00) has become due and payable,
together with interest at the rate of 13% per annum, reasonable
legal fees for collection of said sum in accordance with the terms
of said mortgage less such sums as have been paid on account of
principal of the said mortgage and costs.
16. The Plaintiff believes and therefore avers that
reasonable legal fees for collection is $1520.00.
17. The Defendants are liable to the Plaintiff for interest
at the rate of 13% per annum until paid and expenses as provided
in and collectible under the mortgage documents that will accrue
until distribution by the Sheriff of Cumberland County,
Pennsylvania, to be computed at the time of judgment in these
proceedings in addition to the current loan balance.
18, The Defendants are liable to the Plaintiff for the
following on said mortgage loan:
A. Principal amount and interest
due through 12/31/96 $ 31,987.79
B. Interest at the rate of
13\ from 1/1/97 to
7/14/97 $ 2,072.83
C. Late Charges $ 233.74
D. Attorney's Collection Fee S 1. 520.00
TOTAL:
$ 35,814.36
19. The Plaintiff believes and avers that neither of the
Defendants are members of the armed forces or are in the military
service of the United States of America.
WHEREFORE, the Plaintiff prays the Court to enter Judgment
against the Defendants, David W. Noll and Kathleen J. Noll, of
Mortgage Foreclosure and sale of the mortgaged property, wi th
damages in the amount of Thirty-Five Thousand Eight Hundred
Fourteen and 36/100 Dollars ($35,814.36), together with additional
interest thereon, costs and all other amounts advanced by
Plaintiff.

7. A Schedule of Distribution being a list of the persons,
governmental, corporate entities or agencies being entitled to
receive part of the ~roceeds of sal~ executed to be disbursed by
the Sheriff will be filed by the Sheriff on a date specified by the
Sheriff not later than thirty (30) days after the Sheriff's Sale,
and that distribution will be within ten (10) days thereafter.

plan by Gerrit J. Betz, R.S., dated June 11, 1970, as follows, to
wit:
BEGINNING at a point on the northeastern side of market
Street, said point being 43 feet southeast of , the intersection of
Market and Fifth Streets; thence along lands now or late of
Eichelberger North 40 degrees East 100 feet to a corner; thence
along other lands now or late of Eichelberger South 50 degrees East
37 feet to a corner; thence continuing along said lands North 40
degrees East 50 feet to a point on the southwestern side of Walnut
